C.\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p>The Committee of Management of Model Inter College<br \/>\nGhungharwali, District Bulandshahr though its Manager and four<br \/>\nother members of the Committee of Management have filed this<br \/>\npetition for setting aside the order dated 5th April, 2010 passed by<br \/>\nthe District Inspector of Schools by which he has approved the &#8216;No<br \/>\nConfidence Motion&#8217; passed against the Manager of the Committee<br \/>\nof Management of the Institution and has, accordingly, passed an<br \/>\norder for single operation of the salary account of the Institution.\n<\/p>\n<p>It is submitted by Sri R.K. Ojha, learned counsel for the petitioners<br \/>\nthat there were 10 undisputed members of the Committee of<br \/>\nManagement of the Institution, out of which three members had<br \/>\ndied and only 7 member remain. It is his submission that out of<br \/>\nthese 7 members, five members have approached this Court for<br \/>\nsetting aside the order passed by the District Inspector of Schools.<br \/>\nIt is also his submission that the District Inspector of Schools<br \/>\npassed the impugned order without giving any opportunity<br \/>\nwhatsoever to the Manager of the Institution. He, therefore,<br \/>\nsubmits that liberty may be given to the petitioners to file a<br \/>\nrepresentation before the District Inspector of Schools who may<br \/>\nexamine the same and pass an appropriate order.\n<\/p>\n<p>Learned Standing Counsel appears for the respondent Nos. 1, 2<br \/>\nand 3. In view of the order that I propose to pass it is not necessary<br \/>\nto issue notice to respondent No.4.\n<\/p>\n<p>Since it is claimed by the petitioners that opportunity was not<br \/>\ngiven to them before the impugned order was passed by the<br \/>\nDistrict Inspector of Schools and nor is it clear from the impugned<br \/>\norder that any opportunity was given, the petitioners may file a<br \/>\nrepresentation before the District Inspector of Schools within two<br \/>\nweeks from today along with a certified copy of this order and in<br \/>\ncase such a representation is filed, the District Inspector of Schools<br \/>\nshall examine the same and pass an appropriate order after hearing<br \/>\nthe parties concerned including respondent No.4 expeditiously,<br \/>\n preferably within a period of six weeks from the date of filing of<br \/>\nthe representation.
