No. 2560 of 2008\n                  ................................................\n                Dated this the 30th day of July 2008\n\n                                   O R D E R\n<\/pre>\n<p>      In this Revision Petition filed under Section 397 read with Sec.<br \/>\n401 Cr.P.C. the petitioner who was the accused in C.C. No. 687 of<br \/>\n2003 on the file of the J.F.C.M. I, Attingal challenges the conviction<br \/>\nentered and the sentence passed against                      him for an offence<br \/>\npunishable under Sec. 138 of the Negotiable Instruments Act, 1881<br \/>\n(hereinafter referred to as &#8216;the Act&#8217;).\n<\/p>\n<p>      2.    I heard the learned counsel for the Revision Petitioner and<br \/>\nthe learned Public Prosecutor.\n<\/p>\n<p>      3.    The learned counsel appearing for the Revision Petitioner<br \/>\nre-iterated the contentions in support of the Revision. The courts<br \/>\nbelow have concurrently held that the cheque in question was drawn<br \/>\nby the petitioner in favour of the complainant on the drawee bank,<br \/>\nthat the cheque was validly presented to the bank, that it was<br \/>\ndishonoured for reasons which fall under Section 138 of the Act, that<br \/>\nthe complainant made a demand for payment by a notice in time in<br \/>\naccordance with clause (b) of the proviso to Section 138 of the Act<br \/>\nand that the Revision Petitioner\/accused failed to make the payment<br \/>\nwithin 15 days of receipt of the statutory notice.                 Both the courts<br \/>\nhave considered and rejected the defence set up by the revision<br \/>\npetitioner while entering the above finding.                  The said finding has<br \/>\nbeen recorded on an appreciation of the oral and documentary<br \/>\nevidence. I do not find any error, illegality or impropriety in the<br \/>\nfinding so recorded concurrently by the courts below. The conviction<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 2560 of 2008         -:2:-<\/span><\/p>\n<p>was thus rightly entered against the petitioner.\n<\/p>\n<p>       4.      What now survives for consideration is the question as to<br \/>\nwhether what should be the proper sentence to be imposed on the<br \/>\nrevision petitioner. Having regard to the facts and circumstances of<br \/>\nthe case, I am inclined to modify the sentence imposed on the revision<br \/>\npetitioner. In the light of the recent decision of the Supreme Court in<br \/>\nEttappadan Ahammedkutty v. E.P. Abdullakoya &#8211; 2008 (1) KLT 851<br \/>\ndefault sentence cannot be imposed for the enforcement of an order<br \/>\nfor compensation under Sec. 357 (3) Cr.P.C. Accordingly, for the<br \/>\nconviction under Section 138 of the Act the revision petitioner is<br \/>\nsentenced to pay a fine of Rs. 45,000\/-(Rupees forty five thousand<br \/>\nonly).        The said    fine shall be paid to the complainant       as<br \/>\ncompensation under Section 357 (1) Cr.P.C. The revision petitioner is<br \/>\npermitted either to deposit the said fine amount before the Court<br \/>\nbelow or directly pay the compensation to the complainant within<br \/>\nfour months from today and produce a memo to that effect before the<br \/>\ntrial Court in case of direct payment. If he fails to deposit or pay the<br \/>\nsaid    amount within the aforementioned period          he shall suffer<br \/>\nsimple imprisonment for three months by way of default sentence.\n<\/p>\n<p>       In the result, this Revision is disposed of confirming the<br \/>\nconviction     entered but modifying the sentence       imposed on the<br \/>\nrevision petitioner.\n<\/p>\n<p>       Dated this the 30th day of July 2008.\n<\/p>\n<p>                                               V.
