No.928 of 2010\n                               RAKESH KUMAR GUPTA\n                                         Versus\n                                   STATE OF BIHAR\n                                       -----------\n<\/pre>\n<p>2   13.08.2010                 Both parties present.<\/p>\n<p>                               Petitioners in both the applications pray for<\/p>\n<p>                 release of the edible pulses and gram allegedly seized by<\/p>\n<p>                 the State on the plea that they were being transported to<\/p>\n<p>                 the city for the purpose of selling there in black market.<\/p>\n<p>                               It appears that a submission was advanced<\/p>\n<p>                 before the court below by the learned Prosecutor that the<\/p>\n<p>                 proceeding under Section 6E of the Essential Commodities<\/p>\n<p>                 Act is likely to be initiated in these applications. Petitioners<\/p>\n<p>                 have categorically stated that till date no confiscation<\/p>\n<p>                 proceeding has been initiated with respect to those items. It<\/p>\n<p>                 is contended that the edible pulses and gram are perishable<\/p>\n<p>                 and the court should take reasonable view on the<\/p>\n<p>                 application as allowing the pulses and gram to perish will<\/p>\n<p>                 not be in the interest of either the petitioners, the State or<\/p>\n<p>                 the nation.\n<\/p>\n<p>                               Counsel for the State seeks time.\n<\/p>\n<p>                               List this matter on Wednesday (18.8.2010) high<\/p>\n<p>                 on Board.\n<\/p>\n<p><span class=\"hidden_text\">                        2<\/span><\/p>\n<p>               Let a copy of this order be handed over to Mr.<\/p>\n<p>      Jharkhandi Upadhyay, learned APP.<\/p>\n<p>                           ( Kishore K.
