Secretary, Department of Health Bihar, Patna.\n3. The Civil Surgeon, Araria.\n4. Medical Officer, Incharge, Primary Health Centre, Jokihat,\n   Dist. Araria.\n5. The District Magistrate, Araria, District Araria.\n6. The Director-in-charge, Health Services, Govt. of Bihar, Patna.\n                                              --------- Respondents\n                             -----------\n<\/pre>\n<p>3       12.08.2010             No    one    appears           on        behalf       of        the<\/p>\n<p>                     petitioner. Counsel for the State is present.<\/p>\n<p>                               The     following              prayers            of            the<\/p>\n<p>                     petitioner in this writ application:-<\/p>\n<blockquote><p>                          &#8220;1A. For         issuance           of         appropriate<br \/>\n                                writ\/order or direction commanding<br \/>\n                                the respondents to compensate the<br \/>\n                                petitioner            who    was    illegally         and<br \/>\n                                wrongly         put    under       suspension         and<br \/>\n                                was    made       accused          in    a    criminal<br \/>\n                                case without any fault on his part<br \/>\n                                and the petitioner has been found<br \/>\n                                innocent         in    both       the    cases       i.e.<br \/>\n                                criminal         case        as     well        as        in<br \/>\n                                departmental proceeding.<\/p><\/blockquote>\n<pre>\n                          B.    For        issuance           of         appropriate\n                                writ\/orders                   or              direction\n<\/pre>\n<blockquote><p>                                commanding the respondents to make<br \/>\n                                payment         of     the     compensation               as<br \/>\n                                assessed by this Hon&#8217;ble Court for<br \/>\n                                physical               harassment,               mental<br \/>\n                                torture, financial loss as well as<br \/>\n                                loss       of    dignity       in       the    society<br \/>\n                                because         the     petitioner            was     put<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>                 under suspension without any fault<br \/>\n                 on his part and he was also made<br \/>\n                 an accused in criminal case. The<br \/>\n                 petitioner has been exonerated in<br \/>\n                 both       the   proceeding    because      no<br \/>\n                 charges was proved against him.&#8221;\n<\/p><\/blockquote>\n<p>      are virtually claiming damages for the mental<\/p>\n<p>      agony undergone by the petitioner on account<\/p>\n<p>      of his suspension and\/or filing of a criminal<\/p>\n<p>      case.
