Mr.Rashesh<br \/>\n\tRindani, learned Assistant Government Pleader appearing on behalf of<br \/>\n\trespondent Nos.1 to 3 in Special Civil Application No.3373 of 2011.<br \/>\n\tMs.Monali Bhatt, learned Assistant Government Pleader appearing on<br \/>\n\tbehalf of respondent Nos.1 to 3 in Special Civil Application<br \/>\n\tNos.2259 to 2264 of 2011. Mr.M.B.Gandhi, learned advocate appearing<br \/>\n\ton behalf of respondent No.5.\n<\/p>\n<p>\tIn this group of<br \/>\n\tpetitions learned advocate Mr.Ramnandan Singh relies upon earlier<br \/>\n\torder dated 19.10.2010 passed by Division Bench of this Court in<br \/>\n\tsimilar circumstances in Special Civil Application Nos.9248 and 9398<br \/>\n\tof 2010, Special Civil Application Nos.11575 to 11585, 11587 and<br \/>\n\t11588 of 2009. The order passed by Division Bench of this Court on<br \/>\n\t19.10.2010 which reads as under:-\n<\/p>\n<p>&#8220;1.\n<\/p>\n<p>\t\tThe petitioners have, invoking Articles 14, 19, 21 and 226 of the<br \/>\n\t\tConstitution, approached this Court with the main grievance that<br \/>\n\t\tparts of their lands in the residential area of the villages are<br \/>\n\t\tsought to be acquired for developing an industrial estate by the<br \/>\n\t\tGujarat Industrial Development Corporation (GIDC), which is against<br \/>\n\t\tthe policy of GIDC itself. Upon notices being issued, learned<br \/>\n\t\tA.G.P. has appeared for respondent Nos.1 and 2 and learned counsel<br \/>\n\t\tMr.Nagarkar has appeared for respondent No.5, representing GIDC. It<br \/>\n\t\twas fairly submitted by learned counsel Mr.Nagarkar that, prima<br \/>\n\t\tfacie, some parts of the lands under acquisition on the basis<br \/>\n\t\tof notifications already issued under sections 4 and 6 of the Land<br \/>\n\t\tAcquisition Act, 1894, dated 25.3.2008 and 23.6.2009 respectively,<br \/>\n\t\twere falling within the periphery of residential area of the<br \/>\n\t\tvillages and policy was in fact adopted by GIDC, generally not to<br \/>\n\t\tacquire lands falling within 300 metres of residential area. He,<br \/>\n\t\thowever, also submitted that the notifications as aforesaid having<br \/>\n\t\talready been published, GIDC was required to consider the whole<br \/>\n\t\tissue, as far as the petitioners were concerned, at the higher<br \/>\n\t\tlevel and necessary decision could only be taken in a meeting of<br \/>\n\t\tthe Board of Directors of GIDC. He submitted, on instructions, that<br \/>\n\t\tsuch meeting may be held within the period of next two months and<br \/>\n\t\tthe issue of releasing the lands of the petitioners from<br \/>\n\t\tacquisition will be considered at such meeting. He fairly stated<br \/>\n\t\tthat as and when decision in respect of the petitioners&#8217; lands is<br \/>\n\t\ttaken, it will be communicated to the petitioners and their<br \/>\n\t\tadvocates as early as practicable; and, in the meantime, the<br \/>\n\t\trespondent will not proceed further with the process of<br \/>\n\t\tacquisition.\n<\/p>\n<p>2.<br \/>\n\t\tAdmittedly, the petitioners are not paid any<br \/>\n\t\tcompensation and no awards are made and the petitioners continue to<br \/>\n\t\tbe in possession of the lands in question. Under such circumstances<br \/>\n\t\tand in view of the statements made on behalf of GIDC in consonance<br \/>\n\t\twith their affidavit-in-reply and recorded hereinabove, the<br \/>\n\t\tpetitions were not pressed for any order on merits at this stage in<br \/>\n\t\tthe hope that GIDC will take appropriate decision in consonance<br \/>\n\t\twith its own policy and in public interest. Accordingly, the<br \/>\n\t\tpetitions are disposed as not pressed at this stage, with liberty<br \/>\n\t\tto the petitioners to challenge the decision of GIDC, as and when<br \/>\n\t\tsuch decision in respect of the lands in question is communicated<br \/>\n\t\tto them. Notice in each of the petitions is discharged with no<br \/>\n\t\torder as to costs.&#8221;\n<\/p>\n<p>\tIn view of above order<br \/>\n\tpassed by Division Bench of this Court learned advocate Mr.Ramnandan<br \/>\n\tSingh submitted before us that the petitioners will make detailed<br \/>\n\trepresentation to respondent No.5 and some suitable direction may be<br \/>\n\tissued to respondent No.5 so that they may examine actual fact<br \/>\n\twhether land in question is falling within 300 Mtrs., from<br \/>\n\tresidential area or not. Let petitioners may make detailed<br \/>\n\trepresentation to respondent No.5 within a period of one week from<br \/>\n\tdate of receipt of this order. As and when respondent No.5 receive<br \/>\n\tsuch representation, it is directed to respondent No.5 &#8211; GIDC<br \/>\n\tto examine such representation made by petitioners and also to find<br \/>\n\tout fact on the basis of map and record whether land in question<br \/>\n\tacquired is falling within 300 Mtrs., from residential area or not<br \/>\n\tand, thereafter, to pass reasoned order and communicate to<br \/>\n\tpetitioners within a period of one month from date of receipt of<br \/>\n\trepresentation from petitioners.\n<\/p>\n<p>\tMr. M.B.Gandhi, learned<br \/>\n\tadvocate appearing on behalf of respondent No.5 submitted that one<br \/>\n\tConsent Award dated 27.11.2010 passed under Section 11(4) and<br \/>\n\tRegular Award dated 22.2.2011 under Section 11(1) are passed under<br \/>\n\tprovisions of Land Acquisition Act.\n<\/p>\n<p>\tIn view of above<br \/>\n\tobservations and directions all these petitions are disposed of by<br \/>\n\tthis Court without expressing any opinion on merits.
