Justice P.N.RAVINDRAN\n\n Dated :21\/07\/2008\n\n O R D E R\n                                                       CR\n\n                   J.B.Koshy &amp; P.N.Ravindran, JJ.\n                  =====================\n                         W.A.No.1796 of 2007\n                  =====================\n\n                Dated this the 21st day of July, 2008.\n\n                               JUDGMENT\n<\/pre>\n<p>Ravindran,J.\n<\/p>\n<\/p>\n<p>      The University Grants Commission, the first respondent in W.P.<\/p>\n<p>(C) No.6157 of 2005, is the appellant in this Writ Appeal. For the sake<\/p>\n<p>of convenience, the parties are referred to as they are arrayed in the<\/p>\n<p>Writ Petition. The brief facts of the case are as follows:<\/p>\n<p>      2.   By a notification dated 29.7.1999 published in the Kerala<\/p>\n<p>Kaumudi, Mathrubhoomi, Indian Express and the Hindu Dailies, the<\/p>\n<p>Manager, Sree Narayana Colleges invited applications from eligible<\/p>\n<p>candidates for appointment to the post of Lecturer in Computer<\/p>\n<p>Science.    The number of vacancies notified was 5. Though the<\/p>\n<p>notification is not produced by any of the parties, the newspapers in<\/p>\n<p>which the notification was published are available in File No.Acf<\/p>\n<p>III\/1\/006197\/2000 produced by the Kerala University. The notification<\/p>\n<p>states   that   the   qualifications  are   as   per   University Grants<\/p>\n<p>Commission\/University norms. The qualifications in detail, were<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 2 :-<\/span><\/p>\n<p>however not set out. The files disclose that the Academic Council of<\/p>\n<p>the Kerala University had at its meeting held on 19.11.1996 prescribed<\/p>\n<p>the  qualifications   for appointment       of  teachers  in   Computer<\/p>\n<p>Science\/Electronics in the affiliated colleges offering B.Sc. Computer<\/p>\n<p>Science\/Electronics courses. The Kerala University thereupon issued<\/p>\n<p>order No.Acad. A IV\/2\/2812\/95 dated 21.12.1996, the relevant portion<\/p>\n<p>of which reads as follows:\n<\/p>\n<blockquote><p>           &#8220;The Academic Council at its meeting held on<\/p>\n<p>     19.11.96 considered along with the recommendations of<\/p>\n<p>     the Standing Committee and approved the following<\/p>\n<p>     qualifications for appointment of teachers in Computer<\/p>\n<p>     Science\/Electronics courses in affiliated colleges offering<\/p>\n<p>     B.Sc. Computer Science\/Electronics courses.<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>           1. Lecturers in Computer Science<\/p>\n<\/blockquote>\n<blockquote><p>           (a)    First  Class    B.E.\/B.Tech.     in  Computer<\/p>\n<p>     Science\/Computer Engineering.\n<\/p><\/blockquote>\n<blockquote><p>                                    OR<\/p>\n<\/blockquote>\n<blockquote><p>           (b) First Class B.E.\/B.Tech. in Electronics\/ Electrical<\/p>\n<p>     and Electronics Engineering with one year teaching\/R&amp;D<\/p>\n<p>     Experience       in   Computer         Science\/   Computer<\/p>\n<p>     Engineering\/Computer        Application    in   Universities\/<\/p>\n<p>     Colleges\/ Govt.\/ Public Sector Organisations.<\/p><\/blockquote>\n<pre>\n\n                                    OR\n\n           (c)   M.Sc.   (Computer       Science)\/MCA  Computer\n\n     Science with minimum 55% marks.\n\n     NOTE\n\n<span class=\"hidden_text\">WA 1796\/07                          -: 3 :-<\/span>\n\n             (i) Candidates under category (a) &amp; (b) will be\n\n<\/pre>\n<blockquote><p>      governed by AICTE norms &amp; will be eligible for promotion<\/p>\n<p>      only after acquiring Masters degree.<\/p><\/blockquote>\n<p>      (ii) Candidates under category (c) should have passed NET\/SET<\/p>\n<p>in their relevant subject of specialization.\n<\/p>\n<p>      3.    The petitioners, who possess MCA degree, applied for<\/p>\n<p>appointment as Lecturer in Computer Science. They were selected by<\/p>\n<p>the selection committee constituted for the purpose and appointed<\/p>\n<p>along with one Smt.Nimi Thilak as Lecturer in Computer Science in<\/p>\n<p>S.N. College, Cherthala as per Ext.P1 proceedings dated 24.12.1999<\/p>\n<p>issued by the Manager, Sree Narayana Colleges. The proposals to<\/p>\n<p>approve the appointment of the petitioners and Smt. Nimi Thilak were<\/p>\n<p>forwarded to the Kerala University by the Principal, Sree Narayana<\/p>\n<p>College, Cherthala to the Registrar of the Kerala University along with<\/p>\n<p>his letter dated 17.2.2000.     By Ext.P2 order dated 15.1.2002, the<\/p>\n<p>Kerala University, hereinafter referred to as the &#8220;University&#8221; for short,<\/p>\n<p>approved their appointment subject to the condition that they should<\/p>\n<p>pass the National Eligibility Test (NET) within two years as stipulated in<\/p>\n<p>letter dated 15.6.1998 sent by the Joint Secretary, University Grants<\/p>\n<p>Commission, New Delhi to the Commissioner and Secretary to<\/p>\n<p>Government, Higher Education Department, Government of Kerala.<\/p>\n<p>      4. By Ext.P2, the appointment of Smt. Nimi Thilak was approved<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                       -: 4 :-<\/span><\/p>\n<p>with effect from 29.12.1999. The appointment of the petitioners was<\/p>\n<p>approved with effect from 29.12.1999, 31.12.1999 and 30.12.1999<\/p>\n<p>retrospectively. The petitioners and Smt. Nimi Thilak did not pass the<\/p>\n<p>NET within the period of two years stipulated in Ext.P2. They along<\/p>\n<p>with Smt.Nimi Thilak submitted a representation dated 28.1.2002 to<\/p>\n<p>the Vice Chancellor of the University requesting that they may be<\/p>\n<p>exempted from passing the NET.         In the said representation, they<\/p>\n<p>referred to and relied on Ext.P7 order dated 19.8.2000 issued by the<\/p>\n<p>University exempting three Lecturers in Computer Science appointed<\/p>\n<p>on 1.6.1998 in Sree Ayyappa College, Eramallikara from passing the<\/p>\n<p>NET and approving their appointment with effect from 1.6.1998. They<\/p>\n<p>also brought to the notice of the Vice Chancellor of the University that<\/p>\n<p>the Mahatma Gandhi University has by Ext.P8 order dated 14.3.2001<\/p>\n<p>exempted Lecturers in Computer Science appointed during the period<\/p>\n<p>1997-99 from passing the NET. The request of the petitioners and<\/p>\n<p>Smt.Nimi Thilak was forwarded by the Principal, Sree Narayana<\/p>\n<p>College, Cherthala to the Registrar of the University who in turn<\/p>\n<p>forwarded it to the University Grants Commission along with his letter<\/p>\n<p>dated 4.6.2002. The University Grants Commission in Ext.P13 letter<\/p>\n<p>dated 4.9.2002 called for certain clarifications. The Registrar of the<\/p>\n<p>University thereupon sent a letter dated 20.11.2002 furnishing the<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                       -: 5 :-<\/span><\/p>\n<p>details sought in Ext.P13. This was followed by yet another letter<\/p>\n<p>dated 26.7.2003 addressed to the Secretary, University Grants<\/p>\n<p>Commission wherein the University Grants Commission was requested<\/p>\n<p>to consider the request earlier made. A set of documents sent along<\/p>\n<p>with the letter dated 20.11.2002 was once again forwarded.          The<\/p>\n<p>University Grants Commission thereupon sent Ext.P14 letter dated<\/p>\n<p>2.9.2004 to the University stating that the minimum qualification<\/p>\n<p>prescribed by the University for the post of Lecturer in Computer<\/p>\n<p>Science is not as per the regulations of the University Grants<\/p>\n<p>Commission, which stipulated a pass in the NET as one of the<\/p>\n<p>qualifications. It was also stated that the University Grants<\/p>\n<p>Commission Regulations are mandatory and every University is bound<\/p>\n<p>to follow them and that the matter needs clarification.<\/p>\n<p>       5. Aggrieved by the delay in the disposal of their representation<\/p>\n<p>seeking exemption, the petitioners filed W.P.(C) No.7675 of 2004. By<\/p>\n<p>Ext.P15 judgment delivered on 4.3.2004, this Court disposed of the<\/p>\n<p>said Writ Petition, recording the submission made by the Central<\/p>\n<p>Government Standing Counsel appearing on behalf of the University<\/p>\n<p>Grants Commission that a decision will be taken in the matter within<\/p>\n<p>three months from the date of receipt of a copy of the judgment. The<\/p>\n<p>University Grants Commission thereafter sent Ext.P16 letter (wrongly<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                         -: 6 :-<\/span><\/p>\n<p>addressed to the Registrar, University of Calicut) stating that at its<\/p>\n<p>meeting held on 24.12.2004 exemption has been granted to the<\/p>\n<p>petitioners and Smt.Nimi Thilak from passing the NET, subject to the<\/p>\n<p>condition that they should clear the NET in the relevant subject within<\/p>\n<p>two years from the date of the communication, failing which they will<\/p>\n<p>not be eligible for any exemption thereafter. The petitioners thereupon<\/p>\n<p>filed W.P.(C)No.6157 of 2005 challenging Ext.P16 and seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>            &#8220;(a) issue a writ of certiorari or other appropriate<\/p>\n<p>      writ, order of direction calling for the records leading to<\/p>\n<p>      Ext.P16 and quashing the same to the extent it<\/p>\n<p>      incorporates the condition that the petitioners should be<\/p>\n<p>      acquired NET within two years from the date of<\/p>\n<p>      communication of Ext.P16.\n<\/p><\/blockquote>\n<blockquote><p>            (b) issue a writ of mandamus or other appropriate<\/p>\n<p>      writ, order or direction declaring that in accordance with<\/p>\n<p>      Ext.P12 regulations the petitioners are entitled to be<\/p>\n<p>      exempted from NET without any condition since there<\/p>\n<p>      was no candidates possessing NET at the time of<\/p>\n<p>      appointment of the petitioners as Lecturers in Computer<\/p>\n<p>      Science in S.N. College, Cherthala.\n<\/p><\/blockquote>\n<blockquote><p>            (c) issue a writ of mandamus or other appropriate<\/p>\n<p>      writ, order or direction declaring that Ext.P16 order to the<\/p>\n<p>      extent it incorporates the condition that the petitioners<\/p>\n<p>      should acquire NET within two years from the date of<\/p>\n<p>      communication of the order is ultravires and void.<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 7 :-<\/span><\/p>\n<\/blockquote>\n<blockquote><p>             (d) issue a writ of mandamus or other appropriate<\/p>\n<p>       writ, order or direction directing the 2nd respondent to<\/p>\n<p>       approve the appointment of the petitioners as Lecturer in<\/p>\n<p>       Computer Science treating them as exempted from<\/p>\n<p>       possessing NET ignoring the condition incorporated in<\/p>\n<p>       Ext.P16 that the petitioners should acquire NET within<\/p>\n<p>       two years from the date of communication of Ext.P16<\/p>\n<p>       order.&#8221;<\/p><\/blockquote>\n<p>       6. The petitioners challenged the conditional grant of exemption<\/p>\n<p>on the ground that it is arbitrary and discriminatory. They pointed out<\/p>\n<p>that by Exts.P3 to P6 and Exts.P9 to P11, the University Grants<\/p>\n<p>Commission has exempted Lecturers appointed in various colleges<\/p>\n<p>affiliated to the University of Calicut from passing the NET without<\/p>\n<p>prescribing any time limit, while in the case of the petitioners, the<\/p>\n<p>University Grants Commission has granted exemption, limiting it for a<\/p>\n<p>period of two years from the date of Ext.P16 communication. The<\/p>\n<p>petitioners also relied on Ext.P7 order dated 19.8.2000 issued by the<\/p>\n<p>University according approval for the appointment of three Lecturers in<\/p>\n<p>Computer Science in Sree Ayyappa College, Eramallikara without<\/p>\n<p>insisting on passing the NET. Reliance was also placed on Ext.P8 order<\/p>\n<p>dated 14.3.2001 issued by the Mahatma Gandhi University exempting<\/p>\n<p>Lecturers in Computer Science appointed during the period 1997-1999<\/p>\n<p>from passing the NET. The petitioners also challenged Ext.P16 on the<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                         -: 8 :-<\/span><\/p>\n<p>ground that it is not in tune with the regulations governing the field.<\/p>\n<p>It was contended that the provision in the regulations enabling the<\/p>\n<p>University   Grants    Commission     to   grant  exemption    does   not<\/p>\n<p>contemplate the prescription of any condition.        Though under the<\/p>\n<p>regulations, exemption can be limited to a specified period in respect<\/p>\n<p>of the University for which it is granted, it cannot be interpreted as an<\/p>\n<p>exemption in respect of the candidates and limited in duration of time<\/p>\n<p>rendering the appointee liable to be thrown out after the said period, it<\/p>\n<p>was contended. The petitioners contended that when the University<\/p>\n<p>Grants Commission grants exemption to a University for a specified<\/p>\n<p>period, candidates who have not passed the NET can be appointed in<\/p>\n<p>colleges affiliated to that University during the period specified in the<\/p>\n<p>order of exemption and that the said appointments would be perfectly<\/p>\n<p>in order and cannot be revoked on the ground that the candidates who<\/p>\n<p>were appointed have not passed the NET within the period of<\/p>\n<p>exemption. In other words, the contention of the petitioners was that<\/p>\n<p>during the period of exemption, a candidate who has not passed the<\/p>\n<p>NET, but is otherwise eligible can be validly appointed and that his<\/p>\n<p>appointment is liable to be approved unconditionally if it is made<\/p>\n<p>during the said period of exemption.        It was also contended that<\/p>\n<p>candidates appointed during the period of exemption cannot be<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 9 :-<\/span><\/p>\n<p>compelled to pass the NET during the period the exemption is in force.<\/p>\n<p>      7. The University Grants Commission resisted the Writ Petition<\/p>\n<p>contending inter alia that exemption from passing the NET is granted<\/p>\n<p>where (a) no NET examination is held in the subject or (b)NET\/SLET<\/p>\n<p>qualified\/exempted candidates were not available when the selection<\/p>\n<p>was held.     It was further contended that the University Grants<\/p>\n<p>Commission had at its meeting held on 13.8.2004 laid down the<\/p>\n<p>general criteria to be followed by the Exemption Committee while<\/p>\n<p>granting exemption and that individual cases were considered based<\/p>\n<p>on the said criteria. It was further contended that it was in the light of<\/p>\n<p>the norms thus evolved by the University Grants Commission on<\/p>\n<p>13.8.2004 (Ext.R3) that Ext.P16 order of exemption was passed and<\/p>\n<p>that it is open to the University Grants Commission to limit the period<\/p>\n<p>of exemption and to insist that those who are granted exemption<\/p>\n<p>should pass the NET during the period of exemption.\n<\/p>\n<p>      8. By the judgment under challenge, the learned Single Judge<\/p>\n<p>held that the stipulation in Ext.P16 that the petitioners should pass the<\/p>\n<p>NET during the period of exemption is not in tune with Ext.P12<\/p>\n<p>regulations and is therefore arbitrary.         The University Grants<\/p>\n<p>Commission has in this appeal canvassed the correctness of the said<\/p>\n<p>decision.\n<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                         -: 10 :-<\/span><\/p>\n<p>      9.  We have heard Sri.S.Krishnamoorthy, the learned counsel<\/p>\n<p>appearing for the appellant, Sri.K.R.B.Kaimal, the learned Senior<\/p>\n<p>Counsel appearing for respondents 1 to 3, Sri.M.Ragagopalan Nair, the<\/p>\n<p>learned Standing Counsel appearing for the fourth respondent<\/p>\n<p>University and Sri.A.N.Rajan Babu, the learned counsel appearing for<\/p>\n<p>the fifth respondent &#8211; Manager. The learned counsel appearing on<\/p>\n<p>either side reiterated the contentions advanced before the learned<\/p>\n<p>Single Judge, set out in detail in paragraphs 6 and 7 above.<\/p>\n<p>       10. It is clear from the University order dated 21.12.1996 which<\/p>\n<p>we have quoted above that candidates who seek appointment as<\/p>\n<p>Lecturer in Computer Science should have passed M.Sc. degree in<\/p>\n<p>Computer Science or MCA degree in Computer Science and NET\/SLET<\/p>\n<p>in the relevant subject. The qualification prescribed by the University<\/p>\n<p>for the post of Lecturer in Computer Science is in tune with the<\/p>\n<p>regulations issued by the University Grants Commission. Regulation 2<\/p>\n<p>of the University Grants Commission (Minimum Qualifications required<\/p>\n<p>for the Appointment and Career Advancement of Teachers in<\/p>\n<p>Universities and Institutions affiliated to it) Regulations, 2000,<\/p>\n<p>hereinafter referred to as the &#8220;Regulations&#8221; for short, reads thus:<\/p>\n<blockquote><p>            &#8220;2. Qualification: No person shall be appointed to a<\/p>\n<p>      teaching post in University or in any of institutions<\/p>\n<p>      including constituent or affiliated colleges recognised<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                      -: 11 :-<\/span><\/p>\n<p>     under clause (f) of section 2 of the University Grants<\/p>\n<p>     Commission Act, 1956 or in an institution deemed to be a<\/p>\n<p>     University under section 3 of the said Act in a subject if<\/p>\n<p>     he\/she does not fulfill the requirements as to the<\/p>\n<p>     qualifications for the subjects as provided in the<\/p>\n<p>     Annexure.\n<\/p><\/blockquote>\n<blockquote><p>           Provided that any relaxation in the prescribed<\/p>\n<p>     qualifications can only be made by the University Grants<\/p>\n<p>     Commission in a subject in which NET is not being<\/p>\n<p>     conducted or enough number of candidates are not<\/p>\n<p>     available with NET qualifications for a specified period<\/p>\n<p>     only. (This relaxation, if allowed, would be given based<\/p>\n<p>     on sound justification and would apply to affected<\/p>\n<p>     Universities for that particular subject for the specified<\/p>\n<p>     period. No individual applications would be entertained:)<\/p>\n<p>           Provided further that these regulations shall not be<\/p>\n<p>     applicable to such cases where selections of the<\/p>\n<p>     candidates having had the then requisite minimum<\/p>\n<p>     qualification as were existing at the time through duly<\/p>\n<p>     constituted     Selection   Committees       for   making<\/p>\n<p>     appointments to the teaching posts have been made prior<\/p>\n<p>     to the enforcement of these regulations.&#8221; (Emphasis<\/p>\n<p>     supplied).\n<\/p><\/blockquote>\n<p>In the Annexure to the Regulations, the qualifications prescribed for<\/p>\n<p>appointment to the post of Lecturer are as follows:\n<\/p>\n<blockquote><p>           &#8220;1.3.3 Lecturer<\/p>\n<p>             Good academic record with at least 55% of the<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                         -: 12 :-<\/span><\/p>\n<p>      marks or an equivalent grade of B in the 7 point scale<\/p>\n<p>      with latter grades O,A,B,C,D,E and F at Master&#8217;s degree<\/p>\n<p>      level, in the relevant subject from an Indian University,<\/p>\n<p>      or, an equivalent degree from a foreign University.<\/p>\n<\/blockquote>\n<blockquote><p>            Besides fulfilling the above qualifications, candidates<\/p>\n<p>      shoulid have cleared the eligibility test (NET) for Lecturers<\/p>\n<p>      conducted by UGC, CSIR or similar test accredited by the<\/p>\n<p>      UGC.&#8221;<\/p><\/blockquote>\n<p>      (Note omitted as it is not relevant in the case on hand)<\/p>\n<p>      11. In our opinion, the real question that arises is, what is the<\/p>\n<p>scope of the relaxation contemplated under the first proviso to<\/p>\n<p>Regulation 2 extracted above and whether Ext.P16 is in tune with the<\/p>\n<p>said proviso. Regulation 2 stipulates that no person shall be appointed<\/p>\n<p>to a post in a University or in any of its affiliated colleges unless he\/she<\/p>\n<p>possesses the qualifications prescribed in the Annexure to the<\/p>\n<p>Regulations. A pass in the NET in the subject concerned is one among<\/p>\n<p>the prescribed qualifications. However, the first proviso to Regulation<\/p>\n<p>2 empowers the University Grants Commission to grant relaxation<\/p>\n<p>from the prescribed qualifications, if NET is not being conducted in a<\/p>\n<p>subject or enough number of candidates with a pass in the NET were<\/p>\n<p>not available. The relaxation contemplated is in respect of the<\/p>\n<p>University concerned for that particular subject, for the period<\/p>\n<p>specified in the order granting relaxation.           The first proviso to<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 13 :-<\/span><\/p>\n<p>Regulation 2 also makes it clear that no individual application for<\/p>\n<p>relaxation of the prescribed qualifications will be entertained. In the<\/p>\n<p>instant case, the selection and appointment of the petitioners is not<\/p>\n<p>under challenge. There is no pleading or proof to the effect that the<\/p>\n<p>petitioners were selected overlooking qualified hands with a pass in the<\/p>\n<p>NET. It is evident from Ext.P16 that the University Grants Commission<\/p>\n<p>has chosen to exempt the petitioners from passing the NET for the<\/p>\n<p>reason that no NET qualified hand was available at the time when they<\/p>\n<p>were interviewed for selection to the post of Lecturer in Computer<\/p>\n<p>Science.   On the terms of the first proviso to Regulation 2 quoted<\/p>\n<p>above, non-availability of qualified hands with a pass in the NET is one<\/p>\n<p>ground for granting exemption. Therefore, in the case on hand, the<\/p>\n<p>petitioners have been rightly found eligible for the grant of exemption.<\/p>\n<p>Then the only question is whether the stipulation in Ext.P16 that the<\/p>\n<p>petitioners have to pass the NET within the period of exemption is<\/p>\n<p>sustainable in the light of the first proviso to Regulation 2 extracted<\/p>\n<p>above.\n<\/p>\n<p>      12. While Sri.S.Krishnamoorthy, the learned counsel for the<\/p>\n<p>appellant would contend that it is open to the University Grants<\/p>\n<p>Commission to insist that those who are granted exemption should<\/p>\n<p>pass the NET during the period of exemption, Sri.K.R.B. Kaimal, the<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 14 :-<\/span><\/p>\n<p>learned senior counsel appearing for respondents 1 to 3 would contend<\/p>\n<p>that on the terms of the first proviso to Regulation 2, the University<\/p>\n<p>Grants Commission cannot impose such a condition. It was contended<\/p>\n<p>that the University Grants Commission has no common standard or<\/p>\n<p>yardstick and that in Exts.P3 to P6 and Ext.P9 to P11 it had adopted<\/p>\n<p>different approach when exemption from passing the NET was granted<\/p>\n<p>in the years 2002 and 2003 in respect of teachers appointed in<\/p>\n<p>colleges affiliated to the University of Calicut in the subject, Computer<\/p>\n<p>Science. We have given our anxious consideration to the submissions<\/p>\n<p>made at Bar by the learned counsel appearing on either side.<\/p>\n<p>In our opinion, the relaxation contemplated under the first proviso<\/p>\n<p>to Regulation 2 is not an exemption granted to the candidates<\/p>\n<p>who have been chosen by the affiliated colleges or the University to<\/p>\n<p>which they are affiliated, from passing the NET in the concerned<\/p>\n<p>subject. The relaxation is for the University which has sought<\/p>\n<p>relaxation. Such relaxation can be granted only if the NET is not being<\/p>\n<p>conducted in a particular subject or if enough number of candidates<\/p>\n<p>with a pass in the NET were not available at the time of selection. The<\/p>\n<p>first proviso to Regulation 2 does not contemplate a situation where<\/p>\n<p>the candidate appointed during the period when the relaxation is in<\/p>\n<p>force, either in the University itself or in any of its affiliated colleges,<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 15 :-<\/span><\/p>\n<p>would have to pass the NET or face retrenchment if he or she does not<\/p>\n<p>pass the NET during the period the relaxation is in force.            The<\/p>\n<p>contention of the University Grants Commission that Ext.R3 (which is<\/p>\n<p>the same as Annexure A3 produced along with the Writ Appeal)<\/p>\n<p>empowers it to prescribe such a condition is in our opinion, plainly<\/p>\n<p>untenable and is not contemplated by the Regulations. Annexure A3<\/p>\n<p>proceeds on the erroneous assumption that individual requests for<\/p>\n<p>grant of exemption from passing the NET can be entertained. This is<\/p>\n<p>clearly prohibited by the first proviso to Regulation 2. The first proviso<\/p>\n<p>to Regulation 2 does not contemplate the grant of an exemption. It<\/p>\n<p>contemplates only a relaxation in the prescribed qualifications. That<\/p>\n<p>relaxation if granted is for the University concerned for the period<\/p>\n<p>specified in the order granting relaxation. If during the period the<\/p>\n<p>relaxation is in force, a teacher is appointed either in the University in<\/p>\n<p>respect of which relaxation is granted or in any of its affiliated or<\/p>\n<p>constituent colleges, it would enable the University\/constituent<\/p>\n<p>colleges\/affiliated colleges to appoint a candidate who has not passed<\/p>\n<p>the NET in the concerned subject during the period the relaxation is in<\/p>\n<p>force. The relaxation contemplated in the first proviso to Regulation 2<\/p>\n<p>is not a relaxation from possessing the basic educational qualifications,<\/p>\n<p>but only from passing the NET. The first proviso to Regulation 2 does<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 16 :-<\/span><\/p>\n<p>not contemplate an order of exemption in respect of a particular<\/p>\n<p>candidate for a specified period and does not empower the University<\/p>\n<p>Grants Commission or any of its committees to impose a condition<\/p>\n<p>similar to the one stipulated in Ext.R3 that the candidate should pass<\/p>\n<p>the NET during the period of exemption. Regulation 2 does not<\/p>\n<p>stipulate that the University Grants Commission may subject to such<\/p>\n<p>conditions as it may deem fit to impose, grant relaxation from passing<\/p>\n<p>the NET. As the grounds on which relaxation can be granted are set<\/p>\n<p>out in the first proviso to Regulation 2 itself, the          Exemption<\/p>\n<p>Committee and the University Grants Commission are not competent<\/p>\n<p>to impose conditions for the grant of relaxation. Though the norms<\/p>\n<p>evolved by the Exemption Committee as set out in paragraph 2 of<\/p>\n<p>Ext.R3 are in tune with the first proviso to Regulation 2, the conditions<\/p>\n<p>stipulated in paragraphs 1 and 3 thereof run counter to the first<\/p>\n<p>proviso to Regulation 2. We therefore hold that an order of relaxation<\/p>\n<p>issued by the University Grants Commission in exercise of the power<\/p>\n<p>conferred on it under the first proviso to Regulation 2 to a particular<\/p>\n<p>University would enable the said University or its constituent or<\/p>\n<p>affiliated colleges to appoint candidates who have not passed the NET<\/p>\n<p>in the concerned subject during the period when the relaxation is in<\/p>\n<p>force and that persons appointed during the period when the<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 17 :-<\/span><\/p>\n<p>relaxation is in force, are not required to pass the NET during the said<\/p>\n<p>period or thereafter and are not liable to be retrenched, if they do not<\/p>\n<p>pass the NET on the cessation of the period of relaxation. It is evident<\/p>\n<p>from Ext.P16 itself that no candidate with a pass in the NET\/SLET was<\/p>\n<p>available when the petitioners were interviewed, selected and<\/p>\n<p>appointed as Lecturers in Computer in Science in Sree Narayana<\/p>\n<p>College, Cherthala. Their eligibility for the grant of exemption is also<\/p>\n<p>not in dispute. Further, they were appointed in the year 1999 and<\/p>\n<p>more than 8 years have passed thereafter. In these circumstances,<\/p>\n<p>we are not inclined to remit the matter to the University Grants<\/p>\n<p>Commission for a denovo consideration.\n<\/p>\n<p>      13. As noticed by us earlier, under the first proviso to Regulation<\/p>\n<p>2 of the Regulations, relaxation from passing the NET can be granted if<\/p>\n<p>NET is not conducted in the concerned subject or if no candidate<\/p>\n<p>having a pass in the NET was available when the selection was made.<\/p>\n<p>The relaxation can be granted, if either of the two conditions exist.<\/p>\n<p>Therefore even if during the relevant time, the NET was being held in<\/p>\n<p>Computer Science, relaxation can be granted if no candidate<\/p>\n<p>possessing the said qualification participated in the selection process.<\/p>\n<p>In the case on hand, a stalemate has arisen due to the wrong exercise<\/p>\n<p>of power of relaxation by the University Grants Commission without<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 18 :-<\/span><\/p>\n<p>properly understanding the scope of the power to grant relaxation.<\/p>\n<p>Further, it is evident from Exts.P3 to P6 and P9 to P11 that the<\/p>\n<p>University Grants Commission has granted exemption to a number of<\/p>\n<p>teachers appointed in the colleges affiliated to the University of Calicut<\/p>\n<p>from passing the NET without the stipulation that they shall pass the<\/p>\n<p>NET within the specified period.      Exts.P3, P4, P5 and P6 relate to<\/p>\n<p>Lecturers in Computer Science appointed in colleges affiliated to the<\/p>\n<p>University of Calicut. In those cases, no such condition as in Ext.P16<\/p>\n<p>has been imposed. It is evident that while issuing Ext.P16, the<\/p>\n<p>University Grants Commission has not taken note of the real purport of<\/p>\n<p>the first proviso to Regulation 2.\n<\/p>\n<p>      14. <a href=\"\/doc\/771294\/\">In Principal, King George&#8217;s Medical College v. Dr.Vishan<\/p>\n<p>Kumar Agarwal and<\/a> another &#8211; (1984) 1 S.C.C. 416 the Apex Court<\/p>\n<p>held that as the University has granted relaxation to two other<\/p>\n<p>candidates for admission to the M.D. course, it would be unfair to treat<\/p>\n<p>the respondent differently though he was similarly situated. In the<\/p>\n<p>instant case, both the University Grants Commission and the University<\/p>\n<p>have adopted a different yardstick in the case of the petitioners. The<\/p>\n<p>University Grants Commission has treated the petitioners differently<\/p>\n<p>from the Lecturers named in Exts.P3 and P6 in the matter of grant of<\/p>\n<p>exemption from passing the NET. Exts.P3 to P6 relate to Lecturers in<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 19 :-<\/span><\/p>\n<p>Computer Science, appointed in the Colleges affiliated to the University<\/p>\n<p>of Calicut. In those cases, the University Grants Commission did not<\/p>\n<p>impose a condition similar to the one in Ext.P16 that they should clear<\/p>\n<p>the NET during the period of exemption. Exts.P3 to P6 are in tune with<\/p>\n<p>the interpretation which we have placed on the first proviso to<\/p>\n<p>Regulation 2 of the Regulations. Likewise, the University has by Ext.P7<\/p>\n<p>exempted three Lecturers in Computer Science appointed on 1.6.1998<\/p>\n<p>in one of its affiliated Colleges (Sree Ayyappa College) from passing<\/p>\n<p>the NET and approved their appointment with effect from 1.6.1998.<\/p>\n<p>The University also has adopted a different yardstick in the case of the<\/p>\n<p>petitioners. Therefore, it is crystal clear that though the petitioners<\/p>\n<p>were found to be eligible for grant of relaxation in terms of the first<\/p>\n<p>proviso to Regulation 2, the University Grants Commission and the<\/p>\n<p>University have treated them differently by imposing a condition that<\/p>\n<p>is not prescribed in the Regulations. The condition stipulated in Ext.P16<\/p>\n<p>that the petitioners shall pass the NET during the period of exemption<\/p>\n<p>is ultravires the Regulations. The said stipulation is therefore liable to<\/p>\n<p>be declared invalid and unenforceable.\n<\/p>\n<p>       15. In the instant case, the appellants were appointed in<\/p>\n<p>December, 1999 after a widely published selection process. They have<\/p>\n<p>been discharging their duties for the past more than 8 years and have<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                        -: 20 :-<\/span><\/p>\n<p>gained experience as Lecturers in Computer Science. It would not<\/p>\n<p>therefore be proper to send them out of service at this distance of<\/p>\n<p>time. In Ajet Kumar and others v. K.V.Sunil Kumar and another<\/p>\n<p>&#8211; ILR 1993(2) Kerala 765, a Division Bench of this Court following the<\/p>\n<p>decision of the Apex Court in <a href=\"\/doc\/1867070\/\">Munindra Kumar v. Rajiv Govil<\/a> &#8211; A.I.R.<\/p>\n<p>1991 S.C. 1607 held that though the selection of the appellants is<\/p>\n<p>liable to be set aside, as they were working in the post for a long<\/p>\n<p>number of years, the selection should not be disturbed. It was held<\/p>\n<p>that their selection should not be annulled in the absence of plea or<\/p>\n<p>proof of any malafides, after a long number of years.<\/p>\n<p>      16. For the reasons stated above, we hold that the exemption<\/p>\n<p>granted to the petitioners by Ext.P16, from passing the NET in<\/p>\n<p>Computer Science shall be treated as an order of relaxation issued<\/p>\n<p>under the first proviso to Regulation 2 in respect of the University of<\/p>\n<p>Kerala for appointment to the post of Lecturer in Computer Science<\/p>\n<p>during the year 1999-2000 when the petitioners were selected and<\/p>\n<p>appointed. We also declare that the stipulation in Ext.P16 that the<\/p>\n<p>petitioners should pass the NET within two years from the date of<\/p>\n<p>Ext.P16 is ultravires the Regulations and is unenforceable.        We<\/p>\n<p>accordingly direct the University of Kerala to approve the appointment<\/p>\n<p>of the writ petitioners as Lecturers in Computer Science without<\/p>\n<p><span class=\"hidden_text\">WA 1796\/07                       -: 21 :-<\/span><\/p>\n<p>insisting on a pass in the NET, with effect from the dates mentioned in<\/p>\n<p>Ext.P2. The writ petitioners would also be entitled to all consequential<\/p>\n<p>benefits.\n<\/p>\n<p>       The Writ Appeal is disposed of as above.
