Shevade, learned counsel for the applicant, states that the<br \/>\ndecretal amount has already been deposited by the applicant with the<br \/>\nexecuting Court concerned.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe facts and circumstances of the case, the respondent is at liberty<br \/>\nto withdraw the amount deposited by the applicant with the executing<br \/>\nCourt concerned, after furnishing necessary bank guarantee in that<br \/>\nregard. In view of the same, the application is allowed and the main<br \/>\nmatter is restored on file. The application stands disposed of<br \/>\naccordingly. Rule is made absolute to the above extent with no order<br \/>\nas to costs.\n<\/p>\n<p>5.\tThe<br \/>\nmain is peremptorily fixed for hearing on 28.01.2011 on condition<br \/>\nthat the office objections are removed before the next date.<br \/>\nThereafter, the matter be listed on the Final Hearing Board at Sr.<br \/>\nNo.1 on the next date.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
