DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/03\/2009 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nlearned counsel appearing for the parties.\n<\/p>\n<p>\t\tThis<br \/>\npetition is directed against the order of detention dated 4.11.2008<br \/>\npassed by respondent No. 1 in exercise of powers conferred<br \/>\nunder Section  3(2) of the Gujarat Prevention of Anti Social<br \/>\nActivities Act, 1985 (in short  the Act) by detaining the detenu as<br \/>\na  bootlegger  as defined under Section 2(b) of the Act.\n<\/p>\n<p>2.\t\tLearned<br \/>\nadvocate for the detenu restricted his arguments to the extent of<br \/>\norder of detention and submits that registration of  two FIRs itself<br \/>\ncannot lead to disturbance of even tempo of public life and therefore<br \/>\nthe public order. The order of detention is assailed by the<br \/>\ndetenu on various grounds mentioned in the memo of the petition.<br \/>\nHowever, learned counsel for the detenu has focused his arguments<br \/>\nmainly on the ground that except two  FIRs  registered under the<br \/>\nBombay Prohibition Act, there was no other material before the<br \/>\ndetaining authority whereby it could be inferred reasonably that the<br \/>\ndetenu is a &#8216;bootlegger&#8217; within the meaning of Section 2(b) of the<br \/>\nAct and required to be detained as the detenu&#8217;s activities are<br \/>\nprejudicial to the maintenance of  public health and public order. In<br \/>\nsupport of the  above submission, learned counsel for the detenu has<br \/>\nplaced reliance on relevant observations made by the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/1239835\/\">Piyush Kantilal Mehta vs.<br \/>\nCommissioner of<\/a> police, AIR 1989 Supreme Court 491 and<br \/>\nthe Judgment and order dated 22.8.2000 of<br \/>\nthe Division Bench of this Court (Coram: M.R. Calla &amp; R.R.<br \/>\nTripathi, JJ.), in Letters Patent Appeal No.223 of 2000 in<br \/>\nSpecial Civil Application No.554 of 2000 (Ashok Balabhai Makwana vs.<br \/>\nState of Gujarat) which would squarely help the detenu.<br \/>\nLearned advocate for the detenu further submits that no<br \/>\naffidavit-in-reply is filed by the State Government.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the above, subjective satisfaction of the detaining authority<br \/>\nthat anti-social activities carried out by the detenu are detrimental<br \/>\nto public order stands vitiated and order of detention based on such<br \/>\nsatisfaction deserves to be quashed and set aside.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAssistant Government Pleader submitted that registration of two<br \/>\ncomplaints would go to show that the detenu had, in fact, indulged<br \/>\ninto such activities, which can be said to be disturbing the public<br \/>\nhealth and public order.  Learned Assistant Government Pleader<br \/>\nfurther submitted that there was sufficient material before the<br \/>\ndetaining authority to pass the order of detention and no<br \/>\ninterference is called for by this Court in exercise of its power<br \/>\nunder Article 226 of the Constitution of India.\n<\/p>\n<p>5.\t\tHaving<br \/>\nheard the rival submissions of the parties and perused the record of<br \/>\nthe case, I am of the view that two complaints registered under the<br \/>\nBombay Prohibition Act alone cannot be said to be sufficient enough<br \/>\nto arrive at subjective satisfaction to the effect that the<br \/>\nactivities, as alleged, are prejudicial to the public order. The<br \/>\nregistration of FIRs under Bombay Prohibition Act ipso facto<br \/>\ndoes not lead to disturbance of public order. There has to be nexus<br \/>\nand link for such activities with disturbance of the public order.<br \/>\nThe activities of the detenu must, in the backdrop of the facts,<br \/>\nreflect that such activities disturbed or likelihood of disturbing<br \/>\nthe tempo of normal life of society or general peace and  tranquility<br \/>\nor create a sense of alarm and insecurity in the locality.  The<br \/>\nimpugned order suffers from vice of non-application of mind inasmuch<br \/>\nas the cases in which the detaining authority has placed reliance  do<br \/>\n not indicate that the liquor seized from the detenu is detrimental<br \/>\nto the health of public at large.\n<\/p>\n<p>6.\t\tOn<br \/>\ncareful perusal of the material available on record and the ratio<br \/>\nlaid down by the Apex Court in the case of Piyush Kantilal Mehta<br \/>\n(supra) and the Judgment and<br \/>\norder dated 22.8.2000 of the Division Bench of this Court (Coram:<br \/>\nM.R. Calla &amp; R.R. Tripathi, JJ.), in Letters Patent Appeal No.223<br \/>\nof 2000 in Special Civil Application No.554 of 2000 (Ashok<br \/>\nBalabhai Makwana vs. State of Gujarat), I am of the<br \/>\nview that the activities of the detenu cannot be said to be in any<br \/>\nmanner prejudicial to the public order and therefore, the order of<br \/>\ndetention  passed by the detaining authority cannot be sustained and<br \/>\nis required to be quashed and set aside.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe result, the petition is allowed. The order of detention dated<br \/>\n4.11.2008 passed by the respondent No. 1 is quashed and set<br \/>\naside. The detenu, is ordered to be set at liberty forthwith if he is<br \/>\nnot  required in connection with any other case. Rule is made<br \/>\nabsolute accordingly.
