Special Civil Application No. 6001 of 2003\n          MR SV PARMAR for Petitioner No. 1\n          MS PREETI S PARMAR for Petitioner No. 1\n          .......... for Respondent No. 1-2\n\n\n     --------------------------------------------------------------\n\n\n              CORAM : MR.JUSTICE JAYANT PATEL\n\n\n              Date of Order: 03\/05\/2003\n\n\nORAL ORDER<\/pre>\n<p>     1.The   present   petition   is preferred by the<br \/>\n     petitioner for an appropriate writ of a prohibitory in<br \/>\n     nature to desist the respondents to hold meeting on<br \/>\n     5.5.2003 for considering the motion of no confidence<br \/>\n     against the petitioner and the petitioner has also prayed<br \/>\n     for quashing of the notice Annexure `B&#8217; and the letter<br \/>\n     Annexure `C&#8217;.\n<\/p>\n<p>     2.Heard Mr.S.V.Parmar, learned advocate for the<br \/>\n     petitioner.   The contention raised on behalf of the<br \/>\n     petitioner is that no reasons are mentioned and there is<br \/>\n     absolutely no material together with the proposal for<br \/>\n     motion of no confidence. Mr.Parmar also submitted that<br \/>\n     the copy of motion should bear the original signatures of<br \/>\n     the members concerned whereas the petitioner is supplied<br \/>\n     only xerox and, therefore, the requirement of the law is<br \/>\n     not satisfied. Mr.Parmar also submitted that, as per the<br \/>\n     rules, the power to issue agenda and hold the meeting is<br \/>\n     with the Secretary of the Gram Panchayat and Sarpanch<br \/>\n     could not have issued the agenda for holding of the<br \/>\n     meeting.\n<\/p>\n<p>     3.Having considered the above, I am of the view<br \/>\n     that, in the matter of motion of no confidence, the<br \/>\n     confidence is of the paramount consideration and the<br \/>\n other aspects regarding procedure are in my view the<br \/>\nmethod developed for the purpose of considering the same<br \/>\nand   even   if   there   is some irregularity in the<br \/>\nproceedings, the motion would not lapse unless it is not<br \/>\nmoved by requisite number of members of Gram Panchayat.<br \/>\nApart from the above the contention raised by Mr.Parmar,<br \/>\nI do not find any substance in the contention raised by<br \/>\nMr.Parmar that the material is required to be produced<br \/>\ntogether with the motion.      There is no such expressed<br \/>\nrequirement under the law.     As regards the original<br \/>\nsignature of the members, the said contention is also<br \/>\nill-founded because the original      motion   would   be<br \/>\nsubmitted to the Sarpanch and the xerox which is produced<br \/>\ngoes to show that it&#8217;s original contains the original<br \/>\nsignatures of the members concerned.       There is    no<br \/>\nexpressed requirement under the law that the original<br \/>\nmotion contending signature of the members of the Gram<br \/>\nPanchayat must be presented and produced before the<br \/>\nUp-Sarpanch against whom the motion is proposed to be<br \/>\nconsidered.\n<\/p>\n<p>4.The contention regarding power of the Secretary<br \/>\nto   issue agenda is ex-facie without any substance<br \/>\ninasmuch as Section 56 sub-sec.(5) clause (b) provides<br \/>\nthat if the Sarpanch fails to call for such meeting, the<br \/>\nSecretary of the Panchayat has to make the report. Hence<br \/>\nafresh when the statute provides express power to the<br \/>\nSarpanch to call the meeting, the provision of the rule<br \/>\ncannot have over riding effect.\n<\/p>\n<p>5.Mr.Parmar also made an attempt to contend that<br \/>\nthe action of moving no confidence motion is with<br \/>\nmalafide purpose since the petitioner wants to examine<br \/>\ncertain   documents   in   which   the   petitioner   has<br \/>\napprehension that some illegalities are committed. As<br \/>\nsuch, the said ground also cannot be accepted, because as<br \/>\nobserved earlier, in a matter of motion of no confidence,<br \/>\nthe confidence of the members of the Gram Panchayat<br \/>\nthrough whom the Up-Sarpanch is elected would be of a<br \/>\nparamount consideration. It may be that the petitioner<br \/>\nmay be feeling that he has worked in a very good manner<br \/>\nand there is no cause for moving the motion against him<br \/>\nbut the judicial scrutiny of such individual grievances<br \/>\nare not to be considered while testing the legality and<br \/>\nvalidity of the motion of no confidence. As observed<br \/>\nearlier, the requirement is the confidence upon the<br \/>\noffice bearer and once the confidence is lost, the<br \/>\nmembers are justified to move the        motion   of   no<br \/>\nconfidence.\n<\/p>\n<p>6.Mr.Parmar also made an attempt to submit it is   a<br \/>\n question   of   removal   somebody of the office and,<br \/>\ntherefore, strict compliance is required.     As observed<br \/>\nearlier, there is no express mandatory provision which is<br \/>\nnot complied with for the purpose of considering the<br \/>\nmotion of no confidence. Moreover, as per the law laid<br \/>\ndown by this Court in the case of Narmadaben V.Parmar Vs.<br \/>\nTaluka Development Officer, Kheralu reported in 1998(1)<br \/>\nGLR 225 the electorates through whom the office bearer is<br \/>\nelected, have inherent right to recall their own office<br \/>\nbearer.
