No. I &#8211; 6 of 2001<br \/>\nregistered  with Motakhuntwada Police Station, District Bhavnagar<br \/>\ninsofar as it alleges the offence punishable under Section 450 of<br \/>\nIndian Penal Code.\n<\/p>\n<p>2.\tIt<br \/>\nis submitted by learned advocate Mr.Samir Dave for the petitioner<br \/>\nthat no offence is made against the petitioner under Section 450 of<br \/>\nIPC as when the incident took place the complainant is not in her<br \/>\nhouse but she was outside her house, so prima facie no offence is<br \/>\nmade out under Section 450 of IPC, and therefore, there is no<br \/>\ncriminal tresspass which would attract the provisions of Section 450<br \/>\nof IPC.  Reliance is placed on a decision of the  Hon&#8217;ble Apex Court<br \/>\nin the case of <a href=\"\/doc\/1033637\/\">State of Haryana vs. Bhajan Lal<\/a> reported in 1992<br \/>\nSupp(1) SCC 335.  It is submitted by learned advocate for the<br \/>\npetitioner that as per this judgment the present case   when prima<br \/>\nfacie the case under Section  450 of IPC is not made out, then in<br \/>\nlight of the aforesaid judgment of Bhajanlal&#8217;s  case (supra), the<br \/>\nCourt should quash the complaint qua offence punishable under Section<br \/>\n450 of IPC.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned APP Mr.L.R.Pujari for the respondent-State.  It is submitted<br \/>\nby Mr.Pujari that if no offence is made out under Section 450 of IPC<br \/>\nthen the Investigating Officer will look into the matter and  will<br \/>\nalso  take appropriate steps, and if it is necessary then the I.O.<br \/>\nwill file the chargesheet only for the offence which are made out in<br \/>\nthe complaint.\n<\/p>\n<p>4.\tThe<br \/>\ncomplaint is lodged on 11.2.2011.  The investigation is at a<br \/>\npreliminary stage.  Prima-facie serious offence is made out under<br \/>\nSection 354 of IPC. Whether the offence under Section 450 of IPC is<br \/>\nmade out or not, it cannot be said at this stage, as observed above,<br \/>\nthe investigation is at a preliminary stage.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above, the application is  summarily rejected.
