Justice K.SURENDRA MOHAN\n\n Dated :25\/01\/2010\n\n O R D E R\n               K.SURENDRA MOHAN, J.\n            -------------------------------------------\n                W.P.(C) No.232 of 2010\n            -------------------------------------------\n        Dated this the 25th day of January, 2010\n\n                         JUDGMENT\n<\/pre>\n<p>     The petitioner is the second respondent in O.P.<\/p>\n<p>(MV) No.1272\/2003 of the Motor Accidents Claims<\/p>\n<p>Tribunal, North Parur.             The petitioner was the<\/p>\n<p>registered  owner of a              motor vehicle       bearing<\/p>\n<p>Reg.No.KL-8\/A 1538 which was sold by him in the<\/p>\n<p>year 1995. However, the petitioner even to this date<\/p>\n<p>continues to be the registered owner of the vehicle<\/p>\n<p>because change in the name of registration was not<\/p>\n<p>effected by the authorities.\n<\/p>\n<p>     2. The claim petition was filed for compensation<\/p>\n<p>for the death of late Mini whose legal representatives<\/p>\n<p>are the claimants. The petitioner did not contest the<\/p>\n<p>claim because he was under the impression that he<\/p>\n<p>would have no liability since he had already sold the<\/p>\n<p>vehicle. By Ext.P2, compensation has been awarded<\/p>\n<p>by the Tribunal, which is sought to be recovered from<\/p>\n<p>the petitioner by Ext.P4 Execution Petition.<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.232\/2010      2<\/span><\/p>\n<p>          3. The complaint of the petitioner is that though<\/p>\n<p>    he has submitted Exts.P5 and P6, application for<\/p>\n<p>    setting aside the ex-parte award and for condonation<\/p>\n<p>    of the delay in filing the same, the Tribunal has not<\/p>\n<p>    passed any orders thereon till date. At the same time,<\/p>\n<p>    the Tribunal is proceeding with the execution of the<\/p>\n<p>    award against the petitioner.\n<\/p>\n<p>          4. In view of the fact that Exts.P5 and P6<\/p>\n<p>    applications are pending consideration of the Motor<\/p>\n<p>    Accidents Claims Tribunal, North Parur, there will be<\/p>\n<p>    a direction to the Tribunal to consider and pass final<\/p>\n<p>    orders on the said applications, as expeditiously as<\/p>\n<p>    possible.
