Heard  the  learned  counsel   for   the<br \/>\nparties.\n<\/p>\n<p> 2. The brief facts of this petition, are as<br \/>\nunder :-\n<\/p>\n<p>  The  respondent  no.16  is not specified<br \/>\nsociety.  Under its bye-laws any person, who  holds  a<br \/>\nshare  of  Rs.100\/-  is  entitled  to become a member.<br \/>\nUnder its by bye-laws its  election  to  the  Managing<br \/>\nCommittee  are  to  be  held  in  accordance  with the<br \/>\nElection Rules,  which  are  required  to  be  framed.<br \/>\nAdmittedly,  such  Election Rules were approved by the<br \/>\nAssistant Registrar-respondent No.1 on 23.8.2000.   In<br \/>\nthe  Election  Rules a person a member was entitled to<br \/>\nfile his nomination provided he owned  two  shares  of<br \/>\nthe value  of  Rs.200\/-.   On 14.11.2001, the election<br \/>\nprogramme of  respondent  no.16  society  came  to  be<br \/>\npublished.   Under  the  Election programme, the dates<br \/>\nfor filing of nomination were between  10.12.2001  and<br \/>\n14.12.2001.   The  last date for raising objection was<br \/>\n18.12.2001.  The date for scrutiny was on  20.12.2001.<br \/>\nIt  is  not  in  dispute  that  on  the date fixed for<br \/>\nscrutiny,  the  Returning  Officer-  respondent  no.2,<br \/>\nrejected nomination of present respondents No.3 to 15,<br \/>\non the ground that they were not owners of two shares,<br \/>\nwhich was a pre-requisite condition under the Election<br \/>\nRules, as stated hereinabove.\n<\/p>\n<p> 3. Being  aggrieved by the rejection of the<br \/>\nnomination the respondents No.3 to 15 filed an  appeal<br \/>\nbefore the Assistant Registrar of Co-operative Society<br \/>\nunder  section  152(a) of the Maharashtra Co-operative<br \/>\nSocieties Act, 1960.  The said appeal was  decided  by<br \/>\nrespondent no.1  on  13.1.2001.    While  deciding the<br \/>\nappeal, he accepted the contention of  the  respondent<br \/>\nto  the  effect that the nomination had been rejected,<br \/>\nin view of clear provision of  Election  Rules,  which<br \/>\nrequired a person seeking nomination to own two shares<br \/>\nworth Rs.200\/-.   He further held that had respondents<br \/>\nNo.3 to 15 been given an opportunity of hearing,  then<br \/>\nthey would   have   removed   the   objection.      In<br \/>\nconsequence, he gave a direction that  if  respondents<br \/>\nNo.3  to  15  remain  present,  then  respondent no.16<br \/>\nsociety should  accept  the  amount  of  Rs.200\/-  and<br \/>\ncontinue their nominations, as valid.\n<\/p>\n<p> 4. This order of respondent no.1 passed, as<br \/>\naforesaid  on  31.12.2001 is the subject matter of the<br \/>\npresent Writ Petition.  It is the  contention  of  the<br \/>\npetitioner  that  once  the Election Rules, admittedly<br \/>\nframed under bye-laws clearly provided  the  ownership<br \/>\nof   two  shares  of  the  valuation  of  Rs.200\/as  a<br \/>\npre-requisite condition to the filing  of  nomination,<br \/>\nwithin   Election   Rules,   which  were  approved  by<br \/>\nrespondent no.1 himself, it had binding force and  the<br \/>\nReturning   Officer   had   rightly   disallowed   the<br \/>\nnomination of respondents No.3 to 15, who did not have<br \/>\nthe requisite two shares.  It was  further  contention<br \/>\nof  the  petitioner  that  the respondent no.1, having<br \/>\naccepted that two  shares  were  necessary  under  the<br \/>\nElection  Rules,  exceeded  its  power  under  section<br \/>\n152(a) of the Maharashtra Co-operative Societies  Act,<br \/>\n1960,  by  giving a direction to the society to accept<br \/>\nthe amount of Rs.200\/- from respondents No.3 to 15, if<br \/>\nthey remain present.    The  argument  was  that  such<br \/>\ndirection beyond the scope and ambit of Section<br \/>\n152(a)<br \/>\nof the Maharashtra Cooperative Societies Act,1960.\n<\/p>\n<p> 5. On behalf of respondents 3 to 15, it was<br \/>\ncontended  that  the  Election  Rules  as  framed   by<br \/>\nrespondent no.1  are  unreasonable.    It  is  further<br \/>\ncontented that it is beyond the scope conferred by the<br \/>\nManaging Committee to frame the Election Rules.\n<\/p>\n<p> 6. The   Society   in  question  is  not  a<br \/>\nspecified society.   Once  it  is  admitted  that  the<br \/>\nElection  Rules  have  been  framed  and  provide  for<br \/>\nrequirement  of  two  shares  for   filing   a   valid<br \/>\nnomination,  any  grievance relating to the manner, in<br \/>\nwhich the present Election  Rules  have  been  framed,<br \/>\nmust  necessarily  lie,  within the ambit of a dispute<br \/>\nunder Section 91 of Maharashtra Co-operative Societies<br \/>\nAct,1960.  It may be noticed that the  Election  Rules<br \/>\nwere  framed  and  approved on 23.8.2001 by respondent<br \/>\nno.1.   There  was  ample  time  and  opportunity  for<br \/>\nrespondents no.    3  to  15  to challenge the same by<br \/>\nfiling a  dispute,  if  they  so  desired.     Further<br \/>\nargument is that it is open for respondents No.3 to 15<br \/>\nto raise contention of unreasonableness, arbitrariness<br \/>\nand  validity  of  the election bye-laws for the first<br \/>\ntime even in reply to the present Writ Petition.  I am<br \/>\nnot inclined to accept this argument.    The  Election<br \/>\nbye-laws  are  not  under  direct  challenged  in this<br \/>\nCourt.   Respondent  NO.3  to  15   have   not   filed<br \/>\nproceeding challenging  byelaws.   Therefore, validity<br \/>\nof bye-laws cannot be gone into this writ petition and<br \/>\nit is always open hereinafter for respondents no.3  to<br \/>\n15 or any other aggrieved person to file dispute under<br \/>\nsection  91  of the Maharashtra Co-operative Societies<br \/>\nAct,1960, to challenge the same.It appears to me  that<br \/>\nthe  respondent  no.1,  has  exceeded  his power under<br \/>\nsection<br \/>\n152(a)  by  giving  untenable  direction   to<br \/>\nrespondent  no.16  to  accept  the  share value to the<br \/>\nextent of Rs.200\/- from the respondents  no.3  to  15.<br \/>\nThe only question that he ought to have considered was<br \/>\nwhether  nomination  was  correctly  rejected  by  the<br \/>\nReturning Officer and as to  whether  the  respondents<br \/>\nNo.3  to  15  were  disqualified  on the date that the<br \/>\nnomination were rejected.\n<\/p>\n<p> 7. In the result, this Writ  Petition  must<br \/>\nsucceed.\n<\/p>\n<p> 8. Rule  is  made  absolute,  in  terms  of<br \/>\nPrayer Clause (a).\n<\/p>\n<p> 9. There shall be no order as to costs.\n<\/p>\n<p> 10.
