      This appeal is filed by the complainant in C.C.No. 1526 of<\/p>\n
2001 on the file of the Judicial First Class Magistrate – II, Kochi<\/p>\n
against     the order of acquittal under Section 256 Cr.P.C.<\/p>\n
dt.16.3.2004. That was a case filed by the complainant against<\/p>\n
the first respondent for the offence punishable under Section 138<\/p>\n
of the N.I. Act       involving a cheque for Rs. 24,501\/-             On<\/p>\n
16.3.2004, the accused was acquitted under Section 256 Cr.P.C.<\/p>\n
as the complainant was absent.\n<\/p>\n
      2. Heard learned counsel for the appellant and the learned<\/p>\n
counsel for the first respondent.\n<\/p>\n
      3. The learned counsel for the appellant submitted that on<\/p>\n
16.3.2004 the complainant was actually present in court, but he<\/p>\n
could not enter into the court hall due to heavy rush.<\/p>\n

      4.   Under Section 256 Cr.P.C, three courses are open to the<\/p>\n
Magistrate where the complainant is absent on the date of hearing; (i)<\/p>\n
to acquit the accused or (ii) adjourn the case for a future date or (iii)<\/p>\n
to dispense with the attendance of the complainant and proceed with<\/p>\n
the case.     An order under Section 256 of the Code of Criminal<\/p>\n
Procedure, which operates as a final order barring a fresh complaint<\/p>\n
should be passed after proper application of mind and sound exercise<\/p>\n
of judicial discretion. The order should show the wide discretion that<\/p>\n
vested in the Court had properly been exercised.<\/p>\n
      5.   The order under challenge shows that the complainant was<\/p>\n
present in court on 23.1.2004     for giving evidence.    As the party<\/p>\n
submitted that the matter is likely to be settled, an adjournment was<\/p>\n
given and the complainant was directed to be present for giving<\/p>\n
evidence.   Since the complainant was present on several occasions<\/p>\n
and was ready to give evidence, the learned Magistrate ought not have<\/p>\n
acquitted the accused due to the absence of the complainant on a<\/p>\n
particular day.    In the above circumstances it would be just and<\/p>\n

reasonable to set aside the order of acquittal and to restore      the<\/p>\n
complaint to file.\n<\/p>\n
      6. In the result, this appeal is allowed. The order in C.C.No.<\/p>\n
1526 of 2001 on the file of the Judicial First Class Magistrate -II,<\/p>\n
Kochi dt. 16.3.2004 dismissing the complaint and acquitting the<\/p>\n
accused under Section 256(1) Cr.P.C. is set aside and that complaint<\/p>\n
is restored to file. The learned Magistrate is directed to proceed with<\/p>\n
the case in accordance with law.    The parties are directed to appear<\/p>\n
before that Court on 5.1.2011 for further proceedings.<\/p>\n
