THE OFFICER INCHARGE, KARGAHAR, ROHTAS\n                                            -----------\n<\/pre>\n<p>              For the Petitioner:-     Mr. Vishal Saurabh, Adv.<br \/>\n              For the Respondents:- Mr. Manoj Kumar Jha, AC to G.A.-1\n<\/p>\n<p>                                      &#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>9.   30.11.2010              Heard learned counsel for the petitioner<\/p>\n<p>                  and the State.\n<\/p>\n<p>                             The petitioner is aggrieved by the order of<\/p>\n<p>                  the District Magistrate, Rohtas at Sasaram dated<\/p>\n<p>                  20.5.2010 refusing to grant him an Arms License in<\/p>\n<p>                  Arms Case No. 82 of 2010.\n<\/p>\n<p>                             It is submitted that the father of the<\/p>\n<p>                  petitioner held a valid license for a double barrel<\/p>\n<p>                  gun. His father expired on 25.6.1997. Prior to the<\/p>\n<p>                  same, the petitioner on 26.2.1997 had applied for an<\/p>\n<p>                  Arms License in his own name. The petitioner now<\/p>\n<p>                  desires to continue and retain the double barrel gun<\/p>\n<p>                  of his father presently deposited in safe custody. It<\/p>\n<p>                  has    been      declined    notwithstanding      the<\/p>\n<p>                  recommendation by the Superintendent of Police. It<\/p>\n<p>                  is submitted that the ground mentioned in the<\/p>\n<p>                  impugned order for refusal to grant license are not<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>germane and extraneous to Section 14 of the Arms<\/p>\n<p>Act regulating the grant of license.<\/p>\n<p>           Learned counsel for the State sought to<\/p>\n<p>raise an issue with regard to the correctness of<\/p>\n<p>submission of any application by the petitioner dated<\/p>\n<p>26.2.1997. In the view of the Court that issue is no<\/p>\n<p>more relevant when the fact is not in dispute on<\/p>\n<p>behalf of the State that the Superintendent of Police<\/p>\n<p>has made a recommendation in favour of the<\/p>\n<p>petitioner. There is a presumption of the petitioner<\/p>\n<p>having applied for grant of an Arms License as in<\/p>\n<p>absence    of   the   same,   the      question   of   any<\/p>\n<p>recommendation in his favour does not arise much<\/p>\n<p>less a final order for refusal to grant the license.<\/p>\n<p>That leaves in question the correctness of the<\/p>\n<p>impugned order.\n<\/p>\n<p>           Section 14 of the Arms Act specifies the<\/p>\n<p>conditions under which the license can be refused.<\/p>\n<p>The impugned order rejects the application on the<\/p>\n<p>ground that there was no threat perception to the<\/p>\n<p>petitioner. That is not one of the grounds mentioned<\/p>\n<p>in Section 14. The stand of the State with reference<\/p>\n<p>to any executive instruction dated 31.3.2010 of the<\/p>\n<p>Union of India is best answered on the proposition<\/p>\n<p>that if the grant of license is regulated by any<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>           statutory provisions, it has to be considered strictly<\/p>\n<p>           in accordance therewith and cannot be varied or dis-<\/p>\n<p>           regarded on basis of any executive instruction.         In<\/p>\n<p>           any event, the respondents have chosen to confront<\/p>\n<p>           the   Court      with   their   own   interpretation   and<\/p>\n<p>           application of the executive instruction without even<\/p>\n<p>           placing it before the Court and then leaving it for the<\/p>\n<p>           Court to decide. The impugned order of rejection<\/p>\n<p>           dated 20.5.2010 is therefore not sustainable in law.<\/p>\n<p>           It is accordingly set aside.\n<\/p>\n<p>                         The District Magistrate is now required to<\/p>\n<p>           consider the grant of license to the petitioner in light<\/p>\n<p>           of the recommendation made by the Superintendent<\/p>\n<p>           of Police and the ground urged by the District<\/p>\n<p>           Magistrate having been found to be beyond his<\/p>\n<p>           statutory power by the Court.\n<\/p>\n<p>                         Let such fresh orders be passed by the<\/p>\n<p>           District Magistrate within a maximum period of one<\/p>\n<p>           month from the date of receipt\/production of a copy<\/p>\n<p>           of this order.\n<\/p>\n<p>                         The writ application stands allowed.<\/p>\n<pre>P.
