for possession and damages. The suit was decreed<\/p>\n

and the appellant was directed to vacate and deliver<\/p>\n
vacant possession to the respondent–plaintiff  in<\/p>\n
respect of mesne profits, the trial court <\/p>\n
enquiry to be held as per Order 20 Rule7i___2  <\/p>\n

defendant, con\ufb01rmed the giudgrnent of  <\/p>\n
and the appeal was  ‘The

convinced of the exact amount of rent that was due<\/p>\n

also produced by the plaintiff to show that<\/p>\n

4. On the other  learried
\nLakshminarayana Rao forll’ _Vgrespenidentfrblaintiff
\nsupported the View   ‘below and
\nsubmitted that V there– regard to
\nlandlord _   if both courts have
\nconcurredlf apart from the admission
\nmade  *   in the course of their<\/p>\n
evidence. As “such,p:’the suit was rightly decreed and<\/p>\n
\u00bb iasfar as arrears of rent is concerned, submission<\/p>\n
if  appellant was in arrears of rent for a<\/p>\n
long.  and this fact has been brought on record<\/p>\n
2 through the evidence of PW–1 and notice was also<\/p>\n
‘issued to the appellant as required under law. As<\/p>\n
such, the judgments of the courts below call for no<\/p>\n
9\/<\/p>\n
interference. However, learned counsel also<\/p>\n
submitted that, in the alternative, the respondent-<\/p>\n
piaintiff be given liberty to work out his  V.<\/p>\n
respect of the actual damages to which  be<\/p>\n
entitled. However, the appeilarit  <\/p>\n
the rent as was being paidcby th4e–.appellant’;,   1<\/p>\n

\nmade by the learned”couns_ei\u00bbl:lbrV–‘theV:parties and the
\ncourts  “facts concerning<\/p>\n
the land;lo’rri\u00ab._  V_r’e_iat:ion’ship and the trial<\/p>\n
cou1″:t__ having-\ufb02rnadlep”an’~observation at para.19 of its
\njudgment to the” the appellant did not<\/p>\n
 his tenancy under the respondentwplaintiff and<\/p>\n
\u00bb lwas ~ as rent, this court in second<\/p>\n
‘–a.p-peal’, th.ei:efore cannot interfere with the concurrent<\/p>\n
\ufb01ndings of facts, moreover the said findings are based<\/p>\n
2 ~ on\u00ab–..the admission made by the appellant himself. It is<\/p>\n
also not in dispute that the respondent–plaintiff<\/p>\n

stepped into the shoes of his father and was<\/p>\n
collecting the rent.\n<\/p>\n
