The appellant was however, acquitted for the offences<br \/>\npunishable under Sections 302, 323 and 504 of IPC and Section 135 of<br \/>\nthe Bombay Police Act. He was also given the benefit of set-off under<br \/>\nSection 428 of Cr.PC.\n<\/p>\n<p>3.\tThe<br \/>\ncase of the prosecution is that, the complainant Lakhiben, now widow<br \/>\nof deceased Keslabhai Rathwa was residing at village Chichaba, Taluka<br \/>\nKawant, Dist. Vadodara with her family.  According to the<br \/>\nprosecution, the incident took place on 23.6.2003 at about 6.30 p.m.<br \/>\nwhen the complainant was at her house.  Her husband Keslabhai was<br \/>\nstanding in the open space nearby the house of the appellant,<br \/>\nGulalbhai Zamariyabhai Rathwa.  It is alleged that at that time,<br \/>\nGulalbhai, appellant herein, asked the deceased Keslabhai, husband of<br \/>\nthe complainant as to why the entire crop of Ladies Finger from his<br \/>\nland was collected instead of the crop from the portion of the<br \/>\ndeceased and the appellant accused to abuse him and the wife of the<br \/>\ncomplainant restrained him from abusing and on saying so by the wife<br \/>\nof complainant, the appellant accused got infuriated and went to his<br \/>\nhouse and came with a ?SPaliya?? (Dinga) and inflicted a blow  with<br \/>\nthe blunt portion of the ?SPaliya?? on the head of the deceased.<br \/>\nShe immediately snatched away the weapon from the appellant-accused<br \/>\nand thereafter, along with her husband, she went to Kawant Police<br \/>\nStation where she lodged the complaint.  On the basis of the said<br \/>\ncomplaint, the offence was registered as Kawant Police Station<br \/>\nC.R.No.II-43 of 2003 for the offences punishable under Sections 323<br \/>\nand 504 of IPC and under Section 135 of the Bombay Police Act. On<br \/>\n24.6.2003, the injured died at SSG Hospital during treatment and<br \/>\ntherefore, Section 302 of IPC was added  and the report under Section<br \/>\n157 of  Cr.PC was submitted before the  Court.  During the<br \/>\ninvestigation, statements of witnesses were recorded, Inquest<br \/>\npanchnama, panchnama of scene of offence and panchnama of recovery of<br \/>\nclothes as well as weapons were drawn; sample of blood from the soil<br \/>\nwas collected and the muddamal items were sent to the Forensic<br \/>\nScience Laboratory (FSL) for analysis. It is the prosecution case<br \/>\nthat the complaint Exh.36 was also recorded and the offence was<br \/>\nregistered.  The accused was also sent to hospital for treatment. At<br \/>\nthe end of investigation, the charge sheet was filed as referred  to<br \/>\nabove.  Since the court of learned JMFC has no jurisdiction to try<br \/>\nthe case, it was committed to the Court of Sessions which was<br \/>\nnumbered as Sessions Case No. 77 of 2003.\n<\/p>\n<p>4.\tThe<br \/>\nCharge was framed at Exh.4 against the present appellant-accused for<br \/>\nthe offences punishable under Sections 302, 323, and 504 of IPC and<br \/>\nSection 135 of the Bombay Police Act.  The appellant-accused denied<br \/>\nthe charges and claimed to be tried.\n<\/p>\n<p>5.<br \/>\n The further statement of the accused under Section 313 of Cr.PC was<br \/>\nrecorded wherein also, the appellant accused submitted that he has<br \/>\nbeen falsely involved in committing the offence.\n<\/p>\n<p>6.\tThe<br \/>\nprosecution has examined the following witnesses:\n<\/p>\n<p>\tPW-1<br \/>\nLekhiben Keslabhai ? Exh.13<\/p>\n<p>\tPW-5<br \/>\nRanjanbhai Gordhanbhai ?  Exh.19<\/p>\n<p>\tPW-6<br \/>\nRupjibhai Udariyabhai Rathwa ?  Exh.23<\/p>\n<p>\tPW-7<br \/>\nNatubhai Rataniyabhai Rathwa ? Exh.22<\/p>\n<p>\t\t\tProduction<br \/>\n\t\t\tof original F.I.R.(Accused)<\/p>\n<p>\t\t\tF.I.R.<\/p><\/blockquote>\n<p>\t\t\t&#8211; Complainant (Lakhiben)<\/p>\n<p>8.<br \/>\n The prosecution has examined PW-1-Lakhiben Keslabhai ?  Exh.9, who<br \/>\nis wife of the deceased, and the complainant.  She has  deposed that<br \/>\nshe along with her husband were walking towards their house and she<br \/>\nreached the house first. At that time, the appellant ?  accused<br \/>\ninflicted blow on the head of her husband with Paliya and this<br \/>\nincident was happened in front of the house of the appellant-accused.<br \/>\nThe appellant&#8217;s house is close to her house. She has deposed that the<br \/>\nincident took place at about 6 O&#8217;Clock in the evening. There was no<br \/>\nreason to inflict Paliya blow to her husband. Thereafter, she along<br \/>\nwith some other persons took her husband to Kawant Hospital.  She has<br \/>\ngiven the complaint about the incident at Kawant Police Station.<br \/>\nFrom Kawant Hospital, her husband was shifted to SSG Hospital<br \/>\nVadodara for better treatment, accompanying him. She has stated that<br \/>\nduring the treatment, her husband expired. She has identified the<br \/>\nappellant and the weapon used in the incident. In her cross<br \/>\nexamination, she has stated that at first instance, she took her<br \/>\nhusband in a ?SChakada?? directly to Kawant police station, where<br \/>\nshe has lodged the complaint. She has stated that in her presence,<br \/>\nthe police questioned her husband. She has further stated that she<br \/>\nreached the Police Station at about 7 O&#8217;Clock in the evening and<br \/>\ndenied that they spent about one hour in the Police Station.<br \/>\nThereafter, she has taken her husband to the hospital and the Doctor<br \/>\non duty talked to her husband to which, her husband was giving<br \/>\nanswer.   Thereafter her husband was taken in a Govt. vehicle to<br \/>\nVadodara and reached Vadodara at about 3 O&#8217;Clock in the early<br \/>\nmorning.  She has further stated that there was no accident or<br \/>\nanything happened during their travel from Kawant to Vadodara. The<br \/>\nDoctor had talked to her husband, but  he was not in a position talk.<br \/>\nThe Doctor gave her husband the necessary treatment, but he expired<br \/>\non the next day at about 3 O&#8217;Clock in the afternoon. Her husband was<br \/>\nnot in a position to talk till then. The statement was taken by the<br \/>\npolice from her at about 6 O&#8217;Clock, after the death of her husband.<br \/>\nShe has denied that the appellant-accused had drunk and was in an<br \/>\ninebriated condition at the time of incident. She has admitted that<br \/>\nshe has given  the statement that on the day of incident at about 6<br \/>\nO&#8217;Clock, she was at her house  and her husband was standing in the<br \/>\nfront side of the appellant&#8217;s house, which is nearby her house. She<br \/>\nhas also admitted that it is true that she has written in the<br \/>\ncomplaint before the police that at the time of incident, the<br \/>\nappellant had asked him as to why the crop of Ladies Finger had been<br \/>\ncollected. She has stated that she has been watering Ladies Finger<br \/>\ngrown at the portion of her land only and not in the portion of the<br \/>\nappellant.\n<\/p>\n<p>6.\tI<br \/>\nhave heard learned advocate Buddhabhatti, who is appearing as amicus<br \/>\ncuriae, appointed through Legal<br \/>\nAid Committee, on behalf of the appellant-accused and learned<br \/>\nAPP Mr.U.R.Bhatt.\n<\/p>\n<p>7.\tLearned<br \/>\nadvocate Mr.Budhhbhatti has taken this Court through the entire<br \/>\nevidence on record and submitted that taking into consideration the<br \/>\ncross complaint which is produced at Exh.36, the presence of the<br \/>\npresent appellant-accused was well established by the prosecution.<br \/>\nHe submitted that taking into consideration the complaint which is<br \/>\nproduced at Exh.33, it seems that a quarrel had taken place in<br \/>\nconnection with the collection of crop of Ladies Finger alone by the<br \/>\ncomplainant&#8217;s husband.  As per the PM report also, which is produced<br \/>\nas Exh.26, only one injury is found on the head of the deceased on<br \/>\nthe left-hand side temporal region and fracture was there.  It has<br \/>\nalso come in evidence that, firstly, the injured along with his<br \/>\nwife-complainant had gone to Police Station instead of going to<br \/>\nhospital and the complaint was lodged by the complainant. So, cross<br \/>\ncomplaint Exh.36 clearly suggests that all of a sudden the quarrel<br \/>\nhad taken place and accused as well as the deceased both were injured<br \/>\nin the scuffle, but as a result of the same, deceased received<br \/>\nsomewhat serious injury.  Therefore, the trial Court has rightly<br \/>\nconvicted the accused for the offence punishable under Section 304(2)<br \/>\nof IPC.  He further submitted that the appellant-accused is in jail<br \/>\nsince more than 8 years, and a poor person having no criminal<br \/>\nantecedents and hence, the appeal is required to be allowed<br \/>\nconsidering the peculiar facts and circumstances of the case.\n<\/p>\n<p>8.\tThe<br \/>\nwitness Meeraben Keslabhai  &#8211; PW-2 ?  Exh.10 has also stated in her<br \/>\ndeposition the same story as per that of the complainant Lekhiben.<br \/>\nShe has also identified the accused as well as the weapon used in<br \/>\ncommitting the offence. Same is the position with witness PW-3<br \/>\nVesalbhai Amariyabhai Rathwa ?  Exh.11. So also, the evidence of<br \/>\nother witnesses is of somewhat similar nature, though there are<br \/>\ncertain minor contradictions.\n<\/p>\n<p>9.\tConsidering<br \/>\nthe above, the appeal deserves to be  allowed and it is hereby partly<br \/>\nallowed. So far as the judgment and order of conviction and sentence<br \/>\ndated 25.6.2004 passed by the learned Addl.Sessions Judge &amp; 4th<br \/>\nFast Track Judge, Fast Track Court, Chhota-udepur, against the<br \/>\nappellant for the offence punishable under Section 304(2) of IPC in<br \/>\nCriminal Case No.77 of 2003 is concerned, while confirming the order<br \/>\nof conviction, the order of sentence is modified and reduced to the<br \/>\nextent that the period of sentence which the appellant-accused has<br \/>\nalready undergone be treated as the sentence imposed upon him.  The<br \/>\nappellant-accused is ordered to be released forthwith.
