No. 2068 of 2008\n            -------------------------------------------------\n          Dated this the 21st day of August, 2008\n\n                               ORDER\n<\/pre>\n<p>     The petitioner is the 2nd accused and he, along with two<\/p>\n<p>others, faced indictment for the offence punishable under<\/p>\n<p>Sec.436 read with Sec.34 IPC. The co-accused have already<\/p>\n<p>been tried, found not guilty and acquitted. The petitioner was<\/p>\n<p>not available for trial.     The case against him was split up.<\/p>\n<p>The same is now pending before the Assistant Sessions Court,<\/p>\n<p>Vadakara, as S.C.NO.1132\/06.           At this stage, the petitioner,<\/p>\n<p>along with the de facto complainant, has come before this<\/p>\n<p>Court. He points out that the co-accused having already been<\/p>\n<p>acquitted, no useful purpose will be served by continuing the<\/p>\n<p>surviving prosecution against the petitioner. It is by now trite,<\/p>\n<p>after the decision in <a href=\"\/doc\/217622\/\">Moosa v. Sub Inspector of Police<\/a> (2006<\/p>\n<p>(1) KLT 552), that the acquittal of a co-accused is by itself no<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 2068 of 2008 -: 2 :-<\/span><\/p>\n<p>sufficient reason to justify the invocation of the extraordinary<\/p>\n<p>inherent jurisdiction under Sec.482 Cr.P.C.    An absconding co-<\/p>\n<p>accused cannot be held to be entitled for any benefit or<\/p>\n<p>advantage on account of the judgment of acquittal rendered by<\/p>\n<p>the court in favour of the co-accused on the basis of an evidence<\/p>\n<p>in the prosecution against the co-accused.<\/p>\n<p>      2. The learned counsel for the petitioner then submits that<\/p>\n<p>in this case the parties have already settled their disputes. The<\/p>\n<p>2nd respondent is the de facto complainant and the 3rd<\/p>\n<p>respondent &#8211; his father, is the person whose building was<\/p>\n<p>allegedly set fire to.   The petitioner is the nephew of the 3rd<\/p>\n<p>respondent.    A purely private dispute had led to the alleged<\/p>\n<p>crime and the allegations being raised against the petitioner.<\/p>\n<p>The parties have willingly and voluntarily settled their disputes.<\/p>\n<p>      3. Respondents 2 and 3 have filed a joint affidavit to<\/p>\n<p>confirm that they have settled their disputes with the petitioner.<\/p>\n<p>Both respondents 2 and 3 are represented by a counsel and the<\/p>\n<p>counsel confirms that the parties have settled their purely<\/p>\n<p>personal dispute and respondents 2 and 3 have no surviving<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 2068 of 2008 -: 3 :-<\/span><\/p>\n<p>grievance against the petitioner. Taking the totality of<\/p>\n<p>circumstances into account and invoking the dictum in <a href=\"\/doc\/1442974\/\">Madhan<\/p>\n<p>Mohan Abbot v. State of Punjab<\/a> (2008 AIR SCW 2287), the<\/p>\n<p>surviving prosecution against the petitioner in S.C.No.1132\/06<\/p>\n<p>may be quashed under Sec.482 Cr.P.C., it is prayed.<\/p>\n<p>      4. Notice was given to the learned Public Prosecutor. The<\/p>\n<p>learned Public Prosecutor, after taking instructions, confirms<\/p>\n<p>that the disputes have been settled between the parties.    The<\/p>\n<p>State has no objection against the quashing of proceedings<\/p>\n<p>invoking the dictum in Madhan Mohan Abbot.        The dispute is<\/p>\n<p>one which is purely private and personal between the parties, no<\/p>\n<p>public policy or public interest is involved.          In these<\/p>\n<p>circumstances, I am satisfied that this is a fit case where the<\/p>\n<p>powers under Sec.482 Cr.P.C. as enabled by the dictum in<\/p>\n<p>Madhan Mohan Abbot can be invoked notwithstanding the<\/p>\n<p>fact that the offence alleged is a non-compoundable offence.<\/p>\n<p>      5. In the result:\n<\/p>\n<p>      (a) This Crl.M.C. is allowed.\n<\/p>\n<p>      (b) S.C.NO.1132\/06 pending before the Assistant Sessions<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 2068 of 2008 -: 4 :-<\/span><\/p>\n<p>Court, Vadakara, against the petitioner herein is hereby<\/p>\n<p>quashed.\n<\/p>\n<p>    (c) The proceedings under Sec.446 Cr.P.C., if any, pending<\/p>\n<p>against the petitioner or his sureties shall be disposed of in<\/p>\n<p>accordance with law.\n<\/p>\n<\/p>\n<p>                                          Sd\/-\n<\/p>\n<p>\n                                     (R.
