The State of Rajasthan\n\n DATE OF ORDER            :     15th December 2009\n\n       HON'BLE MR.JUSTICE DINESH MAHESHWARI\n\n Mr.Ramesh Purohit for the petitioner.\n Mr.Mahipal Bishnoi, Public Prosecutor for State.\n                               ....\n\n       These two bail applications, though relating to different\n\n FIRs but concerning the same accused petitioner             and\n\n involving similar   circumstances,   have    been   considered\n\n together; and are taken up for disposal by this common order.\n\n       The petitioner is accused in two criminal cases pending\n\n since the year 2002 in the Court of Judicial Magistrate, Jayal\n\n for offence under Section 379 IPC.           For the petitioner\n\n remaining absent in these cases on 30.01.2009,          his bail\n\n bonds were forfeited; and thereafter,    he was arrested     on\n\n 21.08.2009.   The bail applications as moved by the petitioner\n\n were declined by the learned Additional Sessions Judge,\n\n Nagaur    essentially for the reason that he had repeatedly\n\n jumped the bail and his bail bonds were earlier forfeited in the\n\n years 2004, 2007 and 2008 and such absence has caused the\n\n delay in disposal of the matter.\n\n       The learned counsel for the petitioner has strenuously\n\n argued that the petitioner had all through attended the matter\n\n on substantial number of dates of hearing and it had, in fact,\n\n been for the absence of the co-accused Salim that the matter\n\n got prolonged; that there is no any         recovery suggested\n                                      2\n\n     against the petitioner    in these matters; and that he has\n\n     remained in custody for sufficiently long time and deserves\n\n     indulgence. However, the learned Public Prosecutor informs\n\n     on instructions that practically the trial is nearing completion in\n\n     these matters with only one witness remaining to be\n\n     examined; and the matters are fixed in the Trial Court on 19th\n\n     inst.\n\n             At the given stage of trial, though this Court does not\n\n     find it proper to pass an order for release of the petitioner on\n\n     bail and, therefore, these bail applications are being rejected\n\n     but then, in the totality of circumstances, it does appear\n\n     appropriate and hence is observed that if the prosecution\n\n     evidence is completed on 19th inst., the learned Trial Court\n\n     shall endeavour to decide the matters without further loss of\n\n     time; but if the evidence is not completed on 19.12.2009 for\n\n     any reason and the matters remain pending, in that event, if\n\n     the petitioner moves the applications for bail afresh, the\n\n     same shall be considered by the learned Trial Court on their\n\n     own merits irrespective of rejection of the earlier bail\n\n     applications by the learned Sessions Judge or by this Court by\n\n     this order.\n\n             With the aforesaid observations, these bail applications\n\n     moved on behalf of the petitioner Swaroop Ram s\/o Sukha\n\n     Ram stand rejected at this stage.\n\n\n\n                                      (DINESH MAHESHWARI),J.\n<\/pre>\n<p>MK<br \/>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>     S.B.CRIMINAL MISC.
