They seek quashing  of complaint bearing<br \/>\ninquiry case No.3 of 2002 pending before JMFC, Surat on the ground<br \/>\nthat the complaint does not   disclose any of the offences mentioned<br \/>\nin the complaint.\n<\/p>\n<p>\tIn<br \/>\nthe impugned  complaint, offences mentioned  against the petitioners<br \/>\nare those punishable under section 101 to 104 of the Trade Marks Act,<br \/>\n1999 (hereinafter to be referred to as &#8220;the Act of 1999&#8221;),<br \/>\nunder section 63 of the Copyright Act, 1957 and under section 420 of<br \/>\nthe Indian Penal Code.  The complainant has alleged, inter alia, that<br \/>\nthe complainant company is manufacturer of bulk transporters with air<br \/>\nslide discharge  system with trade name &#8220;ACC &#8211; ShimMaywa&#8221;<br \/>\nand sells such products throughout India.  Such bulk transporters are<br \/>\n specially designed for transporting large quantities of powdery<br \/>\nmaterial such as cement, fly-ash, etc.  and delivering  such<br \/>\nmaterials in a short time with the aid of compressed air.  Such<br \/>\nmachines ensure that the material is transported   in closed<br \/>\ncontainer  protected against weather conditions.  The<br \/>\ncomplainant-Company is the owner and proprietor  of the said trade<br \/>\nmark ACC &#8211; ShinMaywa Bulk Transporter  with the above features.<br \/>\n The customers  and purchasers of such machines associate the product<br \/>\nwith such trade mark.\n<\/p>\n<p>\tIt<br \/>\nis further alleged that  the accused in order to deceive and defraud<br \/>\nthe customers of the complainant Company copied such trade mark and<br \/>\ntrade description deceptively and are using the trade mark and trade<br \/>\ndescription.  They have copied the same and essential features<br \/>\nprinted in the catalogue of the Company&#8217;s product.   On the above<br \/>\ngrounds, it is alleged that the petitioners committed  offence<br \/>\npunishable under section 101 to 104 of the Act of 1999.  They also<br \/>\ncommitted offence  under section 63 of the Copyright Act and section<br \/>\n420 of the Indian Penal Code.\n<\/p>\n<p>\tI<br \/>\nhave  heard the learned counsel for the petitioners.  No one appeared<br \/>\nfor the original complainant though the matter was  heard for a span<br \/>\nof two days.\n<\/p>\n<p>\tCounsel<br \/>\nfor the petitioners submitted that the complaint was lodged in the<br \/>\nyear 2002 for the alleged   offence  punishable  under the Act of<br \/>\n1999  which was actually brought into effect from 15th<br \/>\nSeptember 2003.  She further submitted that there is no infringement<br \/>\nof the Copyright Act since copyright can be claimed only for limited<br \/>\nthings. She further submitted that the product of the petitioners is<br \/>\ncalled Sun Bulk Transporter. Trade Mark ACC ShinMaywa  is in no way<br \/>\ncopied.  She submitted that the purchasers and customers are educated<br \/>\npersons engaged in construction or other related business.<br \/>\nTherefore, no case for cheating is made out.\n<\/p>\n<p>\tI<br \/>\nhave also  heard the learned APP for the State.\n<\/p>\n<p>\tHaving<br \/>\nheard the learned advocates and having perused the documents on<br \/>\nrecord, it clearly emerges that the impugned complaint filed in the<br \/>\nyear 2002, offences alleged are under the Act of 1999 which has been<br \/>\nbrought into  force with effect from 15th September 2003.<br \/>\nObviously, there cannot be retrospective operation of criminal<br \/>\nprovisions.  No case for proceeding further under section 101 to 104<br \/>\nof the Act 1999 is therefore made out.\n<\/p>\n<p>\tWith<br \/>\nrespect to the allegations of offence   under section 63 of the<br \/>\nCopyright Act, it is clear  from section 13 of the said Act that<br \/>\ncopyright can be claimed  only for the works of (a) original<br \/>\nliterary, dramatic, musical and artistic works; (b) cinematograph<br \/>\nfilms and (c) sound recording.\n<\/p>\n<p>\tAdmittedly,<br \/>\nthe present case does not fall in any of the above categories.\n<\/p>\n<p>\tWith<br \/>\nrespect to section 420 of the Indian Penal Code, no  clear averments<br \/>\nare made in the complaint how the customers are cheated.  I have<br \/>\nperused the brochure  of the complainant Company for selling the said<br \/>\nmachine as well as that of the  petitioner Company.  There is no<br \/>\napparent similarity  by which the educated customers could be misled.<br \/>\n Therefore, no case for cheating is also made out.\n<\/p>\n<p>\tIn<br \/>\nthe result, the impugned complaint  being Inquiry Case No.3 of 2002<br \/>\nof the court of JMFC, Surat is quashed.
