SANKARAN, J.\n                  ---------------------------\n                   B.A. No.3055 of 2009\n               ------------------------------------\n             Dated this the 11th day of June, 2009\n\n                           O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under section<\/p>\n<p>438 of the Code of Criminal Procedure. The petitioner is the<\/p>\n<p>accused in Crime No.110\/2009 of Meppayaur Police Station.<\/p>\n<p>      2.   The offences alleged against the petitioner are<\/p>\n<p>under Sections 448 and 427 of the Indian Penal Code and<\/p>\n<p>Section 30 of the Explosive Substances Act.<\/p>\n<p>      3.   The   First   Information     statement   given    by<\/p>\n<p>Ajayakumar shows that at about 3 a.m on 24\/05\/2009, he<\/p>\n<p>woke up hearing a noise and found a bomb in the courtyard. It<\/p>\n<p>is also stated one bomb had exploded. It is also stated in the<\/p>\n<p>F.I. statement that nephew (petitioner) and brother of the<\/p>\n<p>defacto complainant had certain financial dealings and that the<\/p>\n<p>petitioner had threatened the defacto complainant. Therefore,<\/p>\n<p>the defacto complainant suspects the petitioner in respect of<\/p>\n<p>commission of the offence. There is no specific allegation<\/p>\n<p>against the petitioner in the F.I. Statement that he has<\/p>\n<p>B.A. No.3055\/2009<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>committed the offence. The investigation is progressing. The<\/p>\n<p>petitioner apprehends arrest.\n<\/p>\n<p>      4.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioner, the officer in charge of the police station shall release<\/p>\n<p>him on bail for a period of one month on his executing bond for<\/p>\n<p>Rs.25,000\/- with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<blockquote><p>         A) The petitioner shall        report      before     the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on all Mondays, till the final report is filed or until<br \/>\n             further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The     petitioner   shall   appear      before    the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioner shall not try to influence the<br \/>\n             prosecution   witnesses    or   tamper      with  the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioner shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.\n<\/p><\/blockquote>\n<p>B.A. No.3055\/2009<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>         E) On the expiry of the period mentioned above, the<br \/>\n             petitioner shall surrender before the Magistrate<br \/>\n             concerned and seek regular bail.\n<\/p>\n<p>         F) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.\n<\/p>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                   K.T.
