Criminal Misc. Bail Application NO.2275\/09\n        Shiv Kumar   Vs. State of Rajasthan\n\n       Date of order         ::             16th July, 2009\n\n\n      HON'BLE MR. JUSTICE NARENDRA KUMAR JAIN\n\n\nMr.Rajesh Panwar, for the petitioner.\nMr.Anil Joshi,P.P.\n\n\n       Heard learned counsel for the petitioner\n\nas     well     as     learned     Public       Prosecutor      and\n\nperused the material\/case diary made available\n\nto me during the arguments of the case.\n\n       It     is     contended         on    behalf       of   the\n\npetitioner that as per direction of this court\n\nthe         petitioner           appeared          before      the\n\nInvestigating Officer for his interrogation and\n\nhe     has      been     interrogated           fully     by    the\n\nInvestigating           Officer        therefore,       now    his\n\npresence is not required and even if as and\n\nwhen        his presence will be required then he\n\nwill        make       himself        present       before      the\n\nInvestigating Officer.                It is further contended\n\nthat the petitioner is an advocate and there is\n\nno specific allegations against him, his role\n\nduring investigation is                such a kind of nature\n\nthat        cannot     connect        him   with    the      crime.\n\nTherefore, petitioner may be granted benefit of\n                                        2\n\nSection 438 Cr.P.C.                Learned Public Prosecutor\n\nadmits        that          the        petitioner              has        been\n\ninterrogated by the Investigating Officer as\n\nper direction of this court.\n\n      Taking      into      consideration            all       the        facts\n\nand     circumstances             of       the    case    and        without\n\nexpressing any opinion on merits and demerits\n\nof    the    case,      I    allow         this    bail    application\n\nunder Section 438 Cr.P.C.\n\n      Therefore, the S.H.O.\/I.O. Of the Police\n\nStation Hathi Pol, Udaipur is directed that in\n\nthe    event      of    arrest         of    the    petitioner             Shiv\n\nKumar       S\/o    Dr.Badri            Lal       Upadhayay           in    FIR\n\nNo.60\/09,              registered                 under          sections\n\n420,467,468,470 and 471 IPC he shall enlarge\n\nhim on bail provided he furnishes a personal\n\nbond in the sum of Rs.25,000\/-(Rupees Twenty\n\nFive Thousand only) with one surety of the like\n\namount      to    his    satisfaction on                 the    following\n\nconditions:-\n\n\n\n      (1)He shall make himself available for\n        interrogation by Investigating Officer as\n        and when required;\n\n      (2)He shall not directly or indirectly make\n        any inducement, threat or promise to any\n        person acquainted with the facts of the\n        case so as to dissuade him from disclosing\n        such facts to the court or to any police\n        officer;\n                        3\n\n      (3)He shall not leave India without   the\n        previous permission of the Court.\n\n                    (NARENDRA KUMAR JAIN), J.\n<\/pre>\n<p>ns.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Shiv Kumar vs State on 16 July, 2009 1 IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S.B.
