PUBLIC PROSECUTOR for Opponent(s) :\n3, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 21\/02\/2011\n \n\nORAL\nORDER<\/pre>\n<p>The appellant-Food Inspector<br \/>\n\tthrough Ahmedabad Municipal Corporation has preferred the present<br \/>\n\tappeal under Section 378 of the Code of Criminal Procedure, 1973<br \/>\n\tagainst the Judgment and Order of acquittal dated 26th<br \/>\n\tFebruary 2009 passed by the learned Metropolitan Magistrate, Court<br \/>\n\tNo.6, Ahmedabad, in Criminal Case No.11971 of 2006 for the offences<br \/>\n\tpunishable under Section 16 of the Prevention of Food Adulteration<br \/>\n\tAct, 1954, whereby the learned Magistrate has acquitted the<br \/>\n\trespondent Nos.1 and 2-original accused of the charges levelled<br \/>\n\tagainst them by giving benefit of doubt.\n<\/p>\n<p>The short facts of the prosecution<br \/>\n\tcase is that on 05th June 2006 the complainant-Food<br \/>\n\tInspector along with his Peon has visited Ashray Restaurant, 1, City<br \/>\n\tMall, Nr. Rajpath Club, S.G. Highway, Ahmedabad. It is the case of<br \/>\n\tthe complainant that at that time the Manager of the<br \/>\n\tRestaurant-original accused was present. It is the case of the<br \/>\n\tcomplainant that after giving his identity as Food Inspector, the<br \/>\n\tcomplainant purchased 06 plates of Harabhara-Kabad i.e.<br \/>\n\tapproximately 900 gms. in presence of panch witness as sample and<br \/>\n\talso paid consideration for the same. On asking about the ownership<br \/>\n\tof the shop, the respondent No.1 informed that the respondent No.2<br \/>\n\therein-original accused Shri Rajendrabhai Nathabhai Patel is the<br \/>\n\towner of the said restaurant. It is also the case of the complainant<br \/>\n\tthat after following due procedure of sealing, the sample was sent<br \/>\n\tfor analysis. On examination, the Public Analyst found that the said<br \/>\n\tsample was adulterated. Therefore, after following the due<br \/>\n\tprocedure, complaint was filed against the respondent Nos.1 and<br \/>\n\t2-accused in the Court of learned Metropolitan Magistrate, Court<br \/>\n\tNo.6, Ahmedabad for the offences punishable under Section 16 of the<br \/>\n\tPrevention of Food Adulteration Act, 1954.\n<\/p>\n<p>Thereafter, upon service of<br \/>\n\tsummons, the respondent Nos.1 and 2-accused appeared before the<br \/>\n\tCourt and as the accused not pleaded guilty, the trial commenced.<br \/>\n\tThereafter the trial was conducted before the learned Magistrate. To<br \/>\n\tprove the case of the prosecution, prosecution has produced oral as<br \/>\n\twell as documentary evidence. Thereafter, further statements of<br \/>\n\trespondent Nos.1 and 2-accused were recorded under Section 313 of<br \/>\n\tthe Code of Criminal Procedure wherein the accused have denied the<br \/>\n\tcase filed against them.\n<\/p>\n<p>Thereafter, after considering the<br \/>\n\toral as well as documentary evidence, the learned Magistrate has<br \/>\n\tacquitted the respondent Nos.1 and 2-original accused from the<br \/>\n\tcharges alleged against tie by his Judgment and Order of acquittal<br \/>\n\tdated 26th February 2009.\n<\/p>\n<p>Being<br \/>\n\taggrieved and dissatisfied with the said Judgment and Order of<br \/>\n\tacquittal dated 26th<br \/>\n\tFebruary 2009 passed by the learned Metropolitan Magistrate, Court<br \/>\n\tNo.6, Ahmedabad, in Criminal Case No.11971 of 2006, the<br \/>\n\tcomplainant-Food Inspector has preferred the above mentioned<br \/>\n\tCriminal Appeal.\n<\/p>\n<p>Heard Ms.Jirga Jhaveri, learned<br \/>\n\tcounsel for the appellant and Mr.H.L. Jani, learned Additional<br \/>\n\tPublic Prosecutor, appearing on behalf of the respondent No.3-State.\n<\/p>\n<p>Ms.Jhaveri, learned counsel for<br \/>\n\tthe appellant, has contended that the Judgment and Order of<br \/>\n\tacquittal passed by the learned Magistrate is not proper, legal and<br \/>\n\tit is erroneous. She has also argued that the learned Magistrate has<br \/>\n\tnot considered the evidence of the witnesses. She has argued that<br \/>\n\tthe learned Magistrate has not considered the fact that the Food<br \/>\n\tInspector has followed the proper procedure while collecting the<br \/>\n\tsample, etc. are just and proper. The sample was seized and sealed<br \/>\n\tproperly. Yet, the learned Magistrate has not considered the<br \/>\n\tevidence of prosecution. He, therefore, contended that the order of<br \/>\n\tacquittal passed by the learned Magistrate is without appreciating<br \/>\n\tthe facts and evidence on record and is required to be quashed and<br \/>\n\tset aside by this Hon&#8217;ble Court.\n<\/p>\n<p>It is a settled legal position<br \/>\n\tthat in acquittal appeal, the Appellate Court is not required to<br \/>\n\tre-write the judgment or to give fresh reasonings when the Appellate<br \/>\n\tCourt is in agreement with the reasons assigned by the trial Court<br \/>\n\tacquitting the accused. In the instant case, this Court is in full<br \/>\n\tagreement with the reasons given and findings recorded by the trial<br \/>\n\tCourt while acquitting the respondents-accused and adopting the said<br \/>\n\treasons and for the reasons aforesaid, in my view, the impugned<br \/>\n\tjudgment is just, legal and proper and requires no interference by<br \/>\n\tthis Court. Hence, this appeal requires to be dismissed.\n<\/p>\n<p>Even<br \/>\n\tin a recent decision of the Apex Court in the case of State<br \/>\n\tof Goa Vs. Sanjay Thakran &amp; Anr. Reported in (2007)3 SCC 75,<br \/>\n\tthe Court has reiterated the powers of the High Court in such cases.\n<\/p>\n<p>Similar<br \/>\n\tprinciple has been laid down by the Apex Court in the cases of State<br \/>\n\tof Uttar Pradesh Vs. Ram Veer Singh &amp; Ors, reported in 2007 AIR<br \/>\n\tSCW 5553<br \/>\n\tand in Girja<br \/>\n\tPrasad (Dead) by LRs Vs. state of MP, reported in 2007 AIR SCW 5589.<br \/>\n\tThus, the powers which this Court may exercise against an order of<br \/>\n\tacquittal are well settled.\n<\/p>\n<p>It<br \/>\n\tis also a settled legal position that in acquittal appeal, the<br \/>\n\tappellate court is not required to re-write the judgment or to give<br \/>\n\tfresh reasoning, when the reasons assigned by the Court below are<br \/>\n\tfound to be just and proper. Such principle is laid down by the Apex<br \/>\n\tCourt in the case of State<br \/>\n\tof Karnataka Vs. Hemareddy, reported in AIR 1981 SC 1417.\n<\/p>\n<p>Thus,<br \/>\n\tin case the Appellate Court agrees with the reasons and the opinion<br \/>\n\tgiven by the lower court, then the discussion of evidence is not<br \/>\n\tnecessary.\n<\/p>\n<p>I<br \/>\n\thave<br \/>\n\tgone through the order of acquittal passed by the learned<br \/>\n\tMagistrate. I have also perused the oral as well as documentary<br \/>\n\tevidence led before the trial Court and also considered the<br \/>\n\tsubmissions made by learned advocates for the parties.\n<\/p>\n<p>The<br \/>\n\ttrial Court has, after appreciating the oral as well as documentary<br \/>\n\tevidence, observed that prosecution has failed to follow the<br \/>\n\tmandatory provision of Rule 4(3)(iv) of the Rules. It is also<br \/>\n\tobserved by the learned trial Judge that while collecting the<br \/>\n\tsample, the complainant has not drawn the panchnama. Even the<br \/>\n\tprosecution has not examined the panch witness. It is also observed<br \/>\n\tby the learned Magistrate that without appreciating these facts,<br \/>\n\tmechanically, the Sanctioning Authority has given sanction to file<br \/>\n\tcomplaint.  Even there are contradiction in the oral evidence of the<br \/>\n\tcomplainant. Thus, prosecution has failed to prove its case beyond<br \/>\n\treasonable doubt against the respondent Nos.1<br \/>\n\tand 2-original accused. The trial Court has observed that there are<br \/>\n\tserious lacuna in the oral as well as documentary evidence of<br \/>\n\tprosecution. Nothing is produced on record of this appeal to rebut<br \/>\n\tthe concrete findings of the trial Court. Prosecution has failed to<br \/>\n\tprove the case beyond reasonable doubt against the respondent Nos.1<br \/>\n\tand 2-original accused.\n<\/p>\n<p>Thus,<br \/>\n\tthe appellant could not bring home the charges against the<br \/>\n\trespondent Nos.1 and 2-original accused in the present appeal. The<br \/>\n\tprosecution has miserably failed to prove the case against the<br \/>\n\trespondent Nos.1 and 2-original accused beyond reasonable doubt.<br \/>\n\tThus, from the evidence itself it is established that the<br \/>\n\tprosecution has not proved its case beyond reasonable doubt.\n<\/p>\n<p>Ms.Jhaveri, learned counsel for<br \/>\n\tthe appellant, is not in a position to show any evidence to take a<br \/>\n\tcontrary view in the matter or that the approach of the trial Court<br \/>\n\tis vitiated by some manifest illegality or that the decision is<br \/>\n\tperverse or that the trial Court has ignored the material evidence<br \/>\n\ton record.\n<\/p>\n<p>In above view of the matter, I am<br \/>\n\tof the considered opinion that the trial Court was completely<br \/>\n\tjustified in acquitting the respondent Nos.1 and 2-original accused<br \/>\n\tof the charges levelled against them by giving benefit of doubt.\n<\/p>\n<p>I<br \/>\n\tfind that the findings recorded by the trial Court are absolutely<br \/>\n\tjust and proper and in recording the said findings,<br \/>\n\tno illegality or infirmity has been committed by it.\n<\/p>\n<p>I<br \/>\n\tam, therefore, in complete agreement with the findings, ultimate<br \/>\n\tconclusion and the resultant order of acquittal recorded by the<br \/>\n\ttrial Court and hence find no reasons to interfere with the same.<br \/>\n\tHence the appeal is hereby dismissed.\n<\/p>\n<p>\tThe Judgment and Order of acquittal dated 26th<br \/>\n\tFebruary 2009 passed by the learned Metropolitan Magistrate, Court<br \/>\n\tNo.6, Ahmedabad, in Criminal Case No.11971 of 2006 is hereby<br \/>\n\tconfirmed. Bail bond, if any, shall stands discharged. Record and<br \/>\n\tProceedings, if any, be sent back to the trial Court concerned,<br \/>\n\tforthwith.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
