SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/08\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\t Rule.\n<\/p>\n<p>Mr.Zubin Bharda, learned Advocate waives service of notice of Rule on<br \/>\nbehalf of the respondent. With the consent of the learned Advocates<br \/>\nappearing on behalf of the respective parties, the petition is taken<br \/>\nup for final hearing today.\n<\/p>\n<p>2.\t\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioner ?  wife has prayed for an appropriate Writ, direction<br \/>\nand\/or order quashing and setting aside the order dated 11.02.2008<br \/>\npassed by the learned 7th Additional Senior Civil Judge,<br \/>\nRajkot below application Exh.11 in H.M.P.No.48 of 2005 by which the<br \/>\nlearned Trial Court has rejected the application submitted by the<br \/>\npetitioner ?  wife for interim alimony of maintenance of herself and<br \/>\nher minor daughter who is studying in Jr.K.G.\n<\/p>\n<p>3.\t\tMr.Arpit<br \/>\nKapadia, learned Advocate appearing on behalf of the petitioner ?<br \/>\nwife has submitted that in the facts and circumstances of the case,<br \/>\nthe petitioner might not press for interim alimony so far as the<br \/>\napplicant is concerned, but so far as minor daughter is concerned,<br \/>\ninterim alimony is required to be paid by the respondent ?  husband<br \/>\nto meet with the expenses towards education and other expenses for<br \/>\nmaintenance of minor girl.\n<\/p>\n<p>4.\t\tMr.Bharda,<br \/>\nlearned Advocate appearing on behalf of the respondent ?  husband<br \/>\nunder the instructions of respondent ?  husband who is personally<br \/>\npresent in the Court has submitted that so far as the minor girl is<br \/>\nconcerned, he is ready and willing to pay maintenance at the rate of<br \/>\nRs.1350\/- (Rupees One Thousand Three Hundred and Fifty only) per<br \/>\nmonth from the date of application. However, so far as the arrears is<br \/>\nconcerned, some reasonable time be given to make the said payment.\n<\/p>\n<p>5.\t\tConsidering<br \/>\nabove, impugned order dated 11.02.2008 passed by the learned Trial<br \/>\nCourt below Exh.11 in H.M.P.No.49 of 2005 is hereby modified to the<br \/>\nextent that the respondent-husband \/ father of the minor girl is<br \/>\ndirected to pay interim maintenance at the rate of Rs.1350\/- (Rupees<br \/>\nOne Thousand Three Hundred and Fifty only) per month towards minor<br \/>\nGirl ?  Rushali \/ Tarshavi from the date of application i.e. 03rd<br \/>\nOctober, 2005. Arrears at the rate of Rs.1350\/- (Rupees One Thousand<br \/>\nThree Hundred and Fifty only) per month from October, 2005 till<br \/>\nAugust, 2008 shall be cleared by the respondent \/ husband \/ father in<br \/>\n3(three) equal monthly installments from today to be deposited by the<br \/>\nrespondent ?  husband before the learned trial Court and on such<br \/>\ndeposit, the petitioner ?  wife shall be permitted to withdraw the<br \/>\nsame. The respondent ?  husband shall also continue to pay interim<br \/>\nmaintenance at the rate of Rs.1350\/- (Rupees One Thousand Three<br \/>\nHundred and Fifty only) per month as and when due and payable<br \/>\ncommencing from 01st September, 2008, to be paid on or<br \/>\nbefore 10th of each Month, to be deposited with the<br \/>\nlearned trial Court and the learned trail Court is directed to permit<br \/>\nthe petitioner ?  wife to withdraw the said amount. Rule is made<br \/>\nabsolute to the aforesaid extent. In the facts and circumstances of<br \/>\nthe case, there shall be no order as to costs.
