SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioners have prayed for an appropriate writ, direction and<br \/>\norder directing the respondent to finalize the Town Planning Scheme<br \/>\nNo.103, Nikol and grant the peaceful and vacant possession of the<br \/>\nFinal Plot No.70 to the petitioners by removing encroachers from the<br \/>\npetitioners land.\n<\/p>\n<p>2.\tAt<br \/>\nthe outset, it is required to be noted that as such the Town Planning<br \/>\nScheme No.103 (Nikol) is reported to be at Draft Town Planning Scheme<br \/>\nand therefore no direction can be issued upon the respondents to<br \/>\nhandover the peaceful and vacant possession of the Final Plot No.70<br \/>\nto the petitioners. After sanctioning the Draft Town Planning Scheme<br \/>\nwhich is already now sanctioned, the Preliminary Town Planning Scheme<br \/>\nis to be prepared by the TPO and thereafter the same is to be<br \/>\nsanctioned by the State Government under Section 65 of the Gujarat<br \/>\nTown Planning Act. In view of the above, Shri Vyas, learned advocate<br \/>\nfor the petitioners does not press the present petition at this stage<br \/>\nwith a liberty to file fresh petition after the Preliminary Town<br \/>\nPlanning Scheme sanctioned by the State Government. Permission is<br \/>\naccordingly granted.
