Babubhai Gangaram Patel was co-purchaser of the<br \/>\nplot in question, along with the present applicant. He submitted that<br \/>\nthe notice under section 135(d) of the Bombay Land Revenue Code was<br \/>\nalso issued and thereafter the transaction took place. It is<br \/>\nsubmitted that since subsequently prices of the land have escalated,<br \/>\nthe complaint has been preferred. He has also submitted that<br \/>\napplicant is bona fide purchaser.<br \/>\nHe has also referred to the sale-deed in support of his submission.<br \/>\nHe has referred to the order dated 11th<br \/>\nApril, 2011 vide which the brother of the applicant has been granted<br \/>\nanticipatory bail passed in<br \/>\nCriminal Misc.Application No.5013 of 2011. He, therefore, submitted<br \/>\nthat, on the ground of parity, the present applicant may also be<br \/>\nreleased on bail.\n<\/p>\n<p>4.<br \/>\n\tMr.Dabhi, learned APP has opposed the bail application and relied<br \/>\nupon the statement of Talati who submitted that applicant with an old<br \/>\nlady had come and requested that the lady was the landlord, hence her<br \/>\nsignature on notice under section 135(d) of the Code may be taken.<br \/>\nThus, the applicant and other persons have tried to commit fraud with<br \/>\nthe landlord, and, therefore, present applicant may not be enlarged<br \/>\non bail.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned counsel for both the sides and considering the<br \/>\nfacts and circumstances of the case as well as the documents and<br \/>\nother material produced on record of this case, the gravity of the<br \/>\noffence, the quantum of punishment, the allegations against the<br \/>\napplicant, the manner in which the applicant is allegedly involved in<br \/>\nthe case as per the allegation of the prosecution, coupled with the<br \/>\nfact that the co-accused has been released by this Court vide order<br \/>\ndated 11th<br \/>\nApril, 2011, I am of the view that the applicant deserves to be<br \/>\nreleased on bail.\n<\/p>\n<p>6.<br \/>\n  For the foregoing reasons, the application is allowed and<br \/>\nthe applicant is ordered to be enlarged on regular bail in connection<br \/>\nwith M.Case No.1 of 2011 registered at Mehsana City Police Station on<br \/>\nexecuting a bond of Rs.15,000\/- (Rupees Fifteen Thousand Only) with<br \/>\ntwo sureties of the like amount to the satisfaction of the Trial<br \/>\nCourt and subject to the conditions that he shall,<\/p>\n<p>\t[a]<br \/>\n\tnot take undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>\t[b]<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>\t[c]<br \/>\n\t  maintain law and order;\n<\/p>\n<p>\t[d]<br \/>\n\t not leave the State of Gujarat without the prior permission of the<br \/>\n\tSessions Court concerned;\n<\/p>\n<p>\t[e]<br \/>\n\t furnish the present address of his residence to the I.O. And also<br \/>\n\tto the Court at the time of execution of the bond and shall not<br \/>\n\tchange his residence without prior permission of this Court;\n<\/p>\n<p>\t[f]<br \/>\n\tsurrender his passport, if any, to the lower Court within a week;\n<\/p>\n<p>\t[g]<br \/>\n\tmark his presence at the concerned Police Station on 13th<br \/>\n\tMay, 2011 and thereafter on<br \/>\n\tany 1st and 15th day of English<br \/>\n\tcalender month between 9.00 AM and 2.00 PM till the trial is over;\n<\/p>\n<p>7.<br \/>\n   The authorities will release the applicant only if he is not<br \/>\nrequired in any other offence for the time being.\n<\/p>\n<p>8.<br \/>\n  If breach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.<br \/>\n    Bail bond to be executed before the lower Court having<br \/>\njurisdiction to try the case.\n<\/p>\n<p>10.<br \/>\n At the trial, the Trial Court shall not be influenced by the<br \/>\nobservations of prima facie nature, qua the evidence at this<br \/>\nstage, made by this Court while enlarging the petitioner on bail.\n<\/p>\n<p>11.<br \/>\nRule is made absolute to the aforesaid extent.
