The  submission<br \/>\nmade  on  behalf  of the appellant is  that  the  expression<br \/>\nmine  used in Section 2(1) of the Act has to be read along<br \/>\nwith  the  expressions such as in respect of and read  so,<br \/>\nwould  mean not only the area where extraction of ores takes<br \/>\nplace,\tbut  also the other offices and that  the  enactment<br \/>\nitself intends to make a distinction, it has so been made as<br \/>\nis  clear  from Section 2(12) which defines  the  expression<br \/>\nfactory, and mine which is subject to the operation of the<br \/>\nMines  Act, 1952 is excluded from the purview of the Act and<br \/>\nplaced\theavy reliance on the decision of this Court in\t <a href=\"\/doc\/563308\/\">The<br \/>\nBallarpur  Collieries  Co.   vs.   State  Industrial  Court,<br \/>\nNagpur\t&amp;  Ors.,<\/a>  1966\t(2)  SCR  589.\t On  behalf  of\t the<br \/>\nrespondent,  strong reliance is placed upon the decision  in<br \/>\n<a href=\"\/doc\/1683954\/\">M\/s  Serajuddin\t &amp; Co.\tvs.  Their Workmen,<\/a> 1962 Supp.\t (3)<br \/>\nSCR 934, where the specific question what is the appropriate<br \/>\nGovernment  has\t been  considered and  held  the  expression<br \/>\nmine  used  in Section 2(a)(i) of the Mines Act,  1952\tto<br \/>\nconfine\t only to those cases where it really concerns a mine<br \/>\nwhere  extraction  of ores actually takes place\t as  defined<br \/>\nunder\tthe   Mines  Act  and\tnot  other  parts   of\t the<br \/>\nestablishment.\n<\/p>\n<p>      In the present case, the mines is situated at Pisurlen<br \/>\nand the office of the mine at Sanquelin.  The payment of the<br \/>\nstaff  and  workers is made through the office at  Sanquelin<br \/>\nwhile  the mining operations and the incidental work is done<br \/>\nat  Pisurlen.\tThe Head Office of the establishment  is  at<br \/>\nPanaji.\n<\/p>\n<p>      In  The  Ballarpur Collieries Co.s case [supra]  this<br \/>\nCourt  was  concerned with a notification which stated\tthat<br \/>\nthe  Act  would\t come  into  force  on\t21.11.1947  in\tall<br \/>\nindustries  except  the following and then went on to  name<br \/>\nfour  industries,  the third one being mines.  This  Court<br \/>\nheld  that after the word following the word  industries<br \/>\nmust  be read and thus read the notification in effect\tsaid<br \/>\nthe  Act  would\t come into effect on the given date  in\t all<br \/>\nindustries  except the industries mentioned.  Therefore,  it<br \/>\nwas  held that it is not only mines but the mining  industry<br \/>\nitself\tthat was exempted from the operation of the Act.  In<br \/>\nM\/s  Serajuddin &amp; Co.s case [supra] the dispute relating to<br \/>\nthe  Head  Office  of a mining company was referred  to\t the<br \/>\nIndustrial  Tribunal by the West Bengal Government under the<br \/>\nIndustrial  Disputes  Act, 1947.  It was held that the\tWest<br \/>\nBengal\tGovernment  was the appropriate Government  and\t the<br \/>\ndecision  turned on the interpretation of Section 2(a)(i) of<br \/>\nthe  ID Act which defines the appropriate Government.  The<br \/>\ncrucial words that fell for interpretation were in relation<br \/>\nto  an industrial dispute concerning a banking or  insurance<br \/>\ncompany\t or  mine or an oilfield or a major port.   It\twas<br \/>\nheld  that the word mine as used in Section 2(a)(i) of the<br \/>\nID  Act\t referred to a mine as defined in the Mines Act\t and<br \/>\nthat a dispute with reference to the Head Office of the mine<br \/>\nwas  not a dispute concerning a mine which must mean mine as<br \/>\ndefined\t under the Mines Act.  Therefore, this Court, having<br \/>\ninterpreted  the expression the appropriate Government\tin<br \/>\nthe  Industrial Disputes Act in M\/s Serajuddin &amp; Co.s  case<br \/>\n[supra]\t  which\t is  identical\t with  the  expression\tthe<br \/>\nappropriate  Government as defined under the Act, we  think<br \/>\nthe view taken by the High Court is correct and calls for no<br \/>\ninterference.  This appeal, therefore, stands dismissed.  No<br \/>\nCosts.\n<\/p>\n<p>      C.A.No.8891\/97  In  this matter questions arising\t for<br \/>\nconsideration\t are   identical   to\t those\t arose\t  in<br \/>\nC.A.No.8890\/97.\t Following the decision therein, this appeal<br \/>\nalso  stands  dismissed.   I.A.\t  is filed  by\tone  of\t the<br \/>\nWorkmen-Union  in  support  of the case\t of  the  appellant.<br \/>\nInasmuch  as  we  have\tconsidered the\tcontentions  of\t the<br \/>\nimpleading  applicant also along with that of the  appellant<br \/>\nand  have  allowed  the said applicant to intervene  in\t the<br \/>\nmatter,\t impleadment is unnecessary.
