2   07.12.2010             I.A. No. 4665 of 2010 has been filed by the<\/p>\n
                    petitioner for necessary amendments in the writ<\/p>\n
                    application     and    for    liberty    to     challenge    the<\/p>\n
                    order dated 6.4.2010 by which his second appeal<\/p>\n
                    has also been dismissed.\n<\/p>\n
                           Considering      the      facts   and     circumstances<\/p>\n
                    mentioned in the I.A. the same is allowed.<\/p>\n
                           In   this     writ    application       petitioner    has<\/p>\n
                    challenged     the    order      of   minor     punishment   of<\/p>\n
                    withholding of one increment without cumulative<\/p>\n
                    effect as contained in Annexure-5 as well as the<\/p>\n
                    order of the Appellate Authority rejecting his
\n                  2<\/span><\/p>\n
appeal as contained in Annexure-7 and also order<\/p>\n
dated    06.04.2010     of     the        second        Appellate<\/p>\n
Authority      rejecting      his    second        appeal        as<\/p>\n
contained in Annexure-10.\n<\/p>\n
        From the show cause notice as contained in<\/p>\n
Annexure-2 and the impugned order, Annexure-5 it<\/p>\n
appears that the charge against the petitioner<\/p>\n
was of delaying clearance of a file for granting<\/p>\n
technical approval for construction of a check<\/p>\n
post. Petitioner at the relevant time was Chief<\/p>\n
Engineer in the Central Planning Organization in<\/p>\n
the   Road   Construction     Department.          A    file    for<\/p>\n
granting technical approval for construction of a<\/p>\n
check   post    was   received       in     his        office    on<\/p>\n
31.1.2008. The file remained in the office for<\/p>\n
over 3 months and finally could be cleared with<\/p>\n
the technical approval only on 3.4.2008.The delay<\/p>\n
in construction of check post therefore caused<\/p>\n
revenue loss to the State Government. Hence, a<\/p>\n
show cause was issued to the petitioner to which<\/p>\n
he replied through Annexure-3. In his said reply,<\/p>\n
petitioner explained the movement of the file in<\/p>\n
his office. He stated that he was transferred<\/p>\n
from the post w.e.f.       27.3.2008 and therefore, he<\/p>\n
was   not    responsible     for    the    delay       caused   in<\/p>\n
transmitting    the   file    to    the   Engineer-in-Chief
\n                   3<\/span><\/p>\n
with technical approval thereafter. From the show<\/p>\n
cause it appears that, after the receipt of the<\/p>\n
file petitioner endorsed it to different persons<\/p>\n
for examination and report and file thus kept on<\/p>\n
moving in his Organization itself and was cleared<\/p>\n
and sent only on 3.4.2008.              Hence movement of the<\/p>\n
file and delay in granting technical clearance to<\/p>\n
the said proposal of construction of check post<\/p>\n
caused in his Organization stands established.<\/p>\n
         Learned counsel for the petitioner submits<\/p>\n
that    the    delay     was    not    on   the        part   of    the<\/p>\n
petitioner as he had endorsed the file to the<\/p>\n
concerned      section    under       him   for    scrutiny        etc.<\/p>\n
Therefore, he submits that petitioner cannot be<\/p>\n
held responsible for the delay. He submits that<\/p>\n
the entire process actually took only one month<\/p>\n
and seventeen days and not three months during<\/p>\n
the period of the petitioner.\n<\/p>\n
         It may be that the file was endorsed by<\/p>\n
the petitioner to his subordinate officers for<\/p>\n
scrutiny and report, but the fact is that the<\/p>\n
nature    of    the      work    required         as    expeditious<\/p>\n
dealing with the file. The petitioner was heading<\/p>\n
the    Organization      and,    therefore,        he     cannot     be<\/p>\n
absolved of the vicarious liability for the delay<\/p>\n
caused, though technically file may have remained
\n                                 4<\/span><\/p>\n
          on the table of some of his subordinate officers.<\/p>\n
          Being     the    head      of    the    Organization        it   was<\/p>\n
          required from the petitioner to appreciate the<\/p>\n
          urgency in the matter and ensure that the file is<\/p>\n
          cleared    immediately          and    sent   to   the   concerned<\/p>\n
          authorities to proceed in the matter.                       By the<\/p>\n
          impugned order the petitioner has been awarded a<\/p>\n
          minor punishment of withholding of one increment<\/p>\n
          without cumulative effect.               Hence, the effect of<\/p>\n
          the punishment will stand wiped out on completion<\/p>\n
          of one year as per the newly inserted Explanation<\/p>\n
          2 in Rule 14 of the 2005 Rules and petitioner<\/p>\n
          will be restored in the pay scale at the point he<\/p>\n
          will be entitled and shall also be considered for<\/p>\n
          promotion from the due date after the period of<\/p>\n
          punishment expires.\n<\/p>\n
                  In      the       circumstances,       considering       the<\/p>\n
          facts and circumstances of this case, this Court<\/p>\n
          does not find any merit in the writ application,<\/p>\n
          and the same is dismissed.\n<\/p>\n<\/p>\n
