Nos.216 to 224 of 2002.\n<\/p>\n<p>3.<br \/>\n\t\tLearned Assistant Government Pleader for the applicants submitted<br \/>\nthat the judgement and award was passed by learned Judge on 30th<br \/>\nMarch,2007. The certified copy of the<br \/>\norder was applied on 4th June,2007. The same was ready for<br \/>\ndelivery on 30th June,2007, which was obtained on 21st<br \/>\nJuly,2007. Thereafter, a proposal was forwarded with necessary<br \/>\nopinion to the Legal Department of the State of Gujarat and it took<br \/>\nsometime in studying the judgment and<br \/>\nrelevant case papers, and, subsequently, the final decision<br \/>\nof preferring the Appeal was taken. However,  there was a delay of<br \/>\n171 days in preferring the aforesaid First Appeals. Thus, because of<br \/>\nthe departmental procedure as well as for studying case papers and<br \/>\nthe judgment, the time has been consumed in<br \/>\npreferring the aforesaid First Appeals. Therefore, the delay may be<br \/>\ncondoned.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard the learned counsel for both the sides and looking to the facts<br \/>\nand circumstances of the case and the reasons stated in the memo of<br \/>\nthe applications for condonation of delay, in my opinion, there are<br \/>\nsufficient and reasonable reasons for condonation of delay. Moreover,<br \/>\nthe applications for condonation of delay are not controverted by the<br \/>\nlearned counsel for the respondents. Some time has been consumed in<br \/>\ntaking an opinion of Assistant Government Pleader of the Trial Court,<br \/>\nunder Law Officers Rule and, thereafter, some time has been consumed<br \/>\nin taking decision and in that thinking process, file has moved from<br \/>\none Department to another Department and, therefore, delay has been<br \/>\ncaused in preferring the aforesaid First Appeals, is therefore,<br \/>\ncondoned. These Civil Applications are allowed.
