Justice ANTONY DOMINIC\n\n Dated :30\/09\/2008\n\n O R D E R\n                      ANTONY DOMINIC, J.\n\n           --------------------------------------------------------\n\n                     W.P.(C) 30825 of 2007\n\n           --------------------------------------------------------\n\n                Dated: SEPTEMBER 30, 2008\n\n                              JUDGMENT\n<\/pre>\n<p>     Petitioner is a teacher working under the 4th<\/p>\n<p>respondent on appointment by the 3rd respondent Manager.<\/p>\n<p>He was involved in a criminal case for an offence under<\/p>\n<p>sec.139 of the Negotiable Instruments Act.                          He got<\/p>\n<p>arrested by the police and was remanded to judicial custody<\/p>\n<p>on 13.9.2004. It would appear that subsequently he was<\/p>\n<p>enlarged on bail and thereafter Ext.P3 order was passed by<\/p>\n<p>the 2nd respondent reinstating him in service.                        The<\/p>\n<p>complaint in this writ petition is mainly that the Manager is<\/p>\n<p>not implementing Ext.P3.\n<\/p>\n<p>     2.   The Manager has now entered appearance and<\/p>\n<p>submits that against Ext.P3 he has filed a revision before<\/p>\n<p>the Government.             It is stated by both sides that the<\/p>\n<p>revision was heard by the Government on 26.3.2008 and<\/p>\n<p>orders are awaited.         It is because of the pendency of the<\/p>\n<p>WP(C) 30825\/07<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>revision and orders that are awaited, the Manager has not<\/p>\n<p>implemented Ext.P3.\n<\/p>\n<p>     3.   In view of this I feel that at this stage what is<\/p>\n<p>appropriate is that the revisional authority should dispose of<\/p>\n<p>the revision.   Since the Government is not a party to the<\/p>\n<p>writ petition, this Court is disabled from passing any<\/p>\n<p>positive direction binding on the Government as well.
