(J)\n\nCITATION:\n 1994 SCC  (2) 195\t  1993 SCALE  (4)368\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>ORDER\n<\/p>\n<p>1.Several  telegrams  purported\t to  have  been\t sent  by<br \/>\nparents,  students and other associations and  organisations<br \/>\ncomplaining  of violations of the orders\/directions of\tthis<br \/>\nCourt  by some professional colleges in Karnataka  State  in<br \/>\nthe  matter of admission of students have been\treceived  by<br \/>\nthis  Court.  Though it is not possible to treat  all  those<br \/>\ntelegrams  as individual applications and inquire  into\t the<br \/>\ntruth  or  otherwise of the allegations contained  in  those<br \/>\ntelegrams and grant relief in the absence of an\t application<br \/>\nfiled  in  the manner known to all we, however,\t keeping  in<br \/>\nview  the  predominant interest of the\tstudents  community,<br \/>\ndirected one such telegram purported to have been sent by Dr<br \/>\nNunjundiah, President, Indian Medical Association, Karnataka<br \/>\nBranch,\t Bangalore  to be treated as an application  in\t the<br \/>\nmatters concerned pending before us and issued notice to the<br \/>\nlearned Advocate-General of Karnataka who was present in the<br \/>\nCourt  on  November 2, 1993.  The  learned  Advocate-General<br \/>\nappearing before us today, on verification of the  telegram,<br \/>\nconfirms  that Dr Nunjundiah is the author of the  telegram.<br \/>\nIndeed,\t on his behalf, the learned Senior Counsel  Mr\tRama<br \/>\nJois  is  appearing.  Mr Rama Jois confirms that  there\t are<br \/>\nsome  violations of the orders and directions of this  Court<br \/>\ncommitted by some of the professional colleges in the matter<br \/>\nof  admissions.\t  He placed certain material  before  us  in<br \/>\nsupport\t of  his  averments.  At this  stage  the  Advocate-<br \/>\nGeneral states that out of 50% of the payment seats, 15% are<br \/>\nallotted to NRI students and other foreign students and that<br \/>\nof  the\t remaining  35% seats, 20%  seats  are\tallotted  to<br \/>\nKarnataka  students and 15% to non-Karnataka  students.\t  He<br \/>\nalso  assured us that the alleged violation will  be  looked<br \/>\ninto by the State.\n<\/p>\n<p>2.Be that as it may, in order to avoid any  inconvenience<br \/>\nto the students, we issue the following directions further.\n<\/p>\n<p>3.The complaints regarding violation of or non-compliance<br \/>\nwith  the  orders\/directions of this Court made\t on  several<br \/>\noccasions in relation to the<br \/>\n<span class=\"hidden_text\">199<\/span><br \/>\nadmission of students to professional colleges in  Karnataka<br \/>\nshall be made before Secretary (Education Department) to the<br \/>\nGovernment of Karnataka.  The Secretary shall on receipt  of<br \/>\nthe   complaints,   look  into\tthem  forthwith\t  and\tpass<br \/>\nappropriate  orders to ensure strict compliance with  orders<br \/>\nand directions of this Court.  On such action taken he shall<br \/>\nsend a report to this Court on or before November 15,  1993,<br \/>\nmentioning cases, if any, of violations of or non-compliance<br \/>\nwith the orders\/directions of this Court.\n<\/p>\n<p>4.If the students selected for admission do not join  the<br \/>\ncolleges  within 5 days from the date of the publication  of<br \/>\nthe  admission\tlist and allotment of seats,  the  competent<br \/>\nauthority  shall prepare and publish a waiting list  of\t the<br \/>\ncandidates  in the order of merit forthwith for\t filling  up<br \/>\nany casual vacancies or drop out vacancies.  Those vacancies<br \/>\nwill be filled up within 5 days thereafter from the date  of<br \/>\nthe  publication  of  such waiting list and  they  shall  be<br \/>\nadmitted  in  accordance with clause 9 of the  Scheme  under<br \/>\nparagraph  210\tof the judgment in Unni Krishran, J.  P.  v.<br \/>\nState of A. P. 1\n<\/p>\n<p>5.However, since more than 3 months of this academic year<br \/>\nhave passed by and the admissions are not yet finalised,  we<br \/>\ndirect\tall  the  heads\t of  the  institutions\tto  finalise<br \/>\nadmissions as directed by this Court and in accordance\twith<br \/>\nthe  directions\t given\therein\tand  open  their  respective<br \/>\ncolleges and commence the courses on or before 15th of\tthis<br \/>\nmonth.\n<\/p>\n<p>6.It is made clear no free seats shall be transferred  to<br \/>\nthe  category  of payment seats or to  any  other  category.<br \/>\nSimilarly no unfilled seats as on November 15, 1993 shall be<br \/>\nsurrendered to the management until further orders.\n<\/p>\n<p>7.The  Government of Karnataka shall give wide\tpublicity<br \/>\nto  this  order in the State of Karnataka by  all  available<br \/>\nmedia.\tList the matters on November 17, 1993.<br \/>\nCourt Masters<br \/>\n<span class=\"hidden_text\">200<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Tma Pai Foundation vs State Of Karnataka on 4 November, 1993 Equivalent citations: 1994 SCC (2) 195, 1993 SCALE (4)368 Author: S Pandian Bench: Pandian, S.R.
