THE SUPERINTENDING ENGINEER,CENTRAL CIRCLE, ROAD\n        CONSTRUCTION DEPARTMENT,CHHAJJU BAG,PATNA.\n                                 ------------\n<\/pre>\n<p>3.   10.8.2010             Heard learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                           This   Court   is   not   persuaded    to   grant    any<\/p>\n<p>                 indulgence to the State for filing a counter affidavit in a writ<\/p>\n<p>                 petition with regard to a domestic residence, copy of which<\/p>\n<p>                 has been served in the office of the Advocate General on<\/p>\n<p>                 29.4.2010, the second copy for the benefit of the State for<\/p>\n<p>                 filing of the counter affidavit.\n<\/p>\n<p>                           It is apparent from Anenxure-1 that the petitioner<\/p>\n<p>                 by order dated 23.11.2009, passed by the Superintending<\/p>\n<p>                 Engineer, Central Circle, Road Construction Department<\/p>\n<p>                 Chhajju     Bag,    Patna     was     allotted   a      residential<\/p>\n<p>                 accommodation       at   Danapur-Bankipur        Road     (Golghar<\/p>\n<p>                 Circle) consequent to the superannuation of the earlier<\/p>\n<p>                 incumbent Sri Shashi Bhushan Prasad Sinha.<\/p>\n<p>                           The petitioner claims that he settled down in the<br \/>\n<span class=\"hidden_text\">                   -2-<\/span><\/p>\n<p>quarter but suddenly an order dated 24.4.2010 was issued<\/p>\n<p>by the same Superintending Engineer cancelling the<\/p>\n<p>allotment dated 23.11.2009 with immediate effect and<\/p>\n<p>allotted him another residence at C\/1 Mithapur, Patna.<\/p>\n<p>        Learned counsel for the State submits that the<\/p>\n<p>allotment made to the petitioner relates to the pool of the<\/p>\n<p>Building Construction Department and therefore the order<\/p>\n<p>of cancellation was passed, allotting another residence<\/p>\n<p>simultaneously.\n<\/p>\n<p>        Counsel for the petitioner submits that during the<\/p>\n<p>pendency of the writ application, the Building Construction<\/p>\n<p>Department has already ousted the petitioner.      He has<\/p>\n<p>challenged the same in another writ application in C.W.J.C.<\/p>\n<p>No. 9572 of 2010. The petitioner is interested in a<\/p>\n<p>residential   accommodation   and   he   apprehends    more<\/p>\n<p>trouble even in possession of the new quarter allegedly<\/p>\n<p>allotted unless he has the protection of this Court.     The<\/p>\n<p>apprehension is based on the past conduct of the<\/p>\n<p>respondents.\n<\/p>\n<p>        This Court is satisfied that the order dated<\/p>\n<p>24.4.2010 is completely arbitrary. It contains no reasons.<\/p>\n<p>The reasons sought to be urged on behalf of the State to<\/p>\n<p>explain the recitals contained in the order impugned<\/p>\n<p>cannot be accepted and the order has to be tested on the<\/p>\n<p>recitals contained.\n<\/p>\n<p><span class=\"hidden_text\">                              -3-<\/span><\/p>\n<p>                   Be that as it may, the impugned order itself states<\/p>\n<p>           that quarter No. C\/1 Mithapur, Patna has been allotted to<\/p>\n<p>           the petitioner. Learned counsel for the petitioner contends<\/p>\n<p>           that it is in an extremely dilapidated condition and unsafe<\/p>\n<p>           for human habitation from the point of view of safety.<\/p>\n<p>                   Let the petitioner appear with a copy of the present<\/p>\n<p>           order before the Superintending Engineering concerned<\/p>\n<p>           who is directed to forthwith proceed to rectify quarter No.<\/p>\n<p>           C\/1 Mithapur, Patna and ensure by proper certification<\/p>\n<p>           that it was safe for human habitation. Any accident in the<\/p>\n<p>           premises attributable to the premises being unsafe for<\/p>\n<p>           human habitation in all its civil and criminal consequences<\/p>\n<p>           will rest on the Superintending Engineer. If he is of the<\/p>\n<p>           opinion otherwise he shall forthwith allot other alternative<\/p>\n<p>           official accommodation to the petitioner.<\/p>\n<p>                   Let this order be complied within a maximum<\/p>\n<p>           period of one month.\n<\/p>\n<p>                   The writ application stands allowed.\n<\/p>\n<\/p>\n<pre>P.
