Justice ANTONY DOMINIC\n\n Dated :11\/01\/2008\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                      ===============\n                  W.P.(C) NO. 1389 OF 2008 M\n               =====================\n\n           Dated this the 11th day of January, 2008\n\n                          J U D G M E N T\n<\/pre>\n<p>       A lorry belonging to the petitioner has been seized by the<\/p>\n<p>authorities  on    the   allegation  of  its  involvement   in  the<\/p>\n<p>unauthorised transportation of river sand. Obviously proceedings<\/p>\n<p>are pending before the 1st respondent, who has to pass orders in<\/p>\n<p>terms of Rule 27 of the Protection of River Banks and Regulation<\/p>\n<p>of Removal of Sand Rules, 2002. It is complaining of delay in<\/p>\n<p>finalisation of the proceedings that this writ petition has been<\/p>\n<p>filed by the petitioner seeking release of the truck.<\/p>\n<p>      In view of the pendency of the proceedings before the 1st<\/p>\n<p>respondent, I do not think it proper to direct release of the truck<\/p>\n<p>at this stage. It is for the 1st respondent to pass orders in terms<\/p>\n<p>of Rule 27 and therefore I dispose of this writ petition directing<\/p>\n<p>that the 1st respondent shall with, notice to the petitioner, pass<\/p>\n<p>WPC 1389\/08<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>orders in terms of Rule 27 of the Rules.
