Justice P.BHAVADASAN\n\n Dated :27\/05\/2010\n\n O R D E R\n<\/pre>\n<p>                      P.BHAVADASAN, J.\n<\/p>\n<p>                 &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>                      Ex.SA No.2 of 2010\n<\/p>\n<p>                 &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>                     Dated 27th May 2010<\/p>\n<p>                            Judgment<\/p>\n<p>           The first respondent herein obtained a decree<\/p>\n<p>against the second respondent.\n<\/p>\n<p>           2. The suit was one for money.              The decree<\/p>\n<p>holder took out execution of the decree as per EP<\/p>\n<p>No.98\/05 in OS No.556 of 2001. It appears that the decree<\/p>\n<p>holder sought attachment of the property. The attachment<\/p>\n<p>was ordered. Then the petitioner herein came forward with<\/p>\n<p>a claim petition under Order XXI Rule 58 CPC, pointing out<\/p>\n<p>that the property belonged exclusively to her and not liable<\/p>\n<p>to attachment. Even though the name of the judgment<\/p>\n<p>debtor was shown in the document, he had no right<\/p>\n<p>whatsoever over the property and he was included in the<\/p>\n<p>document only for a name sake.\n<\/p>\n<p>           3. It appears that no evidence whatsoever was<\/p>\n<p>adduced by the petitioner before the Trial Court and the<\/p>\n<p><span class=\"hidden_text\">Ex.SA No.2\/10                    2<\/span><\/p>\n<p>only document produced was Ext.B1 to consider whether<\/p>\n<p>the claim made by the petitioner is correct or not. Going by<\/p>\n<p>the document, the Trial Court came to the conclusion that<\/p>\n<p>the judgment debtor was a co-owner and there was no<\/p>\n<p>evidence to show that it was otherwise. Accordingly, the<\/p>\n<p>claim petition was dismissed.\n<\/p>\n<p>            4. The appellant carried the matter in appeal as<\/p>\n<p>AS No.155\/09 before the Sub Court, Perumbavoor. The<\/p>\n<p>lower Appellate Court, on an independent consideration of<\/p>\n<p>the evidence, came to the same conclusion as that of the<\/p>\n<p>Trial Court and dismissed the appeal. The said order is<\/p>\n<p>assailed in this Appeal.\n<\/p>\n<p>            5. The learned counsel for the appellant raised<\/p>\n<p>two contentions before this Court. They are (1) Since the<\/p>\n<p>claim petition is under Order XXI Rule 58 CPC, issues had<\/p>\n<p>to be raised (2) the appellant was not given an opportunity<\/p>\n<p>to adduce her evidence.\n<\/p>\n<p>            6. On going through the orders of the lower<\/p>\n<p>Court, it can be seen that both the contentions are without<\/p>\n<p><span class=\"hidden_text\">Ex.SA No.2\/10                       3<\/span><\/p>\n<p>any basis whatsoever. The lower Appellate Court has<\/p>\n<p>extracted as to what has transpired on the date on which it<\/p>\n<p>was posted, which reads as follows :\n<\/p>\n<blockquote><p>            &#8220;No representation. Kept aside. Petition represented. No<\/p>\n<p>            oral evidence for the petitioner. Heard. For orders to<\/p>\n<p>            3.6.2006.&#8221;<\/p><\/blockquote>\n<p>            7.   If the appellant has a case that the said<\/p>\n<p>narration in the order of the Trial Court is contrary to facts,<\/p>\n<p>her remedy lies in filing a review petition. It also needs to<\/p>\n<p>be noticed that the order is extracted in the order of the<\/p>\n<p>lower Appellate Court on 27.05.2006. Thereafter, the case<\/p>\n<p>was posted for orders to 03.06.2006. If the appellant had a<\/p>\n<p>case that she was precluded from adducing evidence,<\/p>\n<p>nothing prevented her from filing a petition seeking to re-<\/p>\n<p>open evidence. No such steps appear to have been taken<\/p>\n<p>by her. There is nothing to show that the appellant had any<\/p>\n<p>misapprehension regarding the matter. It needs to be<\/p>\n<p>noticed that the suit is of the year 2001 and a decree has<\/p>\n<p>been obtained. As rightly noticed by the courts below, the<\/p>\n<p><span class=\"hidden_text\">Ex.SA No.2\/10                   4<\/span><\/p>\n<p>attempt seems to be to delay the execution. If there was<\/p>\n<p>any bona fide in the claim made by the appellant, she<\/p>\n<p>would have taken necessary steps to establish her claim.<\/p>\n<p>Having not done so, it cannot be said that she was<\/p>\n<p>precluded from adducing evidence. In the result, no<\/p>\n<p>grounds are made out to interfere with the Judgment and<\/p>\n<p>decree of the court below.
