{"id":66926,"date":"2010-07-27T00:00:00","date_gmt":"2010-07-26T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/rajaswa-bar-assocaition-vs-bar-council-of-uttar-pradesh-on-27-july-2010"},"modified":"2016-06-03T22:36:26","modified_gmt":"2016-06-03T17:06:26","slug":"rajaswa-bar-assocaition-vs-bar-council-of-uttar-pradesh-on-27-july-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/rajaswa-bar-assocaition-vs-bar-council-of-uttar-pradesh-on-27-july-2010","title":{"rendered":"Rajaswa Bar Assocaition &#8230; vs Bar Council Of Uttar Pradesh , &#8230; on 27 July, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Rajaswa Bar Assocaition &#8230; vs Bar Council Of Uttar Pradesh , &#8230; on 27 July, 2010<\/div>\n<pre>                                       1\n\n                                                                  Court No. 1\n\nWrit Petition No. 6648 (MB) of 2010\nRajaswa Bar Association\nVs.\nBar Council of Uttar Pradesh and others.\n\n\nHon'ble Pradeep Kant, J.\n<\/pre>\n<p>Hon&#8217;ble Ritu Raj Awasthi, J.\n<\/p>\n<p>        Respondents are represented by their learned counsel.<br \/>\n        With the consent of both the parties&#8217; counsel, we dispose of the writ<br \/>\npetition finally.\n<\/p>\n<p>        In nutshell, it is a dispute regarding the elections of Rajaswa Bar<br \/>\nAssociation, Lucknow.\n<\/p>\n<p>        The main grievance of the petitioners is that the Bar Council is<br \/>\ninterfering with the election process, as firstly, it stayed the elections<br \/>\nschedule, which was fixed in November, 2009 and thereafter, without giving<br \/>\nany notice, the elections said to have been conducted by the petitioners were<br \/>\ndeclared invalid.\n<\/p>\n<p>        Consequently, Bar Council directed for holding the elections out of<br \/>\nthe voter list, which has been subsequently prepared, overruling the voter<br \/>\nlist, which was used in 2009 elections.\n<\/p>\n<p>        Lengthy arguments have been raised from both the sides but the<br \/>\naction of the Bar Council in interfering with the elections or issuing the<br \/>\ndirections for holding elections in a particular manner, out of the voter list<br \/>\nwhich, according to the Bar Council, appears to the correct, could not be<br \/>\njustified nor any provision under the Model Bye-Laws framed by the Bar<br \/>\nCouncil, U.P. or the Advocates Act or the Bar Council Act could be pointed<br \/>\nout, under which Bar Council could have interfered with the elections of a<br \/>\nBar Association (Rajaswa Bar Association).\n<\/p>\n<p>        At this juncture, parties have arrived to a consensus saying that as<br \/>\nprovided under the Bye-laws, Elders Committee be constituted by this<br \/>\nCourt, who be authorised to get the elections conducted within the time<br \/>\nprescribed. The Elders Committee, so constituted, be directed to the<br \/>\nelections after determining the voter list in accordance with rules.\n<\/p>\n<p>        We, therefore, with the consent of the parties&#8217; counsel, appoint the<br \/>\nfollowing five persons, namely, advocates, who will form the Elders<br \/>\nCommittee.\n<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>       1. Sri Sushil Chandra Shukla\n<\/p>\n<p>       2. Sri Badri Pal Srivastava\n<\/p>\n<p>       3. Sri Pal Singh\n<\/p>\n<p>       4. Sri Raj Kumar Shukla\n<\/p>\n<p>       5. Sri Aditya Prakash Misra<br \/>\n       Learned counsel for the petitioners Sri G.C. Verma and Sri Rajiv<br \/>\nSrivastava for respondents no. 1 and 3 say that Sri Sushil Chandra Shukla<br \/>\nbe appointed as Chairman.\n<\/p>\n<p>       We direct accordingly. Sri Sushil Chandra Shukla, Advocate is<br \/>\nappointed as Chairman of the Elders Committee.\n<\/p>\n<p>       The Elders Committee shall immediately take over the charge of the<br \/>\nRajaswa Bar Association. The Elders Committee shall verify and scrutinize<br \/>\nthe voter list, after giving opportunity to the parties concerned.\n<\/p>\n<p>       While determining the voter list, the Elders Committee shall ensure<br \/>\nthat no member is enrolled in violation of Rule 6(b) of the Model Bye-<br \/>\nLaws, which says that an advocate shall be entitled to hold the ordinary<br \/>\nmembership\/life membership of only one Association i.e. the Association of<br \/>\nthe court, wherein he is actively and regularly practising and necessary<br \/>\ndeclaration in this regard may be obtained.\n<\/p>\n<p>       This shall be done within a maximum period of one week from the<br \/>\ndate of assumption of charge by the Elders Committee.
