Justice K.SURENDRA MOHAN\n\n Dated :23\/09\/2009\n\n O R D E R\n                     PIUS C.KURIAKOSE &amp;\n                   K.SURENDRA MOHAN, JJ.\n             -------------------------------------------\n                L.A.Appeal No.1145 of 2007\n             -------------------------------------------\n       Dated this the 23rd day of September, 2009\n\n                           JUDGMENT\n<\/pre>\n<p>Pius C.Kuriakose,J.\n<\/p>\n<\/p>\n<p>       The lands under acquisition in this case were included in<\/p>\n<p>category-D by the Land Acquisition Officer.<\/p>\n<p>2. We set aside the judgment and decree under appeal and<\/p>\n<p>remand the LAR to the reference court for deciding whether the<\/p>\n<p>lands were enjoying frontage of any road.           If the enquiry<\/p>\n<p>reveals that the property was enjoying road frontage, the<\/p>\n<p>learned subordinate judge will include the property in<\/p>\n<p>category-c and award land value of Rs.26,730\/-. If the enquiry<\/p>\n<p>reveals that the property was not enjoying road frontage, the<\/p>\n<p>land will be retained in category-D and the reference court will<\/p>\n<p>award land value at the rate of Rs.21,384\/-, in the light of the<\/p>\n<p>findings entered by this Court in connected matters.
