BASANT, J.\n\n              -------------------------------------------------\n\n                        B.A. No. 1084 OF  2008\n\n              -------------------------------------------------\n\n          Dated this the  25th day of  February, 2008\n\n\n                                 ORDER\n<\/pre>\n<p>      Application for regular bail.    The petitioner is arrayed as<\/p>\n<p>the 1st  accused.   He faces allegations under the Kerala Abkari<\/p>\n<p>Act.   The  2nd accused was allegedly found to have 20 litres of<\/p>\n<p>spirit in his possession.   He was arrested.   The petitioner was<\/p>\n<p>not available at the scene at all.     The interrogation of the 2nd<\/p>\n<p>accused   furnished   information   to   the   police   that   it   was   the<\/p>\n<p>petitioner   who   supplied   the   said   spirit   to   the   2nd  accused.<\/p>\n<p>Accordingly,   the   petitioner   was   arrested   on   26\/1\/08.     He<\/p>\n<p>continues in custody from that date.   After the interrogation of<\/p>\n<p>the petitioner, the complicity of  A3 and after the interrogation<\/p>\n<p>of   A3,   the   complicity   of   A4   have   now   been   realised.     The<\/p>\n<p>petitioner   continues   in   custody   from   26\/1\/08.     The   learned<\/p>\n<p>Public   Prosecutor   reports   that   the   petitioner   has   no   criminal<\/p>\n<p><span class=\"hidden_text\">B.A. No. 1084 OF  2008                -: 2 :-<\/span><\/p>\n<p>antecedents.       He   is   not   involved   in   any   other   Abkari   Act<\/p>\n<p>prosecution.\n<\/p>\n<\/p>\n<p>        2.  The learned counsel for the petitioner prays, the learned<\/p>\n<p>Public Prosecutor does not oppose the  said prayer on condition<\/p>\n<p>that   appropriate   safeguards   may   be   insisted   and   conditions<\/p>\n<p>imposed and I am satisfied that the petitioner, who has remained<\/p>\n<p>in custody from 26\/1\/08, can now be directed to be released on<\/p>\n<p>bail subject to appropriate terms and conditions.<\/p>\n<p>        3.    In the result:\n<\/p>\n<\/p>\n<p>        (a)  The application is allowed.\n<\/p>\n<\/p>\n<p>        (b)  The petitioner shall be released on bail on the following<\/p>\n<p>terms and conditions:\n<\/p>\n<\/p>\n<p>        (i)   The   petitioner   shall   execute   a   bond   for   Rs.1,00,000\/-<\/p>\n<p>(Rupees   one   lakh   only)     with   two   solvent   sureties   each   for   the<\/p>\n<p>like sum to the satisfaction of the learned Magistrate.<\/p>\n<p>        (ii)     The   petitioner   shall   make   himself   available     for<\/p>\n<p>interrogation before the Investigating Officer on all Mondays and<\/p>\n<p>Fridays   between   10   a.m.   and   12   noon   for   a   period   of   three<\/p>\n<p>months   and   thereafter   as   and   when   directed   by   the<\/p>\n<p>Investigating Officer in writing to do so.<\/p>\n<p>                                                  (R.
