BARKATH ALI, J.\n               ---------------------------------------------\n                  Bail Application No.2493 of 2010\n               ---------------------------------------------\n                Dated this the 23rd day of April, 2010\n\n                              O R D E R\n<\/pre>\n<p>      This is an anticipatory bail application filed by accused 1 and<\/p>\n<p>2 in Crime No.147\/2010 of Kuttippuram Police Station,<\/p>\n<p>Malappuram District under Section 438 of Cr.P.C.<\/p>\n<p>      2. The allegation against the petitioners is that on April 12,<\/p>\n<p>2010 at about 8 a.m. the accused trespassed into the house of<\/p>\n<p>the defacto complainant and manhandled and beat her and<\/p>\n<p>thereby committed offences punishable under Sections 452, 323,<\/p>\n<p>506(2) r\/w Section 34 of IPC.\n<\/p>\n<p>      3. It is alleged in the petition that on the same day at<\/p>\n<p>about 10.40 a.m. the uncle of the defacto complainant in this<\/p>\n<p>case trespassed into the house of the petitioners and attacked<\/p>\n<p>the first petitioner and his mother for which Crime No.163\/2010<\/p>\n<p>was registered by the Kalpakamchery Police Station, that to<\/p>\n<p>escape from that case, the present case has been foisted against<\/p>\n<p>the petitioners and that the petitioners apprehend arrest and<\/p>\n<p>harassment by police and therefore anticipatory bail may be<\/p>\n<p>BA No. 2493 of 2010<br \/>\n<span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>granted to the petitioners.\n<\/p>\n<p>      4. Notice given to the Public Prosecutor. Heard counsel for<\/p>\n<p>the petitioners and Public Prosecutor.\n<\/p>\n<p>      5.    For the following reasons I am inclined to grant<\/p>\n<p>anticipatory bail to the petitioners. The defacto complainant is a<\/p>\n<p>relative of the first petitioner. This is essentially a family dispute.<\/p>\n<p>Further it is alleged that in another incident on the same day the<\/p>\n<p>uncle of defacto complainant attacked the first petitioner and<\/p>\n<p>caused injuries to him.       For which     Crime No.163\/2010 was<\/p>\n<p>registered by the Kalpakamchery Police Station. The copy of the<\/p>\n<p>FIR in that case was produced. Taking into consideration the<\/p>\n<p>circumstances of the case and the facts that the petitioner and<\/p>\n<p>defacto complainant are relatives, I feel that the apprehension of<\/p>\n<p>the petitioners that they will be arrested and harassed at the<\/p>\n<p>hands of the police appears to be true. Therefore I feel that this<\/p>\n<p>is a fit case in which anticipatory bail can be granted to the<\/p>\n<p>petitioners.\n<\/p>\n<p>      In the result, the petition is allowed.      The respondent is<\/p>\n<p>directed to release the petitioners on bail, if arrested,           on<\/p>\n<p>BA No. 2493 of 2010<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>executing a bond for Rs.25,000\/-(Rupees twenty five thousand<\/p>\n<p>only)each      with two solvent sureties for  like sum each.  If<\/p>\n<p>arrested and released on bail, the petitioners shall co-operate<\/p>\n<p>with the investigation and shall appear before the investigating<\/p>\n<p>officer as and when ordered.\n<\/p>\n<\/p>\n<p>                                        P.Q.
