SHAH\n\t\t\n\t\n\n \n\nDate\n: 21\/06\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\napplication has been preferred by the applicant &#8211; appellant &#8211;<br \/>\noriginal opponent No.2 New India Assurance Co. Ltd. for appropriate<br \/>\ninterim order to stay further implementation and operation of the<br \/>\njudgment and award dated 06.12.2010 passed by the learned Motor<br \/>\nAccident Claims Tribunal (Main), Rajkot in M.A.C.P. No.1032\/2006.  It<br \/>\nis to be noted that Appeal is already admitted and while issuing Rule<br \/>\nin the present application, learned Single Judge passed the following<br \/>\nad-interim order on 01.04\/2011.\n<\/p>\n<p>RULE,<br \/>\nreturnable on 09th May 2011. In the<br \/>\nmeantime, there will be ad interim relief in terms of paragraph 7(A)<br \/>\non condition that the applicant will deposit the entire decreetal<br \/>\namount with the Tribunal before the returnable date. The Tribunal<br \/>\nwill, in turn, invest 70% amount in a  Nationalized Bank by way of an<br \/>\nFDR initially for a period of three years and the same shall be<br \/>\nrenewed from time to time till final disposal of the main appeal. The<br \/>\nFDR be retained by the Nazir of the Tribunal. Further orders as to<br \/>\ninvestment\/ disbursement of the balance 30% amount will be passed on<br \/>\nthe returnable date.\n<\/p>\n<p>2.\tThough<br \/>\nserved, nobody appears on behalf of the original claimants<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Majmudar, learned advocate appearing on behalf of the<br \/>\napplicant and so as to protect the interest of the original claimants<br \/>\nand the amount awarded to the original claimants is not frittered<br \/>\naway, ad-interim relief granted earlier by order dated 01\/04\/2011 is<br \/>\nmade absolute as interim relief till final disposal of the main First<br \/>\nAppeal on the same terms and conditions with further modification<br \/>\nthat even the balance 30% of the amount also shall be invested by the<br \/>\nTribunal in any Nationalized Bank by way of fixed deposit receipt<br \/>\ninitially for a period of 3 years and the same shall be renewed from<br \/>\ntime to time till final disposal of the main First Appeal.  The FDRs<br \/>\nmay be retained by the Nazir of the Tribunal.  However, the claimants<br \/>\nshall be entitled to periodical interest on the aforesaid FDRs.<br \/>\nThere shall be no loan or advance on the FDRs.  Rule is made absolute<br \/>\naccordingly.
