Petitioner No.2, at the relevant<br \/>\ntime, was their minor daughter. They had approached the Family Court,<br \/>\nAhmedabad seeking maintenance from the respondent No.2. Family Court<br \/>\nby order dated 29th November 2007 directed the respondent<br \/>\nNo.2 to pay monthly maintenance of Rs.2500\/- to the wife and<br \/>\nRs.1500\/- to the child. He was, thus, required to pay maintenance of<br \/>\nRs.4,000\/- every month to the present petitioners from the date of<br \/>\napplication i.e. 2.12.2005. Claimants have filed the present<br \/>\nproceeding seeking enhancement of maintenance. At the outset, it may<br \/>\nbe noted that the petitioner No.2   daughter of the respondent No.2<br \/>\nhas got married on 17.06.2009. As per provisions of Section 125 of<br \/>\nCr.P.C., from that date she would not be entitled to any further<br \/>\nmaintenance.\n<\/p>\n<p>2.\tNow<br \/>\nthe question is what maintenance the petitioner No.1 should be paid<br \/>\nfrom that date onwards and whether there should be any enhancement in<br \/>\nfavour of both the petitioners for the period interior to 17.06.2009.\n<\/p>\n<p>3.\tCounsel<br \/>\nfor the petitioner drew my attention to salary slip of the respondent<br \/>\nNo.2. He also pointed out that he had received Rs.8 lakhs by way of<br \/>\ncompensation in land acquisition proceeding which amount would<br \/>\nreceive reasonable interest on investment. He, therefore, submitted<br \/>\nthat maintenance awarded by the Family Court is inadequate.\n<\/p>\n<p>4.\tOn<br \/>\nthe other hand, Counsel for the respondent No.2 submitted that he has<br \/>\nadditional responsibility of supporting his son who is residing with<br \/>\nhim and his studying. The take home salary is not more than<br \/>\nRs.10,000\/-. Amount of compensation for land acquisition was received<br \/>\nway back in the year 1995. Such amount has been used away for<br \/>\nmarriage of the sister and in post death ceremonies of his parents.\n<\/p>\n<p>5.\tFrom<br \/>\nthe material on record, following position emerges.\n<\/p>\n<p>(I)\t\tPetitioner<br \/>\nNo.2 having married on 17.06.2009, maintenance in her favour would<br \/>\ncease from that date.\n<\/p>\n<p>(II)\t\tThough<br \/>\nit is stated that son of the respondent No.2 is presently about 19<br \/>\nyears of age, but when the Family Court decided the issue of<br \/>\nmaintenance, he was admittedly minor. Respondent No.2, therefore, had<br \/>\nhis liability also on his head.\n<\/p>\n<p>(III)\tFrom<br \/>\nthe salary slip, it can be seen that the respondent No.2 was<br \/>\nreceiving salary of Rs.15,910\/- in June, 2010. Employer had deducted<br \/>\nRs.5842\/- therefrom giving him net amount of Rs.10,068\/-. Out of the<br \/>\nsaid deductions, he was paying Rs.770\/- to the provident fund and<br \/>\nRs.2087\/- towards LIC premium.\n<\/p>\n<p>6.\tHowever,<br \/>\nthese deductions are in the nature of his savings. Part thereof is<br \/>\nvoluntary and part is compulsory, nevertheless, it does not take away<br \/>\ncharacter of deductions being in the nature of savings of the<br \/>\nemployee.\n<\/p>\n<p>6.1\tHis<br \/>\nearning in June, 2010, therefore, at least, can be close to<br \/>\nRs.13,000\/-.\n<\/p>\n<p>7.\tThough<br \/>\nCounsel for the respondent No.2 admitted that the amount of Rs.8<br \/>\nlakhs was received by way of compensation, his stand that such amount<br \/>\nwas used away in religious ceremonies, is nowhere brought on record.<br \/>\nIt is, therefore, not possible to accept this version of the husband<br \/>\nof having used nearly Rs.8 lakhs on marriage and post death<br \/>\nceremonies. He was, thus, receiving considerable interest from such<br \/>\nsavings to augment his salary income.\n<\/p>\n<p>8.\tConsidering<br \/>\nabove aspects of the matter, taking into account the totality of the<br \/>\nfacts and circumstances of the case, it is provided that the<br \/>\nrespondent No.2 shall pay total amount of Rs.5,000\/- to petitioner<br \/>\nNo.1 from date 17.06.2009 and for the period prior to the said date,<br \/>\nthere shall be no modification.\n<\/p>\n<p>9.\tIf<br \/>\narrear of maintenance as per this order is cleared by latest by 31st<br \/>\nOctober 2010, there shall be no coercive recovery thereof against the<br \/>\npresent petitioner.\n<\/p>\n<p>\tWith<br \/>\nthese directions, the petition is disposed of.\n<\/p>\n<p>(<br \/>\nAKIL KURESHI, J. )<\/p>\n<p>kailash<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Pushpaben vs State on 3 September, 2010 Author: Akil Kureshi,&amp;Nbsp;
