Public Prosecutor, Mr.L.R.Pujari for the respondent<br \/>\n\tNo.1-State.\n<\/p>\n<p>It<br \/>\n\tis submitted by learned advocate, Mr.Chaumal for the applicants that<br \/>\n\tthe applicant of Spl.Cri.Appln.No.603 of 2011 i.e. original accused<br \/>\n\tNo.1 and victim married with each other. Copy of the marriage<br \/>\n\tcertificate is placed on record. It is further submitted that at the<br \/>\n\ttime of lodging of complaint, victim was minor, however,<br \/>\n\tsubsequently on her attaining the age of majority, marriage took<br \/>\n\tplace with the applicant-original accused No.1 and now they are<br \/>\n\tstaying as wife and husband. In view of the fact that the victim and<br \/>\n\tapplicant-Nareshkumar Bhagwanji Parmar have got married at their<br \/>\n\twill, no purpose would be served if criminal complaint filed against<br \/>\n\tthe applicants are allowed to continue. It is therefore requested<br \/>\n\tthat complaint may be quashed.\n<\/p>\n<p>Victim<br \/>\n\tgirl is present before this Court. This Court has ascertained the<br \/>\n\twish of the victim girl in chamber in presence of learned advocates<br \/>\n\tfor the respective parties as well as the learned APP when she has<br \/>\n\tstated in no uncertain terms that applicant-Nareshkumar Bhagwanji<br \/>\n\tParmar is her husband and at present they are staying as wife and<br \/>\n\thusband. It is also stated by her that she left her parents on her<br \/>\n\town free will. She has also stated that as community of her husband<br \/>\n\tis different from her community, her parents are against this<br \/>\n\tmarriage and hence, the present complaint has been filed.\n<\/p>\n<p>In<br \/>\n\tview of above statement made by the victim girl to the effect that<br \/>\n\tshe left her parents and on attaining the age of majority got<br \/>\n\tmarried with the applicant-Nareshkumar Bhagwanji Parmar on her own<br \/>\n\tvolition and at present they are staying as wife and husband under<br \/>\n\tone roof,  I am of the opinion that continuance of the criminal<br \/>\n\tcomplaint filed against the applicants would be an exercise in<br \/>\n\tfutility.\n<\/p>\n<p>Reliance<br \/>\n\tis placed on a decision of the Apex Court reported in  AIR 2003<br \/>\n\tSUPREME COURT 1386 in<br \/>\n\tthe case of  B. S. Joshi v. State of Haryana<br \/>\n\twherein it has been observed by the Hon&#8217;ble Apex Court that<br \/>\n\tHigh Court can exercise inherent power for quashing of criminal<br \/>\n\tproceedings under Sec.482 of Cr.P.C. It has been held by the Apex<br \/>\n\tCourt in paras 14 and 15 of the said judgment as under:\n<\/p>\n<p>&#8220;14.\n<\/p>\n<p>\tThere is no doubt that the object of introducing Chapter XX-A<br \/>\n\tcontaining Section 498A in the Indian Penal Code was to prevent the<br \/>\n\ttorture to a woman by her husband or by relatives of her husband.<br \/>\n\tSection 498A was added with a view to punishing a husband and his<br \/>\n\trelatives who harass or torture the wife to coerce her or her<br \/>\n\trelatives to satisfy unlawful demands of dowry. The hyper-technical<br \/>\n\tview would be counter productive and would act against interests of<br \/>\n\twomen and against the object for which this provision was added.<br \/>\n\tThere is every likelihood that non-exercise of inherent power to<br \/>\n\tquash the proceedings to meet the ends of justice would prevent<br \/>\n\twomen from settling earlier. That is not the object of Chapter XXA<br \/>\n\tof Indian Penal Code.\n<\/p>\n<p>15.<br \/>\n\tIn view of the above discussion, we hold that the High Court in<br \/>\n\texercise of its inherent powers can quash criminal proceedings or<br \/>\n\tFIR or complaint and Section 320 of the Code does not limit or<br \/>\n\taffect the powers under Section 482 of the Code.&#8221;\n<\/p>\n<p>Applying<br \/>\n\tthe above ratio to the facts of the present case, I am of the<br \/>\n\topinion that no useful purpose would be served by permitting the<br \/>\n\tcriminal complaint filed against the applicants to continue. Hence,<br \/>\n\tthe complaint in question is required to be quashed.\n<\/p>\n<p>In<br \/>\n\tview of the above, complaint registered as C.R.No.I-127 of 2010<br \/>\n\tbefore Deesa Rural Police Station for the offences punishable under<br \/>\n\tSecs.363, 366, 506(2) and 114 of IPC against the applicants is<br \/>\n\tquashed. Both these Special Cri.Applications are accordingly<br \/>\n\tallowed. Rule is made absolute.
