1.\tThis
\nis an application preferred under Section 439 of the Code of Criminal
\nProcedure, 1973 by the applicants for regular bail, who were
\narrested, in connection with F.I.R. registered as  C.R. No. I-36 of
\n2009 with Ditwas Police Station for the offence punishable under
\nSections  307, 504, 114 of the Indian Penal Code and Section 135 of
\nthe Bombay Police Act.\n<\/p>\n
2.\tLearned
\nadvocate for the applicants submitted that the applicants are
\ninnocent persons and they have not committed any crime as alleged in
\nthe F.I.R. at Annexure-A to the application. From the bare perusal of
\nthe F.I.R. it becomes clear that F.I.R. was lodged after a
\nconsiderable delay of two days. He further submitted that
\nconsidering the role attributed to the applicants which can be seen
\nfrom the F.I.R. at Annexure-A to the application and since the
\nperson, who sustained the injuries,  has now recovered and discharged
\nfrom the hospital, therefore, the applicants deserve to be enlarged
\non bail.\n<\/p>\n
3.\tLearned
\nA.P.P. Ms. Manisha L. Shah, representing the State, while opposing
\nthe bail application, submitted that the applicants are involved in a
\nserious offence punishable under Sections 307, 504, 114 of the Indian
\nPenal Code and Section 135 of the Bombay Police Act. Considering the
\nrole attributed to the applicants and the nature of the  offence in
\nwhich the applicants are involved, no lenient view be taken in the
\nmatter and the application does not call for any interference by this
\nCourt and the same is deserved to be dismissed.\n<\/p>\n
4.\tI
\nhave heard learned advocate Mr. Paresh M. Dave appearing for the
\napplicants and learned A.P.P. Ms. Manisha L. Shah appearing for the
\nState at length and in great detail. I have considered the rival
\nsubmissions, averments made in the application, role attributed to
\nthe applicants which is reflected in F.I.R. at Annexure-A to the
\napplication and the manner in which the alleged offence is committed
\nby them, provisions of Sections  307, 504, 114 of the Indian Penal
\nCode and Section 135 of the Bombay Police Act and the fact that the
\napplicants gave stick blow to the injured and threw him in the well.
\nHowever,  after taking treatment as injured has recovered and
\ndischarged from the hospital, I am of the view that the applicants
\ndeserve to be enlarged on bail.\n<\/p>\n
5.\tIn
\nthe facts and circumstances of the case, the application is allowed
\nand the applicants are ordered to be enlarged on bail in connection
\nwith  C.R. No. I-36 of 2009 registered at Ditwas Police Station, on
\nexecuting a bond of Rs. 10,000\/- (Rupees ten thousand only) each with
\none surety each of the like amount to the satisfaction of the Trial
\nCourt and subject to the conditions that they shall:\n<\/p>\n
(a)\tnot
\ntake undue advantage of  their liberty or \tabuse \ttheir liberty;\n<\/p>\n
(b)\tnot
\nact in a manner injurious to the interest of the\tprosecution;\n<\/p>\n
(c)\tsurrender
\ntheir passport, if any, to the \tlower court \twithin a \tweek.\n<\/p>\n
(d)\tnot
\nleave the State of Gujarat without the prior \tpermission of the
\n\tSessions Court concerned;\n<\/p>\n
(e)\tmark
\ntheir presence at the concerned Police \tStation \ton 1st
\nand 15th  of every English calendar month \tbetween \t9.00
\nAM and \t02.00 PM. till the trial is \tover;\n<\/p>\n
(f)\tfurnish
\nthe present address of their residence to the \tI.O. \tand \talso to the
\nCourt at the time of execution of \tthe bond and shall \tnot \tchange
\ntheir residence\twithout prior permission of this Court;\n<\/p>\n
(g)\tmaintain
\nlaw and order.\n<\/p>\n
6.\tIf
\nbreach of any of the above conditions is committed, the Sessions
\nJudge concerned will be free to issue warrant or to take appropriate
\naction in the matter.\n<\/p>\n
7.\tBail
\nbond to be executed before the lower Court having jurisdiction to try
\nthe case.\n<\/p>\n
8.\tAt
\nthe trial, the Trial Court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the applicants on bail.\n<\/p>\n
9.\tRule is
\nmade absolute to the aforesaid extent. \tDirect Service today is
\npermitted.\n<\/p>\n
