DABHI, APP for the\nRespondent \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/11\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>1.\t\tBy<br \/>\nfiling the instant application under Section 12 of the Contempt of<br \/>\nCourts Act, 1971, the petitioner has prayed to initiate contempt<br \/>\nproceedings against the respondent for willful disobedience of the<br \/>\norder dated 24.9.2010 rendered in Criminal Miscellaneous Application<br \/>\nNo. 9832 of 2010 in Special Criminal Application No. 1850 of 2009<br \/>\nwith Criminal Miscellaneous Application No. 10621 of 2010 by which<br \/>\nthe Court directed to constitute Special Investigation Team to<br \/>\ninvestigate the offence registered as I-C.R. No.  8 of 2004 dated<br \/>\n15.6.2004 with DCB Police Station, Ahmedabad City.\n<\/p>\n<p>2.\t\tAt<br \/>\nthe time hearing of this application, Mr. Kamal Trivedi, learned<br \/>\nAdvocate General with Mr. L.B. Dabhi, learned APP for the respondent<br \/>\nappeared and has tendered reply affidavit along with annexure &#8211;<br \/>\nNotification dated 16.11.2010 issued by the Home Department,<br \/>\nGovernment of Gujarat by which Special Investigation Team has been<br \/>\nconstituted as per the directions contained under order dated<br \/>\n24.9.2010.  According to him, there is no willful disobedience of the<br \/>\norder passed by this Court. He, therefore, urges to pass appropriate<br \/>\norder disposing of this application.\n<\/p>\n<p>3.\t\tSince<br \/>\nthe order for which this contempt application has been filed has been<br \/>\nfully complied with by the respondent, Mr. Mukul Sinha, learned<br \/>\nadvocate appearing for Mr. Amresh Patel, learned advocate for the<br \/>\napplicant does not want to press this application and seeks leave to<br \/>\nwithdraw the same.\n<\/p>\n<p>4.\t\tMr.\n<\/p>\n<p>Kamal Trivedi, learned Advocate General has no objection if leave  as<br \/>\nprayed for is granted.\n<\/p>\n<p>5.\t\tHence<br \/>\nleave to withdraw this application  is granted.   This application<br \/>\nstands disposed of as withdrawn.\n<\/p>\n<p>6.\t\tAffidavit<br \/>\nin reply filed on behalf of respondent No. 1 which is sworn by by<br \/>\nD.R.
