Justice ANTONY DOMINIC\n\n Dated :09\/12\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n\n             ```````````````````````````````````````````````````````\n                 W.P.(C) No. 34671 of 2010 H\n             ```````````````````````````````````````````````````````\n           Dated this the 9th day of December, 2010\n\n                            J U D G M E N T\n<\/pre>\n<p>            Petitioner was allotted a plot having an extent of 99<\/p>\n<p>cents in Ayyankunnu Industrial Development area in Thrissur<\/p>\n<p>district. Ext.P1 is the agreement that was executed. In this<\/p>\n<p>writ petition, she challenges Ext.P15 order.<\/p>\n<p>      2.    Earlier, alleging violation of the terms of the<\/p>\n<p>allotment, Ext.P9 order resuming the industrial plot was<\/p>\n<p>passed. That order was challenged before this Court and in<\/p>\n<p>Ext.P14 judgment rendered in WP(C) No.23880\/2010, on the<\/p>\n<p>ground that the order was passed without affording an<\/p>\n<p>opportunity of hearing to the petitioner, the order was set<\/p>\n<p>aside and the matter was ordered to be reconsidered.<\/p>\n<p>Accordingly, petitioner was heard and Ext.P15 was passed,<\/p>\n<p>the relevant portion of which reads as under:-<\/p>\n<p>                   &#8221;      But on personal hearing the<\/p>\n<p>            promoter could not put forward any concrete<\/p>\n<p>            proposals to start the project to utilise the<\/p>\n<p>W.P.(C) No.34671\/10<br \/>\n<span class=\"hidden_text\">                                  : 2 :<\/span><\/p>\n<p>             land with valid supporting details.       The<\/p>\n<p>             reason, the promoter had stated for delay in<\/p>\n<p>             implementing the project is due to delay in<\/p>\n<p>             cutting and removing of trees in the land. But<\/p>\n<p>             the cutting and removing of the trees was<\/p>\n<p>             completed in March 2009 itself.           The<\/p>\n<p>             supporting details for financial arrangement,<\/p>\n<p>             they had produced an invalid copy of the loan<\/p>\n<p>             recommendation     letter   from    KVIB   to<\/p>\n<p>             M\/s.Canara Bank, Athani. The promoter had<\/p>\n<p>             promised to produce valid letter for raw<\/p>\n<p>             material availability within 29-09-2010, but<\/p>\n<p>             failed to produce any valid details. The party<\/p>\n<p>             is a defaulter of 2 instalments of land value<\/p>\n<p>             dues.&#8221;\n<\/p>\n<p>     3.     When the matter was taken up, the main<\/p>\n<p>contention raised by the learned counsel for the petitioner<\/p>\n<p>was that the finding in Ext.P15 that the petitioner did not put<\/p>\n<p>forward any concrete proposal to start a project to utilise the<\/p>\n<p>land is incorrect. According to the learned counsel, Exts.P10<\/p>\n<p>and P11 enclosing building plan and other details were<\/p>\n<p>submitted and it was on account of the inaction on the part of<\/p>\n<p>W.P.(C) No.34671\/10<br \/>\n<span class=\"hidden_text\">                               : 3 :<\/span><\/p>\n<p>the respondents that the petitioner could not proceed further<\/p>\n<p>with the matter.\n<\/p>\n<p>      4.    When this submission was made, the learned<\/p>\n<p>Government Pleader was directed to obtain instructions in the<\/p>\n<p>matter.     Accordingly, on instructions, it is submitted that<\/p>\n<p>among the documents produced by the petitioner, the<\/p>\n<p>respondents had received only Ext.P10, a one line letter and<\/p>\n<p>that too without any enclosures including any building plan or<\/p>\n<p>other details. It is stated thereafter the petitioner did not turn<\/p>\n<p>up despite repeated notices that were issued and in the<\/p>\n<p>circumstances, the impugned proceedings were issued.<\/p>\n<p>      5.    Although it is the case of the petitioner that she<\/p>\n<p>made all efforts to establish the industrial unit, there is nothing<\/p>\n<p>on record to prove such a contention. That apart Ext.P10,<\/p>\n<p>which is admitted to have been received by the respondents,<\/p>\n<p>does not contain any concrete proposal for utilisation of the<\/p>\n<p>land. That apart, she is already found to be a defaulter.<\/p>\n<p>Therefore, this evidently is a case of violation of the terms of<\/p>\n<p>W.P.(C) No.34671\/10<br \/>\n<span class=\"hidden_text\">                                  : 4 :<\/span><\/p>\n<p>allotment and the agreement entered into between the<\/p>\n<p>parties.\n<\/p>\n<p>      6.    The plot in question allotted to the petitioner is in<\/p>\n<p>an industrial development area which is established by the<\/p>\n<p>Government for promoting small scale industrial units. If an<\/p>\n<p>allottee does not make use of the plot which is a scarce<\/p>\n<p>commodity, the authorities are entitled to resume the land and<\/p>\n<p>re-allot the same to deserving applicants waiting for allotment.<\/p>\n<p>Such being the case, I do not find any merit in the case set up<\/p>\n<p>by the petitioner.\n<\/p>\n<p>      Writ petition fails and it is dismissed.<\/p>\n<p>                                                            Sd\/-\n<\/p>\n<p>                                       (ANTONY DOMINIC, JUDGE)<br \/>\naks<\/p>\n<p>                            \/\/ True Copy \/\/<\/p>\n<p>                                     P.A.
