THE SASARAM MUNICIPALITY THROUGH ITS EXECUTIVE\n        OFFICER, SASARAM, ROHTAS\n    ...............................................................................RESPONDENTS\n                                       ***********\n<\/pre>\n<p>3     19\/09\/2011            The petitioners are the shopkeepers who have their<\/p>\n<p>                     shops on the land belonging to the Zila Parishad. The Zila<\/p>\n<p>                     Parishad had constructed a market about ten years back.<\/p>\n<p>                     The land adjacent to the market also belongs to the Zila<\/p>\n<p>                     Parishad. The Zila Parishad is intending to construct a Guest<\/p>\n<p>                     House on the said piece of land. The map etc. of the Guest<\/p>\n<p>                     House has been approved by the Municipal corporation.<\/p>\n<p>                              Being aggrieved by the fact that the Zila Parishad<\/p>\n<p>                     has not provided any civil amenities, such as facility of<\/p>\n<p>                     drinking water, bathrooms, parking space for scooters and<\/p>\n<p>                     cars and space for generator, the petitioners have moved this<\/p>\n<p>                     Court.\n<\/p>\n<p>                              At paragraph 2 of the counter affidavit filed on<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>        behalf of the Zila Parishad, it has been specifically stated<\/p>\n<p>        that there is no violation of Section 316 of the Bihar<\/p>\n<p>        Municipal Act, 2007, rather the urinal and the deep boring<\/p>\n<p>        hand pump for water and vehicle parking are situated in the<\/p>\n<p>        market complex.\n<\/p>\n<p>                  This Court doubts this statement, although it is<\/p>\n<p>        submitted that the urinal and water facilities (hand pump)<\/p>\n<p>        have been provided in the market complex, the other two<\/p>\n<p>        requirements of having the parking space specially as the<\/p>\n<p>        market is situated in the main road, has not been made by<\/p>\n<p>        the Zila Parishad.\n<\/p>\n<p>                  The Municipal Corporation has approved the map<\/p>\n<p>        and has allowed the Zila Parishad to build the market<\/p>\n<p>        complex without ensuring that there is sufficient space to<\/p>\n<p>        allow parking for at least a few cars.\n<\/p>\n<p>                  Since, Counsel for the Zila Parishad submits that<\/p>\n<p>        the Zila Parishad has undertaking to provide basic civic<\/p>\n<p>        facilities, this Court cannot pass an order injuncting the Zila<\/p>\n<p>        Parishad from constructing a duly approved building for the<\/p>\n<p>        purpose of a Guest House on their own lands.<\/p>\n<p>                  This writ application is disposed of in view of the<\/p>\n<p>        undertaken by the Zila Parishad.\n<\/p>\n<\/p>\n<pre>Anand                                     ( Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rajeev Ranjan Singh &amp; Anr vs The State Of Bihar &amp; Ors on 19 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CIVIL WRIT JURISDICTION CASE NO.12646 OF 2009 1.
