SHAH\n\t\t\n\t\n\n \n\nDate\n: 04\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent application has been preferred by the applicant herein &#8211;<br \/>\nappellant &#8211; original opponent No.2 &#8211; National Insurance<br \/>\nCompany Limited to stay further execution, implementation and<br \/>\noperation of the judgement and award dated 30\/03\/2010 passed by Motor<br \/>\nAccident Claims Tribunal (Main), Jamnagar in Motor Accident Claim<br \/>\nPetition No.385\/2006.\n<\/p>\n<p>2.\t\tWhile<br \/>\nissuing Rule in the present Civil Application, learned Single Judge<br \/>\ngranted ad-interim relief by passing following order:\n<\/p>\n<p>&#8220;Rule<br \/>\nreturnable on 1st<br \/>\nFebruary 2010.\n<\/p>\n<p>Ad<br \/>\ninterim stay is  granted on  condition  that the applicant  shall<br \/>\ndeposit  the entire awarded  amount  on<br \/>\nor before  the returnable date. On deposit of the same 70%  of the<br \/>\namount shall be deposited  by way of a fixed deposit, to be retained<br \/>\nwith Nazir  of the Tribunal, with a nationalised bank initially for a<br \/>\nperiod of three years,  and on maturity  shall be renewed  by one<br \/>\nyear   at a time without any further orders in this regard till the<br \/>\ndisposal of the appeal.  The remaining  30% shall be allowed to be<br \/>\nwithdrawn  by the original claimant. The periodical interest that may<br \/>\nbe accrued  on the said deposit shall  be  paid to the original<br \/>\nclaimants.&#8221;\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard Mr.Vibhuti Nanavati, learned advocate appearing on behalf of<br \/>\nthe applicant and Mr.Premal Rachh, learned advocate appearing on<br \/>\nbehalf of the original claimants, ad-interim relief granted earlier<br \/>\nis directed to be continued as interim relief till final disposal of<br \/>\nthe main First Appeal, on the same terms and conditions as per order<br \/>\ndated 22\/12\/2010 passed by this Court, as referred hereinabove. Rule<br \/>\nis made absolute to the aforesaid extent.
