Kapoor, Advocate for the appellant<\/p>\n<p>                                 ****<\/p>\n<p>RAKESH KUMAR GARG J.(ORAL)<\/p>\n<p>            This is insurer&#8217;s appeal challenging the award of the<\/p>\n<p>Tribunal which has granted compensation to the claimants on<\/p>\n<p>account of death of one Sanjay caused due to motor vehicle<\/p>\n<p>accident due to rash and negligent driving of offending vehicle.<\/p>\n<p>            In this case, an accident had taken place on 17th<\/p>\n<p>January, 2006 and as per the findings of the Tribunal Sanjay s\/o<\/p>\n<p>Inder Singh had died due to the injuries suffered by him in the<\/p>\n<p>said accident which took place due to rash and negligent driving of<\/p>\n<p>vehicle No.HR-55A\/9772 which was a heavy transport vehicle<\/p>\n<p>driven by respondent No.1.\n<\/p>\n<\/p>\n<p>            The only argument of the learned counsel for the<\/p>\n<p>appellant is that driver of the offending vehicle was not having a<\/p>\n<p>valid and effective driving licence at the time of accident. He has<\/p>\n<p>further argued that there is evidence on record to establish that<br \/>\n<span class=\"hidden_text\"> FAO No.4893 of 2007                                        -2-<\/span><\/p>\n<p>the original driving licence of the driver of the offending vehicle<\/p>\n<p>was not issued by the competent authority.<\/p>\n<p>            I have perused the record of the appellant and heard the<\/p>\n<p>learned counsel for the appellant.<\/p>\n<p>            There is no dispute with regard to the fact that entry<\/p>\n<p>regarding heavy transport vehicle was added in the driving licence<\/p>\n<p>No.715\/R\/2001 on 11.2.2003 vide entry No.285\/R\/2003 which was<\/p>\n<p>valid upto 10.02.2006. The appellant has not disputed the factum<\/p>\n<p>of genuineness of this entry in the record.          It is also not in dispute<\/p>\n<p>that the original licence was renewed validly.<\/p>\n<p>            For the sake of arguments if it is presumed that the<\/p>\n<p>driving licence Exhibit P\/3-R3 was originally a fake document even<\/p>\n<p>in view of the case law National Insurance Co. Ltd. Vs. Swaran<\/p>\n<p>Singh and others 2004 Accidents Claims Tribunal Claims Journal<\/p>\n<p>1, the insurance company cannot absolve itself from the liability to<\/p>\n<p>indemnify the insured on the ground of fake driving licence.<\/p>\n<p>            In the present case, the following observations of<\/p>\n<p>Tribunal are very relevant:-\n<\/p>\n<\/p>\n<blockquote><p>                      &#8220;Having heard the learned counsel for the parties and<\/p>\n<p>                      after going through the oral as well as documentary<\/p>\n<p>                      evidence adduced by the parties, I find no substance<\/p>\n<p>                      in the contention of the learned counsel for the<\/p>\n<p>                      insurance      company   for   the   reasons   recorded<\/p>\n<p>                      hereinafter.    The insurance company has examined<\/p>\n<p>                      Makhan Lal, Assistant Regional Transport Authority,<\/p>\n<p>                      Rewari as RW2 who categorically deposed that the<\/p>\n<p>                      driving licence No.37735\/95 originally issued by the<br \/>\n<span class=\"hidden_text\"> FAO No.4893 of 2007                                                     -3-<\/span><\/p>\n<p>                      Licensing Authority, Una was renewed by their office<\/p>\n<p>                      from        22.2.2001         to      21.2.2004         vide      entry<\/p>\n<p>                      No.715\/R\/2001 dated 22.2.2001. He further deposed<\/p>\n<p>                      that an entry regarding Heavy Transport vehicle was<\/p>\n<p>                      made      in     the     driving    licence      No.715\/R\/2001      on<\/p>\n<p>                      11.2.2003 vide entry No.285\/R\/2003 and the driving<\/p>\n<p>                      licence was valid upto 10.2.2006. The true copies of<\/p>\n<p>                      both the entries No.715 and 285 are Exhibits R1 and<\/p>\n<p>                      R2    respectively.          He,     in    his    cross-examination,<\/p>\n<p>                      deposed that before renewing the driving licence, &#8216;No<\/p>\n<p>                      Objection Certificate&#8217; was sought from the Issuing<\/p>\n<p>                      Licensing Authority and after nothing was heard<\/p>\n<p>                      from them within thirty days that the concerned<\/p>\n<p>                      Licensing Authority had not issued a valid driving<\/p>\n<p>                      licence, renewal was made.                       The &#8216;No Objection<\/p>\n<p>                      Certificate&#8217; was sought through a registered AD letter<\/p>\n<p>                      but    no      objection     was     raised      by    the   Licensing<\/p>\n<p>                      Authority, Una that the driving licence No.37735\/95<\/p>\n<p>                      was not issued by that authority.                        He further,<\/p>\n<p>                      explained that the practice in their licensing authority<\/p>\n<p>                      was to renew the driving licence in which no objection<\/p>\n<p>                      had been raised by the original issuing licensing<\/p>\n<p>                      authority.        He explained that the renewal of the<\/p>\n<p>                      driving licence is meant that the holder was having<\/p>\n<p>                      an authorized and legal authorization to drive the<\/p>\n<p>                      stipulated vehicles.               He also admitted that &#8216;No<\/p>\n<p>                      Objection&#8217;        was    raised     by    the    original    Licensing<\/p>\n<p>                      Authority, Una regarding the genuineness of the<\/p>\n<p>                      driving        licence    No.37735\/95.            As    regards     the<\/p>\n<p>                      testimony of Sanjay, the insurance company cannot<\/p>\n<p>                      derive      any    benefit    from        his statement        as well.<br \/>\n<span class=\"hidden_text\"> FAO No.4893 of 2007                                            -4-<\/span><\/p>\n<p>                      Sanjay, RW1 in his testimony before the Court that<\/p>\n<p>                      the driving licence No.37735\/95 was not issued to the<\/p>\n<p>                      respondent No.1 on 8.2.2001 but he failed to depose<\/p>\n<p>                      as to whether it was issued to him in the year 1995 or<\/p>\n<p>                      not   because   apparently,   it   is   evident   from   the<\/p>\n<p>                      evidence led by the respondent No.3 that the driving<\/p>\n<p>                      licence was originally issued in the year 1995 and it<\/p>\n<p>                      was renewed for the first time on 22.2.2001. Had the<\/p>\n<p>                      driving licence been issued on 8.2.2001, there was no<\/p>\n<p>                      need of its renewal in the same month on 22.2.2001.<\/p>\n<p>                      Thus the insurance company has failed to discharge<\/p>\n<p>                      the onus.&#8221;<\/p><\/blockquote>\n<p>            Thus, I find no merit in the argument raised by the<\/p>\n<p>learned counsel for the appellant and no fault can be found with<\/p>\n<p>the impugned award.\n<\/p>\n<\/p>\n<p>            Dismissed.\n<\/p>\n<\/p>\n<p>                                               (RAKESH KUMAR GARG)<br \/>\n                                                      JUDGE<br \/>\n10.08.2009<br \/>\nshonkar\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court The Oriental Insurance Co.Ltd vs Smt.
