The challenge is made on various grounds<\/p>\n<p>including the source of power to sustain a levy like import fee.<\/p>\n<p>Going by Section 1(2) of the Abkari Amendment Ordinance<\/p>\n<p>No.26\/09, Section 3 is given retrospective effect and is deemed<\/p>\n<p>to have come into force on 30\/03\/1996. The proviso to Section 3<\/p>\n<p>reads as follows:-\n<\/p>\n<blockquote><p>           &#8220;3.  Amendment to Section 6:&#8211; In section 6 of<\/p>\n<p>     the principal Act, after sub-section (1), the following<\/p>\n<p>     proviso shall be inserted, namely:-<\/p>\n<\/blockquote>\n<blockquote><p>                &#8220;Provided        that      notwithstanding<\/p>\n<p>           anything contained in this Act, no import<\/p>\n<p>           fee shall be levied on rectified spirit or<\/p>\n<p>           Extra Neutral Alcohol including absolute<\/p>\n<p>           alcohol intended to be used for the<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.5999 \/08 &amp; con.cases          -2-<\/span><\/p>\n<p>            manufacture of liquor meant for human<\/p>\n<p>            consumption.&#8221;<\/p><\/blockquote>\n<p>      2.    It is pointed out by the learned counsel for the<\/p>\n<p>petitioners and the learned Government Pleader that in the light<\/p>\n<p>of the said proviso, which is applicable in the case of the<\/p>\n<p>petitioners, no import fee can be levied on rectified spirit or Extra<\/p>\n<p>Neutral Alcohol including absolute alcohol intended to be used for<\/p>\n<p>the manufacture of liquor meant for human consumption.<\/p>\n<p>      3.    Therefore, in the light of the said amended provisions,<\/p>\n<p>the petitioners are entitled to succeed in this Writ Petition.<\/p>\n<p>Therefore, the writ petitions are allowed. The impugned Demand<\/p>\n<p>Notices are quashed.
