Justice P.N.RAVINDRAN\n\n Dated :15\/10\/2010\n\n O R D E R\n                          P.N.RAVINDRAN, J.\n                 -----------------------------------------\n                      W.P(C).No.31684 of 2010\n                 -----------------------------------------\n              Dated this the 15th day of October, 2010\n\n                               JUDGMENT\n<\/pre>\n<p>      The petitioners are former employees of the Kerala State Road<\/p>\n<p>Transport Corporation, hereinafter referred to as the Corporation for<\/p>\n<p>short.    They retired from service on 31.3.2007, 30.4.2007.<\/p>\n<p>31.10.2006, 31.10.2006, 30.6.2007, 31.5.2007 and 31.10.2006<\/p>\n<p>respectively. After the petitioners retired from service, pursuant to a<\/p>\n<p>bilateral agreement entered into between the Corporation and its<\/p>\n<p>employees their pensionary benefits were revised with effect from<\/p>\n<p>1.3.2006 subject to the condition that the monetary benefits will be<\/p>\n<p>paid only with effect from 1.4.2009.          In this writ petition, the<\/p>\n<p>petitioners claim payment of the revised pensionary benefits with<\/p>\n<p>effect from 1.4.2009 in terms of the aforesaid settlement.<\/p>\n<p>      2.    Sri.V.V.Nandagopal Nambiar, learned standing counsel<\/p>\n<p>appearing for the Corporation submits that the issue raised by the<\/p>\n<p>petitioners is covered in their favour by Ext.P3 judgment of a Division<\/p>\n<p>Bench of this Court and that the Corporation will determine the revised<\/p>\n<p>pensionary benefits payable to the petitioners and disburse the arrears<\/p>\n<p>with effect from 1.4.2009 expeditiously.<\/p>\n<p>       In the light of the said submission I dispose of the writ petition<\/p>\n<p>W.P(C).No.31684 of 2010<br \/>\n<span class=\"hidden_text\">                                  : 2 :<\/span><\/p>\n<p>with a direction to the respondents to compute the revised pensionary<\/p>\n<p>benefits payable to the petitioners with effect from 1.4.2009 under the<\/p>\n<p>settlement concluded on 28.11.2008 and to disburse the arrears<\/p>\n<p>expeditiously and in any event within one month from the date of<\/p>\n<p>receipt of a certified copy of this judgment.      It is clarified that if<\/p>\n<p>payment as directed above is not made within the time limit of one<\/p>\n<p>month, the arrears of pension payable to the petitioners will carry<\/p>\n<p>simple interest at the rate of 6% per annum from 1.6.2009.
