It was also contended that name of<br \/>\nher mother Diwaliben was also mutated in the revenue record and the<br \/>\nsuit property was sold to defendant by power of attorney holder of<br \/>\nher mother but she is in actual possession of the suit property and<br \/>\nthe defendant was never in possession of the same. It was also<br \/>\ncontended that as the defendant gave threats to handover possession,<br \/>\nthe Suit was filed for permanent injunction.\n<\/p>\n<p>3.\t\tIt<br \/>\nappears that the original defendant did not appear in the Suit and<br \/>\nfile written statement and the appellant original plaintiff gave<br \/>\napplication Exh. 26 to join the heirs of the President of the Society<br \/>\non the record of the Suit and thereafter the heirs were brought on<br \/>\nrecord of the case but no written statement was filed.  Thereafter,<br \/>\nthe heirs were deleted and liquidator of the Society was joined as<br \/>\nparty defendant as the Society went into liquidation. The trial Court<br \/>\nafter recording evidence, dismissed the Suit. Therefore, original<br \/>\nplaintiff preferred Regular Civil Appeal No. 47 of 2007 before<br \/>\nlearned Additional District Judge and Presiding Officer, Fast Track<br \/>\nCourt at Anand. The appeal came to be dismissed by  judgement dated<br \/>\n18.2.2010. Being aggrieved by the said decision, the<br \/>\nappellant-original plaintiff has preferred this Second Appeal on the<br \/>\nsubstantial questions of law as indicated in the memo of appeal.\n<\/p>\n<p>4.\t\tI<br \/>\nhave heard learned advocate Mr. Majmudar for the appellant.\n<\/p>\n<p>5.\t\tIt<br \/>\nalso appears that the suit property was sold to the original<br \/>\ndefendant in the year 1970 and registered document in that regard was<br \/>\nproduced at Exh. 83. Therefore, the original defendant had become the<br \/>\nowner and occupier of the suit property and the appellant-original<br \/>\nplaintiff had no right, title or interest in the suit property but<br \/>\nshe committed trespass over the suit property. The documentary<br \/>\nevidence produced in the trial Court also indicates that with express<br \/>\nconsent of the original plaintiff entry in the record of right was<br \/>\nmade and name of the Society was mutated. Therefore, plaintiff was a<br \/>\ntrespasser and was not entitled for the reliefs claimed in the Suit<br \/>\nand the Courts below were justified in passing the impugned<br \/>\njudgements.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above, both the Courts below were justified in passing<br \/>\nthe impugned judgement. Substantial questions of law as formulated do<br \/>\nnot arise for consideration by this Court and hence the Second Appeal<br \/>\nis required to be dismissed and accordingly it is dismissed with no<br \/>\norder as to costs.\n<\/p>\n<p>\t\tAs<br \/>\nSecond Appeal is dismissed, the Civil Application stands disposed of<br \/>\naccordingly.\n<\/p>\n<p> (BANKIM N.
