Act. \u00a0 The \u00a0 case \u00a0 is \u00a0 registered \u00a0 under \u00a0 the\u00a0<br \/>\nprovisions\u00a0of\u00a0the\u00a0Prevention\u00a0Of\u00a0Immoral\u00a0Traffic\u00a0Act,\u00a01956.\n<\/p>\n<p>2\u00a0     Learned\u00a0Advocate\u00a0Mr.\u00a0C.B.\u00a0Raval,\u00a0for\u00a0the\u00a0detenue\u00a0submits\u00a0that,\u00a0<br \/>\ndue\u00a0to\u00a0oversight,\u00a0wrong\u00a0facts\u00a0of\u00a0another\u00a0case\u00a0are\u00a0wrongly\u00a0crept\u00a0in\u00a0the\u00a0<br \/>\npetition\u00a0and\u00a0requested\u00a0to\u00a0the\u00a0Court\u00a0to\u00a0ignore\u00a0the\u00a0said\u00a0facts\u00a0to\u00a0consider\u00a0<br \/>\nthe\u00a0oral\u00a0submission\u00a0made\u00a0before\u00a0the\u00a0Court\u00a0in\u00a0the\u00a0interest\u00a0of\u00a0justice\u00a0as\u00a0<br \/>\nthe\u00a0detenue\u00a0is\u00a0in\u00a0custody\u00a0from\u00a0the\u00a0date\u00a0of\u00a0his\u00a0arrest\u00a0in\u00a0connection\u00a0with\u00a0<br \/>\nthe\u00a0present\u00a0offence.\u00a0Learned\u00a0Advocate\u00a0further\u00a0regrets\u00a0for\u00a0the\u00a0incorrect\u00a0<br \/>\nfacts \u00a0 mentioned \u00a0 in \u00a0 the \u00a0 petition \u00a0 and \u00a0 the \u00a0 inconvenience \u00a0 caused \u00a0 to \u00a0 the\u00a0<br \/>\nCourt.\u00a0He\u00a0further\u00a0submits\u00a0that\u00a0the\u00a0order\u00a0of\u00a0detention\u00a0impugned\u00a0in\u00a0this\u00a0<br \/>\npetition \u00a0 deserves \u00a0 to \u00a0 be \u00a0 quashed \u00a0 and \u00a0 set \u00a0 aside \u00a0 on \u00a0 the \u00a0 ground \u00a0 that\u00a0<br \/>\nregistration \u00a0 of \u00a0 solitary \u00a0 complaint \u00a0 for \u00a0 the \u00a0 offence \u00a0 punishable \u00a0 under\u00a0<br \/>\nSections\u00a04,\u00a05,\u00a06,\u00a0and\u00a09\u00a0of\u00a0the\u00a0Immoral\u00a0Traffic\u00a0(Prevention)\u00a0Act,\u00a01956\u00a0by\u00a0<br \/>\nitself \u00a0 cannot \u00a0 bring \u00a0 the \u00a0 case \u00a0 of \u00a0 the \u00a0 detenue \u00a0 within \u00a0 the \u00a0 purview \u00a0 of\u00a0<br \/>\ndefinition \u00a0 under \u00a0 Section \u00a0 2(g) \u00a0 of \u00a0 the \u00a0 Act. \u00a0 Learned \u00a0 Advocate \u00a0 for \u00a0 the\u00a0<br \/>\ndetenue \u00a0 further \u00a0 submitted \u00a0 that \u00a0 illegal \u00a0 activity \u00a0 carried \u00a0 out \u00a0 as \u00a0 alleged\u00a0<br \/>\ncannot\u00a0have\u00a0any\u00a0nexus\u00a0or\u00a0bearing\u00a0with\u00a0maintenance\u00a0of\u00a0public\u00a0order\u00a0and\u00a0<br \/>\nat\u00a0the\u00a0most\u00a0it\u00a0can\u00a0be\u00a0said\u00a0to\u00a0be\u00a0breach\u00a0of\u00a0law\u00a0and\u00a0order.\u00a0It\u00a0is\u00a0further\u00a0<br \/>\nsubmitted\u00a0that,\u00a0except,\u00a0statements\u00a0of\u00a0witnesses,\u00a0registration\u00a0of\u00a0FIR\u00a0and\u00a0<br \/>\npanchnama,\u00a0no\u00a0other\u00a0relevant\u00a0or\u00a0cogent\u00a0material\u00a0is\u00a0available\u00a0on\u00a0record\u00a0<\/p>\n<p><span class=\"hidden_text\"> JUDGMENT<\/p>\n<p>connecting\u00a0the\u00a0alleged\u00a0anti\u00adsocial\u00a0activities\u00a0of\u00a0the\u00a0detenue\u00a0with\u00a0breach\u00a0of\u00a0<br \/>\npublic\u00a0order.\u00a0\n<\/p>\n<p>3\u00a0     Mr.\u00a0C.B.\u00a0Raval,\u00a0learned\u00a0Advocate\u00a0for\u00a0the\u00a0detenue\u00a0further\u00a0submits\u00a0<br \/>\nthat\u00a0it\u00a0is\u00a0not\u00a0possible\u00a0to\u00a0hold\u00a0in\u00a0the\u00a0facts\u00a0of\u00a0the\u00a0present\u00a0case\u00a0that\u00a0the\u00a0<br \/>\nactivities\u00a0of\u00a0the\u00a0detenue\u00a0with\u00a0reference\u00a0to\u00a0the\u00a0criminal\u00a0case\u00a0had\u00a0affected\u00a0<br \/>\neven\u00a0tempo\u00a0of\u00a0public\u00a0life\u00a0of\u00a0the\u00a0people\u00a0at\u00a0large\u00a0or\u00a0that\u00a0on\u00a0the\u00a0basis\u00a0of\u00a0the\u00a0<br \/>\ncriminal \u00a0 case, \u00a0 the \u00a0 detenue \u00a0 had \u00a0 put \u00a0 the \u00a0 entire \u00a0 social \u00a0 apparatus \u00a0 in\u00a0<br \/>\ndisorder, \u00a0 making \u00a0 it \u00a0 difficult \u00a0 for \u00a0 whole \u00a0 system \u00a0 to \u00a0 exist \u00a0 as \u00a0 a \u00a0 system\u00a0<br \/>\ngoverned\u00a0by\u00a0rule\u00a0of\u00a0law\u00a0by\u00a0disturbing\u00a0public\u00a0order.\n<\/p>\n<p>4\u00a0     Mr. \u00a0 Kkashyap \u00a0 Puara, \u00a0 learned \u00a0 AGP \u00a0 for \u00a0 the \u00a0 respondent \u00a0 State\u00a0<br \/>\nsupported \u00a0the \u00a0detention \u00a0order \u00a0passed \u00a0by\u00a0 the \u00a0authority \u00a0and\u00a0submitted\u00a0<br \/>\nthat \u00a0 sufficient \u00a0 material \u00a0 and \u00a0 evidence \u00a0 was \u00a0 found \u00a0 during \u00a0 the \u00a0 course \u00a0 of\u00a0<br \/>\ninvestigation\u00a0which\u00a0was\u00a0also\u00a0supplied\u00a0to\u00a0the\u00a0detenue\u00a0itself\u00a0indicate\u00a0that\u00a0<br \/>\nthe \u00a0 detenue \u00a0 is \u00a0 in \u00a0 habit \u00a0 of \u00a0 indulging \u00a0 into \u00a0 activities \u00a0 as \u00a0 defined \u00a0 under\u00a0<br \/>\nSection \u00a0 2(g) \u00a0 of \u00a0 the \u00a0 Act \u00a0 and \u00a0 considering \u00a0 the \u00a0 facts \u00a0 of \u00a0 the \u00a0 case, \u00a0 the\u00a0<br \/>\ndetaining \u00a0authority \u00a0has\u00a0rightly \u00a0passed\u00a0the \u00a0order \u00a0of\u00a0detention \u00a0and\u00a0the\u00a0<br \/>\ndetention \u00a0 order \u00a0 deserves \u00a0 to \u00a0 be \u00a0 upheld \u00a0 by \u00a0 this \u00a0 Court. \u00a0 However, \u00a0 no\u00a0<br \/>\naffidavit\u00adin\u00adreply\u00a0is\u00a0filed\u00a0on\u00a0behalf\u00a0of\u00a0any\u00a0of\u00a0the\u00a0respondents.\u00a0\n<\/p>\n<p>5\u00a0     Having\u00a0heard\u00a0the\u00a0submissions\u00a0of\u00a0the\u00a0parties\u00a0and\u00a0considering\u00a0the\u00a0<br \/>\nrequest\u00a0made\u00a0by\u00a0the\u00a0learned\u00a0Advocate\u00a0for\u00a0the\u00a0petitioner\u00a0with\u00a0regard\u00a0to\u00a0<br \/>\nthe \u00a0 wrong \u00a0 facts \u00a0 mentioned \u00a0 in \u00a0 the \u00a0 petition \u00a0 and \u00a0 also \u00a0 consider \u00a0 the\u00a0<br \/>\ncircumstances \u00a0 of \u00a0 the \u00a0 case, \u00a0 it \u00a0 appears \u00a0 that, \u00a0 the \u00a0 subjective \u00a0 satisfaction\u00a0<br \/>\narrived\u00a0at\u00a0by\u00a0the\u00a0detaining\u00a0authority\u00a0cannot\u00a0be\u00a0said\u00a0to\u00a0be\u00a0legal,\u00a0valid\u00a0and\u00a0<br \/>\nin \u00a0 accordance \u00a0 with \u00a0 law \u00a0 inasmuch \u00a0 as \u00a0 the \u00a0 offences \u00a0 alleged \u00a0 in \u00a0 the \u00a0 FIR,\u00a0<br \/>\ncannot\u00a0have\u00a0any\u00a0bearing\u00a0on\u00a0the\u00a0public\u00a0order\u00a0since\u00a0the\u00a0law\u00a0of\u00a0the\u00a0land\u00a0i.e.\u00a0<br \/>\nthe\u00a0Act,\u00a01956\u00a0and\u00a0other\u00a0relevant\u00a0penal\u00a0laws\u00a0are\u00a0sufficient\u00a0enough\u00a0to\u00a0take\u00a0<br \/>\ncare \u00a0 of \u00a0 the \u00a0 situation \u00a0 and \u00a0 that \u00a0 the \u00a0 allegations \u00a0 as \u00a0 have \u00a0 been \u00a0 levelled\u00a0<\/p>\n<p><span class=\"hidden_text\">                                        Page 3 of JUDGMENT<\/p>\n<p>against\u00a0the\u00a0detenue,\u00a0cannot\u00a0be\u00a0said\u00a0to\u00a0be\u00a0germane\u00a0for\u00a0the\u00a0purpose\u00a0of\u00a0<br \/>\nbringing\u00a0the\u00a0detenue\u00a0within\u00a0the\u00a0meaning\u00a0of\u00a0Section\u00a02(5)\u00a0of\u00a0the\u00a0Act\u00a0and\u00a0<br \/>\nunless\u00a0and\u00a0until\u00a0the\u00a0material\u00a0is\u00a0there\u00a0to\u00a0make\u00a0out\u00a0a\u00a0case\u00a0that\u00a0the\u00a0person\u00a0<br \/>\nconcerned\u00a0has\u00a0become\u00a0a\u00a0threat\u00a0and\u00a0a\u00a0menace\u00a0to\u00a0the \u00a0society\u00a0so\u00a0as\u00a0to\u00a0<br \/>\ndisturb \u00a0 the \u00a0 whole \u00a0 tempo \u00a0 of \u00a0 the \u00a0 society \u00a0 and \u00a0 that \u00a0 the \u00a0 whole \u00a0 social\u00a0<br \/>\napparatus \u00a0 is \u00a0 in \u00a0 peril \u00a0 disturbing \u00a0 public \u00a0 order \u00a0 at \u00a0 the \u00a0 instance \u00a0 of \u00a0 such\u00a0<br \/>\nperson, \u00a0 it \u00a0 cannot \u00a0 be \u00a0 said \u00a0 that, \u00a0 the \u00a0 detenue \u00a0 is \u00a0 a \u00a0 person \u00a0 within \u00a0 the\u00a0<br \/>\nmeaning\u00a0of\u00a0Section\u00a02(g)\u00a0of\u00a0the\u00a0Act.\u00a0Except\u00a0general\u00a0statements,\u00a0there\u00a0is\u00a0<br \/>\nno\u00a0material\u00a0on\u00a0record\u00a0which\u00a0shows\u00a0that\u00a0the\u00a0detenue\u00a0is\u00a0acting\u00a0in\u00a0such\u00a0a\u00a0<br \/>\nmanner\u00a0which\u00a0is\u00a0dangerous\u00a0to\u00a0the\u00a0public\u00a0order.\n<\/p>\n<p>6\u00a0      In\u00a0view\u00a0of\u00a0the\u00a0above,\u00a0I\u00a0am\u00a0inclined\u00a0to\u00a0allow\u00a0this\u00a0petition\u00a0because\u00a0<br \/>\nsimplicitor\u00a0registration\u00a0of\u00a0FIR\u00a0by\u00a0itself\u00a0cannot\u00a0have\u00a0any\u00a0nexus\u00a0with\u00a0the\u00a0<br \/>\nbreach \u00a0 of \u00a0 maintenance \u00a0 of \u00a0 public \u00a0 order \u00a0 and \u00a0 the \u00a0 authority \u00a0 can \u00a0 have\u00a0<br \/>\nrecourse\u00a0under\u00a0the\u00a0Act,\u00a01956\u00a0and\u00a0no\u00a0other\u00a0relevant\u00a0or\u00a0cogent\u00a0material\u00a0<br \/>\nexists\u00a0for\u00a0invoking\u00a0powers\u00a0under\u00a0Section\u00a03(1)\u00a0of\u00a03(2)\u00a0of\u00a0the\u00a0Act.\u00a0That\u00a0<br \/>\nthe\u00a0State\u00a0Government\u00a0has\u00a0not\u00a0filed\u00a0affidavit\u00adin\u00adreply\u00a0to\u00a0this\u00a0petition.\n<\/p>\n<p>7\u00a0      In\u00a0the\u00a0result,\u00a0this\u00a0Special\u00a0Civil\u00a0Application\u00a0is\u00a0allowed.\u00a0The\u00a0order\u00a0of\u00a0<br \/>\ndetention \u00a0 dated \u00a0 06.09.2014 \u00a0 passed \u00a0 by \u00a0 respondent \u00a0 No.1\u00adThe\u00a0<br \/>\nCommissioner \u00a0 of \u00a0 Police, \u00a0 Ahmedabad \u00a0 City, \u00a0 is \u00a0 hereby \u00a0 quashed \u00a0 and \u00a0 set\u00a0<br \/>\naside.\u00a0The\u00a0detenue\u00a0is\u00a0ordered\u00a0to\u00a0be\u00a0set\u00a0at\u00a0liberty\u00a0forthwith\u00a0if\u00a0the\u00a0detenue\u00a0<br \/>\nis\u00a0not\u00a0required\u00a0in\u00a0connection\u00a0with\u00a0any\u00a0other\u00a0case.\u00a0Rule\u00a0is\u00a0made\u00a0absolute\u00a0<br
